The DERR office and the local fire department must be notified 72 hours betore beginning closure activities. Please be sure the DERR office and the Tri-County Health Department are contacted at least 72 hours before the closure takes place. The fifth UST was found to be an attachment to property owned by Max Eggertsen, as Trustor of adjacent property Lots 6, 7, 8 and 9, Block 30, Duchesne City Survey, according to the official plat thereof as found in the office of the Recorder, Duchesne County, Utah. The five (5) USTs are attested in the Notification of Underground Storage Tanks Edwin G. Richman signed on May 7, 1986, and submitted to the Division of Environmental Response and Remediation (DERR). 2. The five (5) USTs at this location have been collectively assigned Facility Identification #9000081. According to your letter of December 2,1998, you obtained ownership of these USTs when you accepted the Deed for the property in Lieu of Foreclosure from Longhorn Service, Inc., on October 27, 1995. Utah Code Unann. S l9-6-412(1)b provides that effective July l,lggl, each owner or operator of an UST shall have a Certificate of Compliance. To date, you have failed to document your compliance as described under Utah Admin. Code R3ll-204-2, R311-204-4, R31l-202-t, g 280.71. utah Admin. code R3ll-202-1, $ 280.70(c), requires owner or operator of any UST that has been temporarily closed for greater than 12 months, to permanently close the UST system if it does not meet the new or upgraded UST performance standards. The performance standards include performance of release detection, operation and maintenance of corrosion protection, spill and overfill protection. An inspection performed on May 24, t999, documented: (a) the USTs were still not properly permanently closed, (b) no proper form of release detection was being performed, (c) no evidence of corrosion protection on tank or product lines, (d) no spill or overfill protection. utah Admin. code R311-202-1, $ 280.40(d) states that an owner or operator must complete the closure procedure for any existing UST system that cannot apply a method of release detection that complies with the requirements. The DERR has not received payment for registration fees and interest, now past due, for fiscal years 1988, 1992, 1993, 1994, 1995, 1996, L997,1998 and 1999 in the amount of $8,812.53. The DERR has not received payment for PST Fund fees, late penalties and interest, now past due, for fiscal years 1991. 1992,1993,1994,1995,1996, and 1997, in the amount of $14,509.43. The DERR received an application for a Low Interest Loan to remove the USTs that was denied on September 8, 1998, due to your outstanding compliance issues with respect to the USTs, including non-payment of fees. VIOLATIONS As shown in paragraphs 1, 3, 4,5, and 6, you are in violation of Utah Code Unann. g 19-6- 412(l)b, by failing to obtain a Certificate of Compliance by July 1, 1991, or upon obtaining ownership, for each UST located at the above-referenced facility. Utah Code Unann. $ 19-6- 425(l) states that you are subject to a civil penalty of up to $10,000.00 for each day of each violation. As shown in paragraphs 1, 3, 5,6,7,and 8; you are in violation of Utah Admin. The Executive Secretary proposes the following: Duchesne Development will properly remove and dispose of all tanks either wholly or partly on Duchesne Development's property, including the tank partly on the Eggertson property, within one-hundred twenty (120) days of the date a Consent Decree (attached hereto) is signed by the partiis. Duchesne Development will remove the underground storage tanks in accordance with state and federal regulations. At the time of tank removal, Duchesne Development will overexcavate a1d gloperly dispose of 50 cubic yards of contaminated soil,performance of which does not require the oveisight of an environmental consultant pursuant to Utah Admin. code R3il-204-5(b). Duchesne Development must notify the DERR at least seventy-two (72) hours prior to tankremoval. DERR staff will be on-site for the tank removal and overexcavation and, together with Duchesne Development and its contractor, will determinewhich soils will be removed. A site assessment will not be required at tank removal, but DERR staff will take samples at the tank and overe-xcavation pit. The Court has jurisdiction over the subject matter herein, and over the parties consenting thereto. Among other things, state and federal law require Duchesne Development to: submit a permanent underground storage tank closure plan, obtain plan approval from the Executive Secretary, notify the Division of Environmental Response and Remediation ("Division") at least 72 hours prior to beginning closure activities, utilize a certified underground storage tank remover, properly dispose of the tanks and contaminated soils, and submit a completed closure notice and other relevant documentation demonstrating the proper removal and disposal of the tanks and contaminated soils. Duchesne Development, LLC, will not be required to perform the site assessment normally required under 40 CFR g 280.72 and Utah Admin. Code R311-205 et seq, because extensive investigation has already been performed at the release area. However, Duchesne Development will permit Division staff to take samples at the tank and overexcavation pit at the time of tank removal. At the time of tank removal, Duchesne Development will overexcavate and properly dispose of 4. 5. 6. \- 50 cubic yards of contaminated soil, performance of which does not require the oversight of an environmental consultant pursuant to Utah Admin. code R311-204-5(b). Duchesne Development must notify the Division at least seventy-two (72) hours prior to tank removal, as required by law. Division staff will be on-site for the tank removal and overexcavation activities. Together with Duchesne Development and its contractor, Division staff will determine which soils will be removed. Duchesne Development hereby provides the Division, its employees, representatives and contractors continued cooperation and an irrevocable right of access at all reasonable times to the Property for future investigation and/or remediation activities, if any. This provision of access shall be through the execution of a Grant of Access, attached hereto and incorporated by reference as "Exhibit A." The Division shall retain all of its access authorities and rights, including enforcement authorities related thereto, under the Utah Underground Storage Tank Act and any other applicable statute or regulation, including any amendments thereto. This irrevocable Grant of Access imposes no obligation upon the Division to take any investigation and/or remediation actions. Duchesne Development or its successors may seek release of the Grant of Access by providing sampling results to the Division demonstrating the achievement of cleanup levels. After tank removal, Duchesne Development will submit to the Executive Secretary the required 7. 