are determined necessalv by the DERR for CAP sy$em components or
groundwatcr monitoring wells.
3. Sire reclamarion ro occur when the CAP is completed. wtrich may include the
abaudonsrent of wells and other such actions rc restore rhe Properry to similar
conditions which exisred inunediately prior to the insallation of the CA-P system.
The tasks described above malr be altercd if conditions change or if the DERR obtains
addidonai informadcn requirine i'wther invesrigadon. If new tasks are proposed. the DERR will
nodfr the Owncr in uriting. The DERR docs not waive any authoritv it may have to euter the
Propertv and perform removai acdons not within the scope of this Consent or if tlrere is an
immediate rhrcat to ttre public hesith or the environmenr, including any orher right of entry
provided for by law.

Dear Mr. Wilkerson:
The Closure Ptan for the above-referenced facility, received by the Division of
Environmental Response and Remediation (DERR) on October 16, 2OO2, has been approved
subject to the noted modifications, if any. The DERR office and the local fire department must
be notified 72 hours betore beginning closure activities. Local agencies may have additional
requirements lbr closure or may charge inspection f'ees. Please be sure the DERR office and
the Tri-County Health Department are contacted at least 72 hours before the closure takes
place.
The Closurc Plan Approval is cfl'cctive tbr a period ol'one ycar l'rom the date of approval.
If closure does not take place within ono year, submittal ol'a new Closure Plan will be required,
unless otherwise approved by the Executive Secretary (UST).
Our records indicate that the tank remover you intend to use has a certificate that expires
within one month. Please ensure that your certified remover has a valid certificate during
closure activities.
Any change to the approved Closure PIan must be submitted, in writing, and approved by
the Executive Secretary (UST) before irnplementation. If contamination is suspected or lound
during closure activities, you must report it to the DERR at (801) 536-4100 within 24 hours of
discovery.

Enclosed is a copy of the Closure Notice form, which must be completed and submitted
to the Executive Secretary (UST) after the Elosure is performed. Please submit the
environmental and Unified Soil Classification sarrple analysis data and Chain of Custody forms
with the Closure Notice as soon as possible, but no later than 90 days after tank closure.
If during upcoming closure activities, it appears that a confirmed petroleum release has
occurred, then the conditions, as explained in the attached notice, may apply to your site
provided all the applicable rules and regulations are complied with.

NOTICE OF YIOLATION
AND ORDER
Facility ID No. 9000081
The Executive Secretary (UST) of the Utah Solid and Hazardous Waste Control Board
("Executive Secretary (UST)"), issues a Notice of Violation and Order regarding proper permanent
closure and payment of fees at Facility ID No. 9000081 where the USTs are owned by Duchesne
Development, L.L.C. (herein referred to as "you").
These proceedings are pursuant to the jurisdiction and authority provided in Utah Code Unann.
$ 19-6-401 et S.9g., and the Utah Admin. Code R31l-200 er seq.
FINDINGS OF FACT
1. You own four (4) of the five (5) Underground Storage Tanks (USTs), located at 72 West Main,
Duchesne, Utah, Lots 10, 1 1, t2, 13, 14, 15,16, and Block 30, Duchesne City Survey, according
to the official plat thereof as found in the office of the Recorder, Duchesne County, Utah, that are
attachments to said property. The fifth UST was found to be an attachment to property owned
by Max Eggertsen, as Trustor of adjacent property Lots 6, 7, 8 and 9, Block 30, Duchesne City
Survey, according to the official plat thereof as found in the office of the Recorder, Duchesne
County, Utah. The five (5) USTs are attested in the Notification of Underground Storage Tanks
Edwin G. Richman signed on May 7, 1986, and submitted to the Division of Environmental
Response and Remediation (DERR).
2. The five (5) USTs at this location have been collectively assigned Facility Identification
#9000081.
According to your letter of December 2,1998, you obtained ownership of these USTs when you
accepted the Deed for the property in Lieu of Foreclosure from Longhorn Service, Inc., on
October 27, 1995.
Utah Code Unann. S l9-6-412(1)b provides that effective July l,lggl, each owner or operator
of an UST shall have a Certificate of Compliance.
Records maintained by DERR disclose that, to date, no Certificate of Compliance has been issued
for the USTs, for over two thousand eight hundred (2800) days.

