SUBJECT: Oclober 20, 2009 DUSA Letter; Oclober 8, 2009 DRC Letter; Amendment Requests
Relating to Freeboard Limit Calculations for Tailings Cells and Control of Storm Water
from Overtopping Cell 3; Response to Proposal Review Request
We received a letter on the subject from DUSA, dated October 20, 2009, which conveys a proposal for
services from a consultant, and also requests that DRC review such for completeness. Afler consideration
of your request, we have determined not to participate for the following reasons:
The problem outlined in our October 8, 2009 request for informalion (RFf) involves defining geometry/
grading and corresponding hydraulic analyses. We believe the DRC RFI adequately defines the scope of
the task. Fmther, the information required is within the confines of standard civil engineering practice.
DUSA has the engineering capability to review this proposal and supervise a consultant to complete the
defined scope of the task. More than one meihod is available to solve the problem, and it is DUSA's
responsibility as a company to decide how best to resolve the issues raised in the RFI.
However. DRC staff is available to discuss the RFI fiirther, or lo answer related questions in a meeting or
conference call. If such i.s needed, please contact Mr. Rupp or myself to make arrangements.
