The reported release was based on observations of petroleum- impacted soil and groundwater occurring at the site of a home under construction at 1777 East 1700 South, Naples, Utah, the Kay property. On November 14, 2013, the DERR confirmed the release by sampling soil and groundwater from the home site. Laboratory results from that effort confirmed the presence of gasoline and diesel contaminants beneath the home. Initially, the source of the contamination was not known, and subsequently, the DERR initiated an investigation to determine if its source was from a leaking underground storage tank (LUST). On January 14-17, 2014, the DERR used Federal LUST Trust monies to conduct a subsurface investigation across nearly four-block area, to determine the source of the petroleum release. Results of that study suggest that the Western Petroleum/Pilot facility, located at 1521 South 1500 East, Naples, Utah, is the primary source of the contamination found at the home under construction. Additionally, the findings indicate that the highest levels of contamination are emanating from near the Western Petroleum/Pilot facility's aboveground storage tank (AST) bulk plant. 195 North 1950 West • Salt Lake City, UT DERR. The DWQ currently manages another AST release (LWP) located at the same Western Petroleum/Pilot facility. DWQ's oversight, in this case, would eliminate redundant tracking of a petroleum spill known to exist at the Western Petroleum/Pilot facility, and the need for the DERR to follow the established MOU protocol, as set forth between the DERR and DWQ. DWQ accepted the DERR's request for oversight of release 'NCE'. Therefore, I recommend that the case file (copy attached) be transferred to the DWQ, and that a hardcopy of the release information be filed in the closed LUST files. cc: Joseph B.