The Executive Secretary (UST) issued a Notici of Noncomptiance on June 4,lggl,to you to
properly upgrade, replace or properly permanently close the USTs which do not meet the
requirements for protection against spill, overfills, corrosion, have proper financial responsibility,
and obtain a Certificate of Compliance. To date, you have failed to document your compliance
as described under Utah Admin. Code R3ll-204-2, R311-204-4, R31l-202-t, g 280.71.
utah Admin. code R3ll-202-1, $ 280.70(c), requires owner or operator of any UST that has
been temporarily closed for greater than 12 months, to permanently close the UST system if it
does not meet the new or upgraded UST performance standards. The performance standards
include performance of release detection, operation and maintenance of corrosion protection, spill
and overfill protection.
An inspection performed on May 24, t999, documented: (a) the USTs were still not properly
permanently closed, (b) no proper form of release detection was being performed, (c) no evidence
of corrosion protection on tank or product lines, (d) no spill or overfill protection.
utah Admin. code R311-202-1, $ 280.40(d) states that an owner or operator must complete the
closure procedure for any existing UST system that cannot apply a method of release detection
that complies with the requirements.
The DERR has not received payment for registration fees and interest, now past due, for fiscal
years 1988, 1992, 1993, 1994, 1995, 1996, L997,1998 and 1999 in the amount of $8,812.53.
The DERR has not received payment for PST Fund fees, late penalties and interest, now past due,
for fiscal years 1991. 1992,1993,1994,1995,1996, and 1997, in the amount of $14,509.43.
The DERR received an application for a Low Interest Loan to remove the USTs that was denied
on September 8, 1998, due to your outstanding compliance issues with respect to the USTs,
including non-payment of fees.
VIOLATIONS
As shown in paragraphs 1, 3, 4,5, and 6, you are in violation of Utah Code Unann. g 19-6-
412(l)b, by failing to obtain a Certificate of Compliance by July 1, 1991, or upon obtaining
ownership, for each UST located at the above-referenced facility. Utah Code Unann. $ 19-6-
425(l) states that you are subject to a civil penalty of up to $10,000.00 for each day of each
violation.
As shown in paragraphs 1, 3, 5,6,7,and 8; you are in violation of Utah Admin. Code R3l I-ZOZ-
1, $ 280.70(c), which requires the owner or operator of any UST that has been temporarily closed
for greater than 12 months, to permanently close the UST system if it does not meet the new or
upgraded UST performance standards. Utah Code Unann. $ 19-6-425(l) states that you are
subject to a civil penalry of up to $ 10,000.00 for each day of each violation.
As shown in paragraphs l, 3, 8, and 9, you are in violation of Utah Admin. Code R3l l-2OZ-1,
$ 280.40(d), which requires the owner or operator to complete the closure procedures for any
existing UST system that cannot apply a method of release detection that complies with the
requirements. Utah Code Unann. $ 19-6-425(1) states that you are subject to a civil penalty of
up to $10,000.00 for each day of each violation.

As shown in paragraph l. 3, and 10, you are in violation for your portion of the UST fees
required of Utah Code Unann. $ 19-6-408, which requires an owner or operator to pay an annual
underground storage tank registration fee on tanks that have not been properly closed. Utah Code
Unann. $ 19-6-408(1)a states that you are subject to an civil penalty of $1,000.00 per facility for
each fiscal year, if the fees are not paid in full within 60 days of the annual due date.
As shown in paragraph 1, 3, and 11, you are in violation for your portion of the UST fees
required of Utah Code Unann. $ l9-6-411(l), which requires an owner or operator to pay annual
peftoleumstoragetankfeesforfiscalyears 1991through 1997. UtahCodeUnann. $ 19-6-425(1)
states that you are subject to a civil penalty of up to $10,000.00 for each day of each violation.
ORDER
The Executive Secretary (UST) hereby orders you to submit a properly completed closure plan
obtain approval within 30 days of this Order, then properly and permanently close your USTs, perform
the sampling as approved within 60 days of this Order, and submit a properly completed subsequent
closure notice which includes sample results within 90 days of the permanent closure, as required under
Utatr Admin. Code, R311-204, R311-205, R3l1-202-1 $$ 280.71(a) and 280.72(a), perform corrective
action for any contamination found upon removal of the USTs as required by R31l-202-l $$ 280.50,
280.51, 280.53,280.60, 280.61, 280.62, 280.63, 280.64, 280.65, 280.66, and 280.67, and pay the
underground storage tank registration fees and petroleum storage tank fees as required by Utah Code
Unann. $ 19-6-408 and Utah Code Unann. $ 19-6-411(1).
Pursuant to Utah Code Unann. $ 19-6-404(3), you may contest this Notice of Violation and Order
by filing a Request for Agency Action to contest the Notice of Violation and Order within 30 days after
issuance. The Request for Agency Action should be filed with The Utah Solid and Hazardous Waste
Control Board, 168 North 1950 West, 1" Floor, P.O. Box 144840, Salt Lake City, Utah 84114-4840. A
copy of the request for agency action must also be mailed to Kent P. Gray, Exectutive'secretary (UST),
168 North 1950 West, lst Floor, P.O. Box 144840, Salt Lake City, Utah, 84114-4840. If you do not
contest this Notice of Violation and Order as described above, the facts specified herein will be deemed
true and not subject to contest in future administrative or judicial proceedings, and you will forfeit any
right to proceed with an administrative or judicial appeal.

1. The Defendant has presented no evidence to deny or refute the facts
contained in the Plaintiffs Motion for an Order to Show Cause, Tl-re Defendant, having
failed to show cause, is held in contempt of court.
2. Defendant Duchesne Development owns Lots 6-15, Bloc,k 30 Duchesne City
Survey ("Property"). Located on the Property are four undergouncl storage tanks
("UST')- A fifth UST is located partially on the Property and partially on property owned
by Max Eggersten. The five USTs have been used for the storag(), use, or ciispensing
of petroleum.
3. On October 1,2001, a Consent Order was signed by th,:r parties and entered
by the Honorable Judge John R. Anderson. ln order to comply with the Consent order,
the Defendant was required to:
a' Properly remove and dispose of all USTs either lvholly or partly on the
Property' inclucling the tank partly on the Eggersten property, withrin 120 days (January
29,2002) of the date of the Consent Order.
b' Remove the USTs in accordance with state and federal regulations,
including utah code Ann. s19-6-401 el seq., Utah Admin cocje R31 1 -2o4, R311-2o2-1
(incorporating 40 CFR part 2BO), and 40 CFR S2g0.71.
c' Permit Plaintiffs staff to take samples at the tank: and overexacation pit
at the lime of tank removal.
cl' At the time of tank removal, overexcavate and prirperly dispose of S0
cubic yards of contaminated soil.
e. Notify the praintiff at least 72 hours prior to tank removar.

