SUBJECT: June 22, 2009 RAM LLC Letter: License UT 1900481, [Lisbon Mine Site, La Sal,
Utah] 2009 Annual Surety Update; November 20, 2008 Utah Division of Radiation
Control (DRC) Letter; Status Summary and Request for Additional
Information
We received a letter from Mr. Chuck Wentz of RAM, dated June 22, 2009, subject as above. The
letter requests a reduction of surety down to the work remaining for ground water monitoring and
long term maintenance. Our subject letter of November 20, 2008 discusses the status summary at
the site.
The DRC letter of November 20, 2008 states, "It appears that all the [visual] deficiencies raised by
DRC have been satisfactorily addressed, except regarding revegetation and soil contouring." This
letter then discusses the revegetation and soil contouring issue in detail. DRC has yet to make a
foiTnal inspection ofthe work on these visual deficiencies, but should do so in the near future.
As far as further reduction of the surety amount for reclamation, pre-requisite documentation in
accordance with the current Radioactive Materials License Conditions 27, 52, and 55 would be
needed to assure there are no hidden (non-visual) deficiencies. This would include, but is not
limited to:
1. A completion report and as-built drawings, verifying that reclamation of the site has
been performed according to the approved reclamation plan.
Summaries of results of the quality assurance and control testing to demonstrate that
the approved specifications were met.

3. The above documentation would need to be certified by a Utah-licensed Professional
Engineer.
4. Other documentation to assure the surface reclamation was performed according to:
a. License Conditions, including inspections to ensure that radon emissions
comply with I0CFR40, Appendix A, Criterion 6, and
b. NRC regulations.
Pending RAM's submittal of this information and DRC's review and approval thereof the
existing surety amount must remain constant at $2,214,366.
