Rogers, Director of Regulatory Affairs EnergySolutions, LLC 299 South Main Street, Suite 1700 Salt Lake City, UT 84111Subject:Stipulation andConsent Order for Closure of the Class A West (CAW)Embankment - Request for InformationGroundwater Quality DischargePermitNo UGW450005 Dear Mr. Rogers: Thank you for your letter of May 7, 2025, that discusses the history of the Open-Cell-Time Limit found in Part I.E.6 of the Ground Water Quality Discharge Permit (Permit) and the Cover Test Cell’s impact on Class A West embankment cover construction. As you are aware, the Permit does allow modification of the 18-year time limitation; the Permit requires that a plan, schedule, and justification be provided to obtain director approval of a modification of the Open Cell Time Limitation. As part of the justification forthemodification of the open-cell time limit the Division of Waste Management and Radiation Control (Division)needs to know when EnergySolutionsnotified David Esser, formerly of the Division, that they would not meet the Open Cell Time Limitation. Additionally, could you provide dates and times of meeting between EnergySolutions, the Division, and David Esser to discussthe exceedance of the Open Cell Time Limitation and the context of those meetings.In an April 1, 2024 letter, EnergySolutions provided an approximate timeline for the construction of final cover of the Class A West embankment. The Division would like a more formal schedule with a better-defined timeline for the closure of the Class A West embankment. The division intends to use a Stipulation and Consent order for the closure ofthe Class A West Embankment, replacing the 18-year time limit for the Class A West embankment. Any information that EnergySolutions thinks should be included in aStipulation and Consent ordershould be included with the response to this letter.
