Upon review of the Records, the Division determined that the claim of business confidentiality made by EnergySolutions meets the requirements of Utah Code Section 63G-2-309. As a result, the Division will manage the Records in accordance with Utah Code Section 63G-2-305. Future consideration of record disclosure is also subject to Utah Code Subsections 63G-2-309(1)(b) and (2). NOTICE OF APPEAL RIGHTS This letter involves an agency action. If you disagree with the agency determination described above, you may appeal the agency determination within 30 days of the date of this letter by filing a notice of appeal, in accordance with Utah Code Section 63G-2-401, to the following chief administrative officer for the Division: Douglas J.
