This department and the local fire department must be notified 72 hours before beginnlng closure activities. The Health Department does charge inspection fees (see enclosures). The Closure Plan approval is effective for a period of one year from the date of approval. lf closure does not take place within one year, submittal of a new Closure Plan will be required, unless otherwise approved by the Executive Secretary. Our records indicate that the tank remover you intend to use has a certificate which expires within 5 months. Il you want to use Automatic Tank Gauging as your leak detection method, you must perform at least one valid leak test each month, and keep the results of those tests. The Utah Underground Storage Tank (UST) Act provides that the Executive Secretary (UST) may revoke a Certificate of Compliance if it is determined that a facility is not in substantial compliance with all state and federal UST statutes, rules and regulations. At the request of the Executive Secretary (UST), the Division of Environmental Response and Remediation (DERR) performed a compliance review for the underground storage tanks at the above facility. The compliance review, performed on April 22,1999, indicates you have not satisfied the requirements of the Act and are out of compliance. To achieve compliance you must do the following: L Submit evidence that proper lnventory Control is performed on UST # I (12,000 gallon gasoline) by; a. Documenting that inventory records are reconciled monthly to determine the total overage or shortage for each UST, and the variance is compared to the allowable of 130 gallons plus one percent of the UST's monthly throughput. The inspection report indicates that the inventory records are being kept, but the reconciliation is not being done at the end of the month. Please submit records for the last l2 months to show that the reconciliation is done. b. Documenting that you meter the product withdrawals and maintain the dispensers to a calibration accuracy of six cubic inches for every five gallons of product withdrawn. Other: The inspection report indicates that the primary leak detection method used for this tank is "Tank Tightness Testing and Inventory Control," with the Automatic Tank Gauge (ATG) being used only to provide the stick readings for the inventory control. The Federal UST regulations require that, once an UST is upgraded, Tank Tightness Testing and Inventory Control can be used as the leak detection method for only 10 additional years after the upgrade. Information we have on file indicates that the tank was upgraded in 1991; if this is the case you would have to cease using tank testing/inventory control by 2001 and begin using the monthly ATG leak tests as the leak detection method on the tanks. The above information must be submitted to this office by June 15, 1999. If it is not received by the date specified, we will commence the revocation process of your Certificate of Compliance. These tanks are located at QUESTAR GAS, 45 E 200 N, Logan, facility ID# 0100148. Under Federal regulations issued in 1988, UST owners and operators have until December 22, 1998 to upgrade, replace, or permanently close USTs that do not meet the requirements for protection against spills, overfills, and corrosion. This deadline will not be extended. If your tanks are not in compliance by the deadline, they will not be able to receive deliveries of fuel. The DERR encourages owners and operators to meet the 1998 upgrade requirements as soon as possible before the December 22, 1998 deadline. It can take several months to upgrade, close or replace an UST system. Delays are not unusual, and contractors may not be available if you wait. Start planning now! The Utah Underground Storage Tank (UST) Act provides that the Executive Secretary ruSD may revoke a Certificate of Compliance if it is determined that a facility is not in substantial compliance with all state and federal UST statutes, rules and regulations. At the request of the Executive Secretary (UST), the Division of Environmental Response and Remediation (DERR) performed a compliance review for the underground storage tanks at the above facility. The compliance review, performed on January 9. 1998, indicates you have not satisfied the requirements of the Act and are out of compliance. To achieve compliance you must do the following: 2. Submit a copy of a current annual (performed in the last 12 months) test for proper operation of the automatic line leak detector on the pressurized product line associated with UST # I . 3. Submit documentation to show whether the tank and piping are cathodically protected. The inspection report indicates the tank and piping are not cathodically protected. An inspection done in 1995 indicated the tank and piping were protected and reported a passing test result of a cathodic protection test done in 1994. If the tank and piping are cathodically protected, a test of the cathodic protection system must be done every three years. If the tank and piping are not protected, they must be protected or removed by the December 1998 upgrade deadline. If you are performing Automatic Tank Gauging as your leak detection method on UST #1, meet item 4 below. If you are doing Tank Tightness Testing/Inventory Control as your leak detection method, meet item 5 below: 4. Submit evidence that proper Automatic Tank Gauging (ATG) is performed on UST # 1 by a. Documenting that the ATG system performs a leak test at least once a month. Please submit copies of records to show that the monthly leak tests have been performed for the last 12 months. 5. Submit evidence that proper Tank Tightness Testing/Inventory Control is performed on UST # 1 by: a.Submitting a copy of a current (performed in the last l2 months) precision tank tightness test for UST # I . l. Submit a copy of a current (performed in the last 12 months) precision line tightness test for the product line associated with UST # 1 (12.000 gallon premium). 1 b. Submitting copies of properly-completed inventory control records for the last 12 months. The inspection report indicates the records were not on site for the inspection. c. Documenting that you meter the product withdrawals and maintain the dispensers to a calibration accuracy of six cubic inches for every five gallons of product withdrawn.
