Dear Mr. VonHatten:
The file for this release has been reviewed by the Division of Environmental Response and
Remediation (DERR) project manager who has recommended that no further corrective action be
taken at this time. This no further action applies only to the specific Release Site OIR. This
recommendation is based on the information contained in the file for this release. That information
was supplied by you, your consultant, or another representative.
The information submitted indicates that petroleum contamination of the soil remains from
this release. The contamination is at locations that are not currently considered a threat to human
health or the environment according to Utah Admin. Code R311-211. This evaluation is based on
current land usage, exposure pathways, potential receptors and other site-specific risk
characteristics. In the future, if changes to these characteristics create a threat to human health or
the environment, additional corrective action may be required.

SUBJECT: No Further Action, Leaking Underground Storage Tank Release
Bingham Canyon Mine Kennecott, located at 8362 West 10200 South, Salt Lake City,

A release of petroleum was reported to the Division of Environmental Response and Remediation
on September 5, 2023 based on Environmental Incident Report Number 16633. The extent and degree of
contamination has been fully defined and a No Further Action (NFA) review is hereby requested.
Case file information justifying no further action includes the following:
Due to a small landslide in August 2023, a temporary fuel system was in use. On September 5,
2023 approximately 1,500 gallons of diesel fuel spilled onto the concrete pad and adjacent
compacted road while fuel was being transferred to the pup trailer at the temporary fueling
station. This was caused by the operator inadvertently missing a step in when opening a vent
valve during the unloading process.
Kennecott Utah Copper assessed the site and initiated clean-up efforts immediately after the
spill by removing approximately 50 tons of soil and applying a new road base. The
contaminated soil was sampled and disposed of at a permitted Class III industrial landfill.
Soil samples taken on November 9, 2023 confirm contamination is below Tier 1 clean up
levels. The primary fuel station is in operation again. This fuel station includes secondary
containment and underground piping within a vault system that will direct any spills to an
additional large catch basin.