f. Provide the Plaintiff, its employees and representatives continued
cooperation and an irrevocable right of access at all reasonable tinres to the Property
for future investigation and/or remediation activities.
g. Upon tank removal, submit to the Executive Secrr:tary the required
documentation demonstrating the proper removal and disposal of the tanks and
contaminated soil.
4. Defendant has failed to comply with any part of the Consent Order.
5. Based upon the afformentioned, ihe Court finds Defend:lnt in Contempt of
Court and imposes on the Defendant a $50,000 fine plus 30 days in jail. Said Sentence
is stayed if the Defendant abides by this Order:

The above matter has been referred to me for enforcement. On October 1,
2001, Judge John R. Anderson entered a Consent Order which both of you signed. ln
accordance with this order Mr. Wilkerson agreed to remove and dispose of all
underground storage tanks either wholly or partially on Lots 6-15, Block 30 Duchesne
City Survey.
Over seven months have passed since the order was entered and removal of the
tanks has not commenced. Please submit a permanent closure plan to the Executive
Secretary of the Division of Environmental Response and Remediation by June 3,
2002. As well as meeting the state and federal regulatory requirements, ihis plan must
set out specific dates for removal of the tanks and closure of the site. The removal
must commence by June 15,2002. lf the closure plan is not submitted to the executive

Dear Mr. Berrett:
Thank you for your letter dated April 30, 2001, regarding Duchesne Development,s
settlement proposal in the above-referenced matter. I have reviewed ihe letter with the Executive
Secretary (usr) and with Fred Nelson of the Attorney General's office.
The Executive Secretary proposes the following:
Duchesne Development will properly remove and dispose of all tanks either
wholly or partly on Duchesne Development's property, including the tank partly
on the Eggertson property, within one-hundred twenty (120) days of the date a
Consent Decree (attached hereto) is signed by the partiis. Duchesne
Development will remove the underground storage tanks in accordance with state
and federal regulations. At the time of tank removal, Duchesne Development will
overexcavate a1d gloperly dispose of 50 cubic yards of contaminated soil,performance of which does not require the oveisight of an environmental
consultant pursuant to Utah Admin. code R3il-204-5(b). Duchesne
Development must notify the DERR at least seventy-two (72) hours prior to tankremoval. DERR staff will be on-site for the tank removal and overexcavation
and, together with Duchesne Development and its contractor, will determinewhich soils will be removed. A site assessment will not be required at tank
removal, but DERR staff will take samples at the tank and overe-xcavation pit.
Duchesne Development will execute a grant of access (attached hereto) giving
continued access and cooperation for future investigation and./or remediation
activities, if any, at the property to DERR and its "-pioy""s, representatives and

contractors. Within ninety days of tank removal, Duchesne Development will
submit to the Executive Secretary a closure notice and other relevant
documentation demonstrating the proper removal and disposal of the tanks and
contaminated soils.
Upon completion of tank removal and overexcavation, submission of removal/overexcavation
documentation and execution of a grant of access, the Executive Secretary's July 6, 1999, Notice
of Violation and Order, h the Matter of Gerald W. Wilkerson and Duchesne Development,
L.L.C., Facility Identification No. 9000081, as well as the lawsuit entitled Utah Department of
Environmental Quality, et al. v. Longhorn Service, Inc., Duchesne Development L.L.C., et al,
Case No. 970800073, filed in the Eighth Judicial District Court in and for Duchesne County,
State of Utah, will be dismissed with prejudice.

This Consent Order is made and entered into by and among the Plaintiffs, Utah Department of
Environmental Quality and Kent Gray, Executive Secretary (UST) of the Utah Solid and Hazardous
Waste Control Board, and the Defendant Duchesne Development, LLC ("Duchesne Development").

Whereas, the Defendant Duchesne Development owns Lots 6-15, Block 30, Duchesne City
Survey ('?roperty"),
Whereas, there are four underground storage tanks located on the Property and a fifth
underground storage tank partly on the Property and partly on property owned by Max Eggertson,
Whereas, the underground storage tanks on the Property have been used for the storage, use,
or dispensing of petroleum, a regulated substance,
Whereas, the underground storage tanks on the Property have not been properly closed or
upgraded,
Whereas, the Plaintiffs agree that settlement of the claims in this case against Defendant
Duchesne Development is appropriate, and, as described below, is a fair and reasonable settlement,
THEREFORE, without adjudication of any issue of fact and upon the consent of the Plaintiffs
and Defendant Duchesne Development, it is hereby ORDERED, ADruDGED AND DECREED, as
follows:
1. The Court has jurisdiction over the subject matter herein, and over the parties consenting
thereto.
In full and complete satisfaction of the Plaintiffs' claims against Defendant Duchesne
Development, Defendant Duchesne Development agrees to properly remove and dispose of all
underground storage tanks either wholly or partly on the Property, including the tank partly on

the Eggertson property, within one-hundred twenty (120) days of the date of this Consent
Order.
Duchesne Development, will remove the underground storage tanks in accordance with state
and federal regulations, including Utah Code Ann. $ 19-6-401 et seq., Utah Admin. Code
R31l-204, R3ll-202-1 (incorporating 40 CFR Part 280), and 40 CFR $ 280.71. Among
other things, state and federal law require Duchesne Development to: submit a permanent
underground storage tank closure plan, obtain plan approval from the Executive Secretary,
notify the Division of Environmental Response and Remediation ("Division") at least 72 hours
prior to beginning closure activities, utilize a certified underground storage tank remover,
properly dispose of the tanks and contaminated soils, and submit a completed closure notice
and other relevant documentation demonstrating the proper removal and disposal of the tanks
and contaminated soils.
Duchesne Development, LLC, will not be required to perform the site assessment normally
required under 40 CFR g 280.72 and Utah Admin. Code R311-205 et seq, because extensive
investigation has already been performed at the release area. However, Duchesne
Development will permit Division staff to take samples at the tank and overexcavation pit at the
time of tank removal.
At the time of tank removal, Duchesne Development will overexcavate and properly dispose of

