The Division has received your 2023 Financial Assurance Test documents.Upon review of the documents, the Division has determined that the claim of business confidentiality made by McWane,
Inc meets the requirements of Utah Code Section 63G-2-309 and the standards of the federal Freedom of Information Act (FOIA), 5 U.S.C. Section 552, which standards apply to the records
under Utah Code Section 19-1-306(2). As a result, the Division will manage the records in accordance with Utah Code 63G-2-305. Future consideration of record disclosure is also subject
to Utah Code Section 63G-2-309(1)(b) and (2).
NOTICE OF APPEAL RIGHTS
This letter involves an agency action. If you disagree with the agency determination described above, you may appeal the agency determination within 30 days of the date of this letter
by filing a notice of appeal, in accordance with Utah Code Section 63G-2-401, to the following chief administrative officer for the Division:
