Acknowledgements: I understand the PWS must meet all conditions required by the Division. I understand this Temporary Exception will be granted only for the rule(s) and location(s) listed above. I understand the PWS must obtain an exception renewal prior to the expiration date of this Temporary Exception. To obtain an exception renewal, re-submit an exception request with confirmation that all conditions outlined in this Temporary Exception have been fulfilled. Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued. Failure to request the re-evaluation of this exception and obtain an exception renewal by the expiration date will result in the activation of the deficiency.
I understand this Temporary Exception may be rescinded at any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this exception. The PWS will maintain a copy of this Temporary Exception Approval for future reference.

Delle City Station water tank storage
The 10000 gallon well site tank was placed in service sometime before I
leased the store in 2007. Instead of a locked shoe box lid, framed four
inches above the roof surface, it has an access hatch at the top but placed
on the vertical wall of the tank. It is secured by the height of the hatch and
multiple access bolts that must be removed. The gasket seal was replaced
in 2019 by Zimmerman Well services in Tooele and appears to be holding
just fine. The roof vent has the proper screen and is also in very good
condition.
The tank is a vertical standing tank. The lowest end of the access hatch is at
least 12 feet off the ground. There is no access ladder built on the tank.
The access cover is secured by 36 large bolts.
This is a very difficult tank to change a gasket and requires proper
equipment. A vandal with bolt cutters and without a very tall ladder would
have no chance gaining access. I believe the public health is secured better
than a shoebox lid with a lock.

This is an exception to Rule R309-545-14(1) Height, (2) Shoebox Lid, and (3) Locking Device for Storage Tank Access Openings:
The basis for your request for an exception to Rule R309-545-14(1), (2), and (3) for the NF001 and ST001 tanks, is that the current tank access openings are either inaccessible due to height or within a locked building. The access openings are gasketed and sealed with the opening greater than 18-inches above the ground surface or
building floor. It is understood that the water system properly cleans and disinfects the area around the access opening when performing any operation and maintenance activities associated with the access openings. Based on this information, the intent of the rule to protect drinking water from potential contamination has been met.
On this basis, a temporary exception to R309-545-14, Access Openings, is hereby granted for
the NF001 and ST001 tanks, subject to the following conditions:
1. This temporary exception expires on August 1, 2025.
2. You will be required to re-submit a temporary exception request along with confirmation that all conditionsoutlined in this temporary exception have been fulfilled and obtain an exception renewal prior to August 1, 2025.
a. Exceptions granted by the Division include an expiration date to ensure that the basis and conditions forgranting the exception are verified periodically and that the drinking water quality remains protected. Afterreceiving your request, the Division will determine whether this exception can be re-issued.
b. Failure to request the re-evaluation of this exceptions and obtain an exception renewal by August 1, 2025, willresult in the activation of the deficiency related to not having an access opening for cleaning and maintaining theStorage Facility (ST001).
3. Your System has committed to following the Divisions protocol for Plan Approval so that when this tank isreplaced, it will be replaced by a tank that meets all the R309-545 requirements.
4. To ensure the storage tank lid is still providing an equivalent degree of protection of the drinking water, theSystem will continue to collect the required monthly routine sampling of their System.
5.This temporary exception may be rescinded any time if new evidence indicates that the conditions of this
exception are no longer being met or a public health risk exists due to this exception.