50 cubic yards of contaminated soil, performance of which does not require the oversight of an
environmental consultant pursuant to Utah Admin. code R311-204-5(b).
Duchesne Development must notify the Division at least seventy-two (72) hours prior to tank
removal, as required by law. Division staff will be on-site for the tank removal and
overexcavation activities. Together with Duchesne Development and its contractor, Division
staff will determine which soils will be removed.
Duchesne Development hereby provides the Division, its employees, representatives and
contractors continued cooperation and an irrevocable right of access at all reasonable times to
the Property for future investigation and/or remediation activities, if any. This provision of
access shall be through the execution of a Grant of Access, attached hereto and incorporated
by reference as "Exhibit A." The Division shall retain all of its access authorities and rights,
including enforcement authorities related thereto, under the Utah Underground Storage Tank
Act and any other applicable statute or regulation, including any amendments thereto. This
irrevocable Grant of Access imposes no obligation upon the Division to take any investigation
and/or remediation actions. Duchesne Development or its successors may seek release of the
Grant of Access by providing sampling results to the Division demonstrating the achievement of
cleanup levels.
After tank removal, Duchesne Development will submit to the Executive Secretary the required

documentation demonstrating the proper removal and disposal of the tanks and contaminated
soils.
Upon Duchesne Development's completion of tank removal and overexcavation activities,
submission of removal/overexcavation documentation, and execution of a grant of access, the
Executive Secretary's July 6, 1999, Notice of Violation and Order, In the Matter of Gerald W.
Wilkerson and Duchesne Development, L.L.C., Facility Identification No. 9000081, as well as
this lawsuit (Utah Department of Environmental Quality, et al. v. Longhorn Seryice,Inc.,
Duchesne Development L.L.C., et al,Case No. 970800073, filed in the Eighth Judicial District
Court in and for Duchesne County, State of Utah) will be dismissed with prejudice.
Notwithstanding any other provision of this Consent Order, the Plaintiffs reserve the right to
institute proceedings against Defendant Duchesne Development, LLC, if the facts are materially
different from that stated in this Consent Order or arise out of claims not within the scope of the
Plaintiffs' complaint. Further, Plaintiffs reserve the right to institute proceedings against
Defendant Duchesne Development, LLC, for the purpose of enforcing the provisions and
ongoing obligations contained in this Consent Order, including the Grant of Access attached
hereto.
Defendant Duchesne Development, T f C, shall have the contribution rights and protections in
Utah Code Ann. 919-6-424.5(7) and (8).

12. If for any reason the Court should decline to approve this Consent Order in the form presented,
this Consent Order and the settlement embodied herein shall be void and the terms hereof may
not be used as evidence in any litigation.
13. Each party hereto shall bear its own costs and attorneys, fees.
The Plaintiffs and Defendant Duchesne Development, LLC, enter into this Consent order and
submit it to the Court, that it may be approved and entered.

closed UST, the certificate for the non-compliant UST will be revoked. If your temporarily closed UST
is currently covered by the Petroleum Storage Tank Fund, you will lose the ability to make a claim against
the Fund for releases from the non-compliant UST.

We, being "Duchesne Development LLC" actually aoquired the property when we
accepted a Doed in Lieu of Foreclosurc from Ionghorn Servicc Inc. on thc27n day of
October 1995. We ncvcr purchascd the property at all. We purchased the first Trust
Deed from "Main Street Properties LLC" on October 2,1995 for the sum of $12,000.00.
We then offered to sell our interest through the first Trust to Bt Richman wtro held the
2d Tnst Deed on the property. When hi'rasnt intcrested in puchasing the first Trust
Deed, we ageed to pay him $1,000.00 to release his interest in the 2d Trust Dced to
avoid having to foreclose on ths property. We also offered to scll the Trust Deed to
Longhorn Service. Thcy said they wcrc not interestcd That was when we agrecd to
aocePt a Deed in Lieu of Foreclosruc from Longhorn. Then to keep from losing the
property to the County we had $8,167.37 in back property taxes that had to be paid.
We had then acquired a piece of property that had an old run down building on it that
we didnt know urhat to do wittr" At that point we decided it vlould make a pretty good
location for our Real Esate Oflice. We then procecded to spend about $30,000.00 to
remodel the building to make it useable as an offrce
At that point we were into the property about $51,167.37, an if ue spend another
S15,000.@ to have the anks removed as we've bcen quoted, we'll be in the properry over
$65,000.00 and in Duchesne I believe ttrat's probably every penny the property is worth.

