Cole and Clay Peck: This Administrative Order for Information is being sent to your attention regarding Peck Rock and Products Co., L.C.(Respondent). According to the Division of Waste Management and Radiation Control (Division) records,you are the designated contact persons for the Respondent.On December 5, 2023, the Division sent Compliance Advisory No. 2311141 (DSHW-2023-211367) to provide the Respondent with notice and the opportunity to correct violations as a result of a compliance evaluation inspection at the Peck Rock and Products CD Landfill (Landfill) on October 23, 2023. Based on the documentation received in response to the Compliance Advisory, the Division is requesting a site characterization plan to include sampling and analysis in order to determine the extent and nature of potential contamination caused by unpermitted sludge acceptance. Within 15 days of the date of this Administrative Order for Information, please submit the following requested documentation to the Director: A site characterization plan that includes a detailed proposal for sampling and analyzing the location, quantity, nature, and extent of sludge present at the Landfill Within 60 days of the date of this Administrative Order for Information, please submit the following requested documentation to the Director: A site characterization report that details the findings of the site characterization plan and proposes remedial actions and other recommendations accordingly. To better protect confidential or protected records, all such documents and information must be submitted in paper form, using the U.S. Mail address above. If the Respondent demonstrates that it has taken appropriate corrective actionsregarding the matters addressed in this Compliance Advisory, the Director will issue a closeout letter and will consider this matter to be closed. In that event, the Director forbears seeking penalties arising from the violations. However, if the Respondent fails to demonstrate appropriate corrective actions within the30-day timeframe, the Director will consider taking escalated enforcement actions, including the potential imposition of penalties. In all events, the matters addressed in this Administrative Order for Information, including the Respondent’s corrective actions, will become part of the Respondent’s compliance record and may be considered in connection with future enforcement matters.