8. 9. documentation demonstrating the proper removal and disposal of the tanks and contaminated soils. Upon Duchesne Development's completion of tank removal and overexcavation activities, submission of removal/overexcavation documentation, and execution of a grant of access, the Executive Secretary's July 6, 1999, Notice of Violation and Order, In the Matter of Gerald W. Wilkerson and Duchesne Development, L.L.C., Facility Identification No. 9000081, as well as this lawsuit (Utah Department of Environmental Quality, et al. v. Further, Plaintiffs reserve the right to institute proceedings against Defendant Duchesne Development, LLC, for the purpose of enforcing the provisions and ongoing obligations contained in this Consent Order, including the Grant of Access attached hereto. Los 10. 11, 12,13,14, 15, 16, and Block 30, Duchesne City Survey, according to the official plat thereof as tbund in the office of the Recorder, Duchesne County, Utah, that are attachments to said property. The fifth UST was found to be an attachment to property owned by Max Eggertsen. as Trustor of adjacent propert-v Lots 6, 7, 8 and 9, Block 30, Ducnesne City Survev, according to the official plat thereof as found in the office of the Recorder, Duchesne Counrv, Utah. The five (5) USTs are attested in the Notificarion of Underground Storage Tanks Edwin G. Richman signed on May 7, 1986, and submitted to the Division of Environmental Response and Remediation (DERR). 2. The five (5) USTs at this location have been collectively assigned Facility Identification #9000081. 3.According to your leuer of December 2, accepted the Deed for the property in October 27,1995. 1998, you obtained ownership of these USTs when you Lieu of Foreclosure from Longhorn Service, Inc., on 4. 5. Utah Code Unann. $ l9-6-412(l)b provides that effective July l, 1991, each owner or operator of an UST shail have a Certificate of Compliance. Records maintained by DERR disclose that, to date. no Certificate of Compliance has been issued for the USTs, for over rwo thousand eight hundred (2800) days. t The Executive Secretarv (UST) issued o XotlJ" of Noncompliance on June 4, 1998, ro you ro properly upgrade. replace or properly perrnanently close the USTs which do not meet the requirements for protection against spiil, overtills. corrosion. have proper financial responsibility, and obtain a Cenir'icate or Compliance. To date. you have failed to document your compliance as described uncier Utah Admin. Code R3 ll-204-2, R31 I -204-4. R31 1-202- 1, $ 280.71. Utah Admin. Code R311-202-1, $ 280.70(c), requires owner or operator of any UST that has been temporariiy closed for greater than l2 months, to permanently close the UST system if it does not meet the new or upgraded UST performance standards. The performance standards include performance of release detection, operation and maintenance of corrosion protection, spill and overfill protection. An inspection penormed on May 24, 1999, documented: (a) the USTs were still not properly permanently closed. tb) no proper form of release detection was being performed, (c) no evidence of corrosion protecrion on tank or product lines, (d) no spill or overfill protection. Utah Admin. Code R311-202-1, S 280.40(d) states that an owner or operator must complete the closure procedure ror any existing UST system that cannot apply a method of release detection that complies rvith the requirements. The DERR has not received payment for registration fees and interest, now past due, for fiscal years 1988, 1992. 1993, 1994, 1995, 1996, 1997, i998 and 1999 in the amount of $8,812.53. The DERR has nor received payment for PST Fund fees, late penalties and interest, now Past due, for fiscal years i99l . 1992, 1993, 1994, 1995, 1996, and 1997, in the amount of $14,509.43. The DERR received an application for a Low Interest Loan to remove the USTs that was denied on September 8. 1998, due to your outstanding compliance issues with respect to the USTs, including non-pavment of fees. VIOLATIONS As shown in paragraphs l, 3, 4, 5, and 6, you are in violation of Utah Code Unann. $ 19-6- 412(l)b, by failing to obtain a Certificate of Compliance by July I , 1991, or upon obtaining ownership, for each UST located at the above-referenced facility. Utah Code Unann. $ 19-6- 425(l) states thar vou are subject to a civil penalty of up to $10,000.00 for each day of each violation. As shown in paragraphs 1, 3, 5,6,7 , and 8, you are in violation of Utah Admin. We never purchased the property at all. We purchased the fint Tnrst Deed from "Main Street Properties LLC'on October 2,1995 forthe sum of $12,000.00. We then offered to sell our interest through the first Trust to Ed Richman who held the 2d Trust Deed on the property. When he wasnt interested in purchasing the first Trust Deed, we agreed to pay him S1,000.00 to release his interest in the 2d Trust Deed to avoid having to foreclose on the property. We also offered to sell the Trust Deed to Longhorn'Service. They said they were not interested. That was when we agreed to accept a Deed in Lieu of Foreclosure from Longhorn. Then to keep from losing the property to the County we had $8,167.37 in back property ta,res that had to be paid. We had then acquired a piece of properly that had an old run down building on it that we didn't know what to do with. At that point we decided it would make a pretty good location for our Real Estate Office. The Act, Urah Code Ann., Sections 19-6-407 and 19-6-408, also gives the Executive Secretary (UST) the power to assess a civil penalty of $1,000 if an owner or operator of an UST fails to register rhe rank, $1,000 for failure to pay fees within 60 days of due date, and assess interest on the unpaid balance. Other violations of the Act may result in civil penalties of up to $10,000 per day.