Under Federal regulations issued in 1988, UST owners and operators have until December 22, 1998 to upgrade, replace, or
permanently closi USts which do not meet the requirements for protection against spills, overfills, and corrosion. Owners and
operators aiso must meet financial responsibility requirements, to show they are able to pay the costs of cleanups of releases from
regulated USTs. In addition, the Utah UST Act requires that all owners and operators of regulated petroleum USTs qualify for
and maintain a Certificate of Compliance. The tanis listed below are not currently covered by a Certificate of Compliance' and
you have not adequately demonstrated that you meet the financial responsibility requirements. The USTs also have not yet met
the upgrade requirements, as shown below:

The Executive Secretary (UST) of the Utah Solid and Hazardous Waste Conrol Board
("Executive Secretary (UST)"). issues a Notice of Violation and Order regarding proper pennanent
closure and payment of fees 'rt Facility ID No. 9000081 where rhe USTs *e o*n"d by Duchesne
Development. L.L.C. (herein r-rcrred to as "you").
These proceedings are pursuant to the jurisdiction and authority provided in Utah Code Unann.
$ 19-6-401 sI s.sq., and the Utah Admin. Code R3 t t -200 er seg.
FINDINGS OF FACT
l. You own four (4) of the five (5) Underground Storage Tanks (USTs), located ar 72 West Main,
Duchesne. Utah. Los 10. 11, 12,13,14, 15, 16, and Block 30, Duchesne City Survey, according
to the official plat thereof as tbund in the office of the Recorder, Duchesne County, Utah, that are
attachments to said property. The fifth UST was found to be an attachment to property owned
by Max Eggertsen. as Trustor of adjacent propert-v Lots 6, 7, 8 and 9, Block 30, Ducnesne City
Survev, according to the official plat thereof as found in the office of the Recorder, Duchesne
Counrv, Utah. The five (5) USTs are attested in the Notificarion of Underground Storage Tanks
Edwin G. Richman signed on May 7, 1986, and submitted to the Division of Environmental
Response and Remediation (DERR).

Utah Code Unann. $ l9-6-412(l)b provides that effective July l, 1991, each owner or operator
of an UST shail have a Certificate of Compliance.
Records maintained by DERR disclose that, to date. no Certificate of Compliance has been issued
for the USTs, for over rwo thousand eight hundred (2800) days.

properly upgrade. replace or properly perrnanently close the USTs which do not meet the
requirements for protection against spiil, overtills. corrosion. have proper financial responsibility,
and obtain a Cenir'icate or Compliance. To date. you have failed to document your compliance
as described uncier Utah Admin. Code R3 ll-204-2, R31 I -204-4. R31 1-202- 1, $ 280.71.
Utah Admin. Code R311-202-1, $ 280.70(c), requires owner or operator of any UST that has
been temporariiy closed for greater than l2 months, to permanently close the UST system if it
does not meet the new or upgraded UST performance standards. The performance standards
include performance of release detection, operation and maintenance of corrosion protection, spill
and overfill protection.
An inspection penormed on May 24, 1999, documented: (a) the USTs were still not properly
permanently closed. tb) no proper form of release detection was being performed, (c) no evidence
of corrosion protecrion on tank or product lines, (d) no spill or overfill protection.
Utah Admin. Code R311-202-1, S 280.40(d) states that an owner or operator must complete the
closure procedure ror any existing UST system that cannot apply a method of release detection
that complies rvith the requirements.
The DERR has not received payment for registration fees and interest, now past due, for fiscal
years 1988, 1992. 1993, 1994, 1995, 1996, 1997, i998 and 1999 in the amount of $8,812.53.
The DERR has nor received payment for PST Fund fees, late penalties and interest, now Past due,
for fiscal years i99l . 1992, 1993, 1994, 1995, 1996, and 1997, in the amount of $14,509.43.
The DERR received an application for a Low Interest Loan to remove the USTs that was denied
on September 8. 1998, due to your outstanding compliance issues with respect to the USTs,
including non-pavment of fees.
VIOLATIONS
As shown in paragraphs l, 3, 4, 5, and 6, you are in violation of Utah Code Unann. $ 19-6-
412(l)b, by failing to obtain a Certificate of Compliance by July I , 1991, or upon obtaining
ownership, for each UST located at the above-referenced facility. Utah Code Unann. $ 19-6-
425(l) states thar vou are subject to a civil penalty of up to $10,000.00 for each day of each
violation.
As shown in paragraphs 1, 3, 5,6,7 , and 8, you are in violation of Utah Admin. Code R3l l-202-
1, $ 280.70(c), rvhich requires the owner or operator of any UST that has been temporarily closed
for greater than i2 months, to permanently close the UST system if it does not meet the new or
upgraded UST pertormance standards. Utah Code Unann. $ 19-6-425(1) states that you are
subject to a civii penalry of up to $10,000.00 for each day of each violation.
As shown in paragraphs l, 3, 8, and 9, you are in violation of Utah Admin. Code R311-202-1,
$ 280.40(d), which requires the owner or operator to complete the closure procedures for any
existing UST system that cannot apply a method of release detection that complies with the
requirements. Utah Code Unann. $ 19-6-425(1) states that you are subject to a civil penalty of
up to $10,000.00 for each day of each violation.

ORDER
The Executive Secretary IUST) hereby orders you to submit a properly completed closure plan
obtain approval within 30 days of this Order. then properly and permanently close your USTs, perform
the sampling as approved within 60 days of this Order, and submit a properly completed subsequent
closure notice which includes sample results within 90 days of the perrnanent closure, as required under
utahAdmin. code. R31I-204, R3II-205. R3l I-202-l $$ 280.71(a) and 2g0.72(a), perform corrective
action for any contamination found upon removal of the USTs as required by R3 ll-ZO2-L gg 2g0.50,
280.51.280.53,280.60, 280.61.280.62.280.63. 280.64,280.65,280.66, and 280.67, and pay the
underground storage tank registration fees and petroleum srorage tank fees as required by Utah bode
Unann. $ l9-6-408 and Utah Code Unann. g l9-6-41l(1).
Pursuant to Utah Code unann. $ 19-6-404(3), you may contest this Notice of violation and order
by filing a Request for Agency Action to contest the Notice of Violation and Ori r within 30 days after
issuance. The Request for Agency Action should be filed with The Utah Solid and Hazardous Waste
Control Board, 168 North 1950 West, l" Floor, P.O. Box 144840, Salt Lake City, Utah g4114-4g40. A
copy of the request for agency action must also be mailed to Kent P. Gray, Exectutive Secretary (UST),

