Topham, PE c. / Phil Goble, Uranium Mill Section Manager FROM: Heather Mickelson, PE DATE: August 17,2017 SUBJECT: 2017 Engineering Module 73, Inspection of disposal of 1 le.(2) decommissioning debris from in situ leach facilities Authority Radioactive Materials License #UT1900479, Condition 10.5: “In accordance with the Licensee's submittal to the NRG dated May 20, 1993, the Licensee is hereby authorized to dispose of byproduct material generated at licensed in situ leach (ISL) facilities, subject to [...] conditions.” (Conditions are included below in the Requirements section.) R313-12-3 (quoting 10 CFR 40.4): “Byproduct Material means the tailings or wastes produced by the extraction or concentration of uranium or thorium from any ore processed primarily for its source material content, including discrete surface wastes resulting from uranium solution extraction processes.”1 10 CFR Part 40 Appendix A, Criterion 2: “To avoid proliferation of small waste disposal sites and thereby reduce perpetual surveillance obligations, byproduct material from in situ extraction operations, such as residues from solution evaporation or contaminated control processes, and wastes from small remote above ground extraction operations must be disposed of at existing large mill tailings disposal sites; unless, considering the nature of the wastes, such as their volume and specific activity, and the costs and environmental impacts of transporting the wastes to a large disposal site, such offsite disposal 1 This definition amends the language given in Section 1 le.(2) of the Atomic Energy Act as amended in 1954 to include ISL facilities on the same footing as conventional uranium mills. Topham, PE, observed disposal of six loads of 1 le.(2) byproduct material on August 10, 2017 at the White Mesa Uranium Mill. The mill is owned and operated by Energy Fuels Resources (the Licensee). Notification of the disposal was sent by the Licensee by email on July 15,2017. This inspection was specific to the Licensee’s implementation of Standard Operating Procedure SOP PBL-10, which governs disposal of 1 le.(2) byproduct material from ISL facilities. The 1 le.(2) byproduct material for disposal was from four generators. One load was received from Energy Fuels Resources - Nichols Ranch in Linch Wyoming; two loads from Cameco Resources - Cameco-Smith Ranch in Douglas Wyoming; two loads from Uranium One Americas - Irigaray/Christensen Projects in Linch Wyoming; one load came from South Texas Mining Venture LLP - UEC/La Palanga in Benavides, Texas. The Licensee maintains a map of Tailings Cell 3 in the mill office that shows the dedicated disposal location for each 1 le.(2) byproduct material generator. This map was reviewed with the Licensee in the mill office. The generator disposal areas are marked within the tailing cell. A photo log is attached and shows disposal activities for each of the waste generators. Lateral disposal pit locations were determined and located in the field by survey prior to excavation and prior to DWMRC arrival. The bottom of the excavations extended into the tailings sand, and the depth was surveyed prior to placement of material into the excavation. Once the 1 le.(2) byproduct material was placed in the excavation and compressed, the top of the material was surveyed (Photos 2, 5, and 11). Clean cover was then placed and compacted (Photos 2, 3, 6, 8, 9, and 12). The lateral extent of the burial is below the top line and above the bottom liner. The Nichols Ranch 1 le.(2) byproduct material consisted of trash and pipe (Photo 1). The burial pit liquids splashed to the surface of the cell as the loader and bull dozer were filling and compacting the burial hole (Photo 3). These liquids made it difficult to completely compact and cover the burial cell while DWMRC was onsite. The Licensee completely compacted with the cover after it had dried. Confirmation of this compaction was received on August 16, 2017 in the Nichols Ranch data packet (See attachment). The Uranium One 1 le.(2) byproduct material consisted of trash and hoses (Photo 4). The Cameco-Smith Ranch 1 le.(2) byproduct material was trash and pipe that was received in barrels (Photo 7). Prior to August 10, 2017, the barrels were opened and the material was removed from the barrels. Both the barrels and the material contained in the barrels were crushed to allow the clean cover material to fill the void spaces of the compacted waste (Photo 7). Third Quarter, 2017 ISL Decommissioning Debris Disposal Inspection Report August 17, 2017 Page 3 The La Palanga 1 le.(2) byproduct material consisted of pipe, barrels, and trash (Photo 10). Prior to August 10, 2017, the barrels were crushed to allow the clean cover material to fill the void spaces of the compacted waste (Photo 11). Present during a close out meeting to discuss observations during the inspection included Heather Mickelson and Russ Topham (Division), Logan Shumway (Plant Manager), David Turk (Radiation Safety Officer), Garrin Palmer, and Tanner Holiday. Copies of paperwork obtained from field crews show that the Licensee used revision R-3.3 of SOP PBL- 10, dated November 13, 2014 for the operations observed. Revision R-3.3 is the most recent version of the procedure. A copy of the data packet for each load is attached to this report. Requirements and Compliance Determination Radioactive Materials License #UT1900479, Condition 10.5B: “All ISL contaminated equipment shall be dismantled, crushed, or sectioned to minimize void spaces. Barrels containing waste other than soil or sludges shall be emptied into the disposal area and the barrels crushed. Barrels containing soil or sludges shall be verified by the Licensee to be full prior to disposal. Barrels not completely full shall be filled with tailings or soil prior to disposal.” The activities observed and information gathered during this inspection supports a conclusion that the Licensee is complying with this license condition. The 1 le.(2) byproduct material from Cameco-Smith Ranch and La Palanga load barrels contained trash and pipes and was crushed to minimize void spaces. Radioactive Materials License #UT1900479, Condition 10.5C: “All ISL waste shall be buried in Cell No. 3 unless prior written approval is obtained from the Executive Secretary [now Director] for alternate burial locations.” The activities observed and information gathered during this inspection supports a conclusion that the Licensee is complying with this license condition. All 1 le.(2) byproduct material was buried in Tailings Cell 3. Radioactive Materials License #UT1900479, Condition 10.5D: “All disposal activities shall be documented and records thereof maintained on-site. The documentation shall include descriptions of the ISL waste and the disposal locations, as well as all actions required by this License condition.” The activities observed and information gathered during this inspection supports a conclusion that the Licensee is complying with this license condition. The Licensee maintains records of the 1 le.(2) byproduct material disposed of onsite. These records include document the nature of each load of material received, where it is buried, and how it was handled, including all measures taken to comply with all of License Condition 10.5. Radioactive Materials License #UT1900479, Condition 10.5E: “The Licensee shall also submit for Executive Secretary [now Director] approval a revised written Standard Operating Procedure (SOP) for ISL disposal on or before December 1, 2010. The revised SOP shall describe the documentation required for ISL disposal, which shall include but is not limited to the following:” Third Quarter, 2017 ISL Decommissioning Debris Disposal Inspection Report August 17, 2017 Page 4 (1) The material disposal area must be located on a tailings beach area of the disposal cell or on an area of the cell that is underlain by tailings sands; (2) The elevation of the material disposal area will not exceed the plane or grade of the elevations of the uppermost flexible membrane liner of the tailings cell; (3) Such ISL byproduct material will be segregated from any mill material and equipment disposed of in the cells pursuant to License Condition 10.4, and the ISL byproduct material from each in situ leach source will be segregated from the byproduct material from all other in situ leach sources; (4) Absence of void space inside barrels disposed, including physical verification before disposal; and (5) Detailed engineering drawings which demonstrate: a. There are at least 4 feet of tailings sands under the bottom of each disposal area; and b. The bottom of each disposal area is located at least 12 feet from the sides or dikes of the tailings cell. The activities observed and information gathered during this inspection supports a conclusion that the Licensee is complying with this license condition. The Licensee met the requirement to submit the procedure with the initial version of SOP PBL-10, and now uses Revision R-3.3, dated November 13, 2014. Revision R-3.3 addresses all of the items specified in License Condition 10.5. The original version and every subsequent revision of this procedure were submitted to the Division for review and approval prior to implementation. Further, the Licensee is complying with the SOP, such as segregating generator 1 le.(2) byproduct material streams, minimizing void space, and placing the waste in the tailing sands with at least four feet of sands below it and at least 12 feet from the side or dike of the cell. Radioactive Materials License #UT1900479, Condition 10.5F: The Licensee shall notify the Executive Secretary [now Director] in writing at least 7 calendar days prior to the proposed scheduled date for disposal of any byproduct material generated at ISL facilities in the tailings cells. 0An annual summary of the amounts of waste disposed of from off-site ISL generators shall be sent to the Executive Secretary [now Director] on or before November 1 of each calendar year. The activities observed and information gathered during this inspection supports a conclusion that the Licensee is complying with this license condition. The Division received notice of the disposal on July 18, 2017, which is greater than 7 days in advance of burial on August 10, 2017. The annual summary submittal will be evaluated by DWMRC separately from this inspection. Conclusions and Recommendations The Licensee appears fully compliant with applicable laws, standards, requirements and License Conditions with respect to disposal of 1 le.(2) byproduct material generated as decommissioning debris from ISL uranium recovery facilities. No new recommendations were identified during this inspection.
