Subject: Radioactive Material License UT2300249 – Condition 62:Self-Identified Non-
Compliance
Mr. Howard:
EnergySolutions herein self-identifies to the Director of the Division of Waste
Management and Radiation Control non-compliance with Condition 62 of Radioactive
Material License UT2300249. Condition 62 requires EnergySolutions limit access to the
Licensed Restricted Area by six-foot chain link fences and access gates. Furthermore,
Section 3.3.7 of EnergySolutions’Clive Operating Procedure CL-RS-PR-120,Access
Control Points requires,
“When NCRA gates or doors to the Restricted Area are unlocked, a qualified RST
or a Non-Contaminated Restricted Area Gate Monitor shall be within visual sight
of and no greater than 100 feet from the gate or door.”
During a routine off-hours security patrol conducted the evening of August 4, 2025, (in
accordance with CL-SE-PR-001), Restricted Area Gate #58 was found improperly
secured without the required control of a Radiation Safety Technician (see attached
photographs). The noncompliant condition was reported to Clive Management and the
gate properly secured. Per the restricted area gate log, Gate #58 was last closed at
approximately 15:46 hours on August 3, 2025. Gate #58 provides access to the “clean
restricted area” for cover construction and the restricted area. Gate 58 is located within
the fenced owner-controlled area. A Condition Report is being generated to track
investigation and resolution of this issue.

CL-RS-PR-120 requires single ownership for each access gate security, visual and
manual gate security and dual verification when locking gates. An investigation is being
conducted to determine why these requirements failed to prevent the improperly secured
gate. Actions to prevent recurrence will be determined based on the results of the
investigation. Upon closure, the condition report, investigation findings, and any
recommended operational or administrative corrections will be provided to the Director.