Bill: When you get back in the office on Monday can you give Fred Nelson (366-0285) a call concerning
the fees owed for the above facility. I talked to him on Friday and he said that he needed some "hard
numbers" for the proposed settlement. Previously we have given him a figure of $2175. I explained to
him that this probably represents a corrected figure based on the premise that the tanks will be removed.
He may also want the amount currently owing that includes the portion that will be waived upon the
removal of the tanks.

The Division of Environmental Response and Remediation has reviewed your eligibility application for a
loan from the Petroleum Storage Tank Loan Fund for underground storage tanks (USTs) at Longhom
Service.T2WestMain.Duchesne,Utah(faciiityiD#9000081). TheUtahUndergroundStorageTank(UST)
Act (19-6-405.3 UCA) specifies the uses for which money loaned from the fund may be used, the eligibility
criteria for receiving a loan, the limits on loan amounts, and objectives to be considered in making loans.
The UST Act specifies that a person may apply for a loan if all tanks owned or operated by that person are
in substantial compliance with all state and federal requirements or will be brought into substantial
compliance with the loan. Based on the eligibility review, your application cannot be approved at this time

we, being "Duchesne De.relopment LLC' actually acquired the property when we
accepted a Deed in Lieu of Foreclosure from Longhorn Service Inc. on the27k day.of
October 1995. We never purchased the property at all. We purchased the fint Tnrst
Deed from "Main Street Properties LLC'on October 2,1995 forthe sum of $12,000.00.
We then offered to sell our interest through the first Trust to Ed Richman who held the
2d Trust Deed on the property. When he wasnt interested in purchasing the first Trust
Deed, we agreed to pay him S1,000.00 to release his interest in the 2d Trust Deed to
avoid having to foreclose on the property. We also offered to sell the Trust Deed to
Longhorn'Service. They said they were not interested. That was when we agreed to
accept a Deed in Lieu of Foreclosure from Longhorn. Then to keep from losing the
property to the County we had $8,167.37 in back property ta,res that had to be paid.
We had then acquired a piece of properly that had an old run down building on it that
we didn't know what to do with. At that point we decided it would make a pretty good
location for our Real Estate Office. We then proceeded to spend about $SO,OOO.OO to
remodel the building to make it useable as an ofEce
At that point we were into the propertv about $51,167.37, an if we spend another
$15,000.00 to have the tanks removed as we've been quoted we'll be in the property over
$66,000.00 and in Duchesne I believe that's probably ivery penny the propertyls worth.

Dear Mr. Hamilton:
The Utah Underground Storage Tank Act (Act), regulates underground storage tanks (USTs) and
imposes certain obligations on the owner or operator of a facility having USTs' The Act specifically
requires rhe owner or operator of a facility, wiitr USts, to meet the following requirements:
. Register the USTs
. Pay an annual registration fee
.PayanannualPetroleumstorageTank(PST)Fundfee
. Meet specific technical and performance standards
. Meet certain financial responsibility requirements
. Maintain adequate tank records
. ParticiPate in the PST Fund
. precision test the tank and lines as a requirement to participate in the PST Fund
The Division of Environmental Response and Remediation (DERR) records indicate you own or
operate five USTs located at Longhorn Service, lnc., Junction HWY 40 and HWY 191' Duchesne' Utah'
A representative of the DERR inspected your facility on NovemberT' 1994, and found five USTs located
at the facilitY.
Information provided to the DERR indicates your facility is not in compliance with the
following requirements :
l. The DERR has not received payment for registration fees and interest now past due for
the fiscal years 1988, 1992, 1993,1994 and 1995'

2. The DERR has nor received payment for PST Fund fees, late penalties and interest, now
past due for the fiscal years 1991, 1992, 1993, 1994 and 1995'
3. The DERR has nor received a copy of a precision tank tightness test for USTs #1, #:-. #3,
#4. and #5 as required to qualify for the PST Fund'
4. The DERR has not received an application for the PST Fund or issued a Certificate of
Compliance to Longhorn Service, Inc. for the tanks at the facility identified above.
5. The DERR has not received a Temporary Closure Notice as required by Utah Admin.
Code R3l l-ZM-4 for USTs closed over 3 months, documenting the USTs have been
emptied to less than I " of fluids, the fill pipes have been locked and secured to Prevent
unauthorized access, and the pipes to the dispenser have been capped, and the vent lines
secured oPen.
6. The DERR documentarion indicates the USTs have been temporarily closed for greater
rhan one (1) year without the USTs including the product lines being upgraded to new
UST standards for corrosion protection'
j . The DERR has not received a site assessment, including analytical results and chain of
custody forms, and a written request for an extension of the one (l) year temPorary
closure as required by Utah Admin. Code R3ll-202-l and 40 CFR S 280.70 for the
substandard USTs temporarily closed for more than one (l) year.
g. The DERR has not received documentation of proper release detection for USTs #1, #2,
#3, #4, and #5 found containing more than one (l) inch of residue on November'1, 1994'
In order to achieve compliance you must do all of the following:
g. pay registration fees in the amount of $2,893.26 which are past due for the fiscal years
1988, i992, tgg3, 1994, and 1995, as required by Utah Code Ann., $ 19-6-408.
10. pay pST Fund fees in the amount of $7,229.03 which are Past due for the fiscal years
lggl,lgg2, lgg3, lgg4, and 1995, as required by Utah code Ann., $ 19-6-411.
I l. Submit documentation that the performance of some acceptable form of release detection
is conducted on the USTs as required by Utah Admin. Code R3l1-202-l and 40
CFR $ 280.40 and including temporarily closed USTs containing more than one (l) inch
of fluids as required by Utah Admin. Code R31l-202-l and 40 CFR $ 280.70(a)'
In addition you have already violated the temporarily closure requirements for over four (4)
years, no further extension will be granted. To achieve compliance you must also do the following:
lZ. Submit a properly completed closure plan for permanent closure of USTs #1,#2,#3,#4
and #5 found in non-compliance on November 7, 1994, as required by Utah Admin. Code
R3ll-2O4-2, obtain approval, close the USTs as approved within 60 days of this letter and

