Subject:Temporary Exceptions Renewed to Rules R309-515-6(4) and R309-600-13(3) for Well #7; Eagle Mountain City; Water System #25142, File #12707, Source No. WS013
These Temporary Exceptions expire on May 1, 2025.
Dear Mack Allen Straw:
The Division of Drinking Water (the Division) received your request to renew the temporary exceptions to Rules R309-515-6(4) and R309-600-13(3) for proposed Well #7 via email on April
10, 2024. The original exceptions were scheduled to expire on October 6, 2024. Drilling of Well #7 is ongoing. Drilling conditions have been difficult, and an estimated date of completion
cannot be determined at this time.
Rule R309-600-13(3) indicates that a Public Water System shall not locate a new ground-water source of drinking water (in an unprotected aquifer) where sewer lines exist within zones
one and two unless the sewer line(s) are at least 50 feet from the wellhead and constructed in accordance with R309-515-6. Sewer lines located within the proposed zone two for Well #7
are not constructed in accordance with R309-515-6. You based your request for a renewal of the exceptions on the following:
The sewer line(s) located within zones one and two are unpressurized gravity-flow line(s).
The sewer line(s) and manholes are video inspected every six years as part of the previous exceptions to rule granted for Well #3.
The stretch of sewer located in proposed zone two was last inspected on June 11, 2020 (except for those located on White Birch Drive) with no defects or areas of concern noted.
If Well #7 proves up, a revised Drinking Water Source Protection (DWSP) Plan will be submitted for the well field which will include Well #3 (WS004), Well #5 (WS006), and Well #7 (WS013).
On this basis, temporary exceptions to rules R309-515-6(4) – Source Protection and R309-600-13(3), Sewers within DWSP Zones and Management Areas are hereby granted subject to the following
conditions:
These temporary exceptions expire on May 1, 2025, or when the final/revised DWSP plan is submitted to the Division, whichever comes first.
You will be required to re-submit an exception request along with confirmation that all conditions outlined have been fulfilled and obtain an exception renewal prior to May 1, 2025.
You must provide adequate documentation that all sewer lines and manholes located within final zone two for the well-field have been video inspected and any identified defects or concerns
remedied.
Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether these exceptions can be re-issued.
Failure to request the re-evaluation of these exceptions and obtain an exception renewal by May 1, 2025, will result in the activation of a SP03 (DWSP PLAN NOT IMPLEMENTED ACCORDING
TO MANAGEMENT STRATEGIES IN DWSP) significant deficiency on the system’s Improvement Priority System (IPS) report.
These temporary exceptions may be rescinded any time if new evidence indicates that the conditions of these exceptions are no longer being met or a public health risk exists due to the