submit a subsequent closure notice, sample results, chain of custody of the samples and
other documentation to establish the USTs have been properly closed; Or perform items
#13, #14, and #15.
13. Submit documentation that the USTs have been upgraded to new UST standards,
including addition of corrosion protection, spill and overfill protection; and that the
performance or installation of some acceptable form of release detection is conducted on
each UST containing more than one (l) inch of-fluids as required by R3ll-202-l and
40 cm $ 280.41.
Submit a complete copy of precision tank tightness tests for the USTs perforrned rn
accordance with the requirements of the Act, Utah Admin. Code R3ll-202'1, and
40 CFR $$ 280.41(a) and 280.41(c).
15. Submit an application for the PST Fund, a previous pollution incidence form indicating
if there was any contamination from the USTs, and obtain a Certificate of Compliance for
the USTs at the facility identified above, containing the USTs as required by the Act.
The Act gives the Executive Secretary (UST) of the Utah Solid and Hazardous Waste Control
Baard (Board) the power to enforce rules made by the Board by issuing Notices of Agency Action or
Orders. The Act, Urah Code Ann., Sections 19-6-407 and 19-6-408, also gives the Executive Secretary
(UST) the power to assess a civil penalty of $1,000 if an owner or operator of an UST fails to register
rhe rank, $1,000 for failure to pay fees within 60 days of due date, and assess interest on the unpaid
balance. Other violations of the Act may result in civil penalties of up to $10,000 per day.
This letter will advise you that your failure to comply with the requirements of the stafutes and
rules may result in the issuance of a Notice of Agency Action or Order and the assessment of a civil
penalty.

Dear Mr. Hamilton:
The Utah Underground Storage Tank Act (Act), regulates underground storage tanks (USTs) and
imposes certain obligations on the owner or operator of a facility having USTs. The Act specifically
requires the owner or operator of a facility, with USTs, to meet the following requirements:
' Register the USTs
. Pay an annual registration fee
. Pay an annual Petroleum Storage Tank (PST) Fund fee
. Meet specific technical and performance standards
. Meet certain financial responsibility requirements
. Maintain adequate tank records
. Participate in the PST Fund
. Precision test the tank and lines as a requirement to participate in the PST Fund
The Division of Environmental Response and Remediation (DERR) records indicate you own or
operate five USTs located at Longhorn Service, Inc., Junction HWY 40 and I{WY 191, Duchesne, Utah.
A representative of the DERR inspected your facility on November 7, 1994, and found five USTs located
at the facility.
Information provided to the DERR indicates your facility is not in compliance with the
following requirements:
1. The DERR has not received payment for registration fees and interest now past due for
the fiscal years 1988, 1992,1993,1994 and 1995.

The DERR has not received payment for PST Fund fees, late penalties and interest, now
past due for the fiscal years 1991,1992,1993,1994 and 1995.
The DERR has not received a copy of a precision tank tightness test for USTs #1, #:. #3,
#4, and #5 as required to qualify for the PST Fund.
The DERR has not received an application for the PST Fund or issued a Certificate of
Compliance to Longhorn Service, Inc. for the tanks at the facility identified above.
The DERR has not received a Temporary Closure Notice as required by Utah Admin.
Code R31l-2M-4 for USTs closed over 3 months, documenting the USTs have been
emptied to less than 1" of fluids, the fill pipes have been locked and secured to prevent
unauthorized access, and the pipes to the dispenser have been capped, and the vent lines
secured open.
The DERR documentation indicates the USTs have been temporarily closed for greater
than one (l) year without the USTs including the product lines being upgraded to new
UST standards for corrosion protection.
The DERR has not received a site assessment, including analytical results and chain of
custody forms, and a written request for an extension of the one (l) year temporary
closure as required by Utah Admin. Code R3lr-202-l and 40 cFR $ 280.70 for the
substandard USTs temporarily closed for more than one (l) year.
The DERR has not received documentation of proper release detection for USTs #1, #2,
#3, #4, and #5 found containing more than one (l) inch of residue on November 7, 1994.
In order to achieve compliance you must do all of the following:
Pay registration fees in the amount of $2,893.26 which are past due for the fiscal years
1988,1992,1993,1994, and 1995, as required by Utah Code Ann., g 19-6-408.
Pay PST Fund fees in the amount of $7,229.03 which are past due for the fiscal years
1991,1992,1993,1994, and 1995, as required by Utah Code Ann., g 19-6-411.
Submit documentation that the performance of some acceptable form of release detection
is conducted on the USTs as required by Utah Admin. Code R3ll-202-l and 40
CFR $ 280.40 and including temporarily closed USTs containing more than one (l) inch
of fluids as required by Utah Admin. Code R3l l-202-l and 40 CFR $ 280.70(a).
In addition you have already violated the temporarily closure requirements for over four (4)
years, no further extension will be granted. To achieve compliance you must also do the following:
Submit a properly completed closure plan for permanent closure of USTs #1, #2, #3, #4
and #5 found in non-compliance on NovemberT, 1994, as required by Utah Admin. Code
R3ll-204-2, obtain approval, close the USTs as approved within 60 days of this letter and

submit a subsequent closure notice, sample results, chain of custody of the samples and
other documentation to establish the USTs have been properly closed; Or perform items
#13, #14, and #15.
13. Submit documentation that the USTs have been upgraded to new UST standards,
including addition of corrosion protection, spill and overfill protection; and that the
performance or installation of some acceptable form of release detection is conducted on
each UST containing more than one (1) inch of fluids as required by R31l-202-l and
40 cFR $ 280.41.
14. Submit a complete copy of precision tank tightness tests for the USTs performed in
accordance with the requirements of the Act, Utah Admin. Code R3ll-202-1, and
40 CFR $$ 280.41(a) and 280.41(c).
15. Submit an application for the PST Fund, a previous pollution incidence form indicating
if there was any contamination from the USTs, and obtain a Certificate of Compliance for
the USTs at the facility identified above, containing the USTs as required by the Act.
The Act gives the Executive Secretary (UST) of the Utah Solid and Hazardous Waste Control
Board (Board) the power to enforce rules made by the Board by issuing Notices of Agency Action or
Orders. The Act, Utah Code Ann., Sections 19-6-407 and 19-6-408, also gives the Executive Secretary
(UST) the power to assess a civil penalty of $1,000 if an owner or operator of an UST fails to register
the tank, $1,000 for failure to pay fees within 60 days of due date, and assess interest on the unpaid
balance. Other violations of the Act may result in civil penalties of up to $10,000 per day.
This letter will advise you that your failure to comply with the requirements of the statutes and
rules may result in the issuance of a Notice of Agency Action or Order and the assessment of a civil
penalty.

Annotated, 1953, as amended.
Accordingly, Edwin G. Richman is required to come into compliance with26-l4e-302, Utah
Code Annotated, 1953, as amended; by paying the fee assessment for fiscal year 1988 which
totals one hundred seventy-five dollars ($175.00). Payment is to be received within 14 clays

The Utah Underground Storage Tank Act ("Act"), Utah Code Ann., Section 26-L4e'L gl.
seq., regulates underground storage tanks ("USTs") and imposes certain obligations on the
owner or operator of a facility having underground tanks. The Act specifically requires the
owner or operator of a facility with underground petroleum storage tanks to meet the
following requirements:
1. Register underground storage tanks.
2. Pay an annual registration fee.
3. Pay an annual petroleum storage tank fund fee.
4. Meet specific technical and performance standards.
5. Meet certain financial responsibility requirements.
6. Maintain adequate tank records.
A review of the records maintained by the Bureau of Environmental Response and
Remediation ("BERR") has disclosed that you have failed to notii/ BERR of the change of
owner or operator of USTs located at the facility identified below as required by Utah Code
Ann., Section 26-1.4e-30L Furthermore, you have failed to pay the annual tank registration
fee provided for in Utah Code Ann., Section 26-1,4e-302; and the annual petroleum storage

tank ("PST') fund fee provided for in Utah Code Ann., Section 26-1.4e-402. Your failure
to comply with these requirements is based on the following facts:
Statement of Facts
Lynn Hamilton owns or operates Longhorn Service, Inc. a facility located in
Duchesne, Utah, .,'rhich has been assigned facility identification number 9000081.
Lynn Hamilton owns or operates five USTs located at the above facility, which are
regulated under Subtitle I of the Resource Conservation and Recovery Act
("RCRA"), 42 USC Section 6991(c) et. seq., and the Act.
To date, BERR has received no documentation to establish that the USTs referred
to in paragraph 2 were properly closed prior to the assessment period(s) noted
below.
4. To date, BERR has received no notification of the change of owner or operator of
USTs at the facility from Lynn Hamilton.

5. To date, BERR has received no payment for registration fees now past due for the
fiscal year 1988.
6. To date, BERR has received insufficient payment for Petroleum Storage Tank
("PST") fund fees now past due for the fiscal year 1991'.
Determination of Non-Compliance
1. Lynn Hamilton, as the owner or operator of the facility identified above, has failed
to submit a properly completed form notifying BERR of the change of owner or
operator of the USTs within 30 days.
2. Lynn Hamilton, as the owner or operator of the facility identified above, has tailed
to pay registration fees now past due for the fiscal year 1988.
3. Lynn Hamilton, as the owner or operator of the facility identified above, has failed
to pay PST fund fees now past due for the fiscal yeat 1991.
4. The total amount of fees (registration and PST fund fees) now past due and owing
is $1,062.50.
Compliance
The Act gives the Executive Secretary of the Solid andHazardous Wastes Committee the
power to enforce rules made by the Committee by issuing orders. The Act also gives the
Executive Secretary the power under Utah Code Ann., Section 26-14e-30L, to assess a civil
penalty of $1,000 if an owner or operator of an UST fails to register the tank. Other
violations of the Act may result in civil penalties of up to $10,000 per day.
This letter will serve as final notice that your failure to comply with the requirements of the
statutes, and rules summarized above, within two weeks from the date of receipt of this
letter, will result in the issuance of an order and the assessment of a civil penalty.
