Attached is the oldest, which is over 90 days past due and approaching 120 days. Please remit payment as soon as possible. Our policy is to send anything over 120 days to State Collections (I believe that will be April 1). Also, please indicate your plans for this site, as we have not heard anything since our meeting in December. If there is an intent to stay in the VCP, we will need to discuss timely payments before we can proceed much further. I will get those taken care of. Do you know which are outstanding? [Quoted text hidden] Bill Rees <brees@utah.gov>Thu, Apr 3, 2025 at 1:26 PM To: Jacob Elsmore <jacobelsmore@gmail.com> Cc: Leigh Anderson <kanderson@utah.gov> Jake, We received a copy of the revised Remedial Action Plan for the subject site. The document was forwarded to us from the PST program. The RAP was not sent to me or Leigh under the VCP, which left us with questions. Is your plan to stay in the VCP and move ahead or is the RAP focused on the petroleum release only? Second, if the plan is to stay in the VCP and proceed, it is imperative that payments are more timely. I am hesitant to have Leigh start a review if there will be challenges with payment again. How will you address this moving forward? Please advise. I have been on vacation with my family and I just got home last night. We told Blake from Watch to return the RAP with all the corrections everyone requested. So it is of he only sent it to one person. That was not the intent, it was supposed to go to everyone who needed it. So I apologize for the condition. With that in mind, I have a couple questions for you. With all the corrections in the report that were asked of us. Can you tell me... 1. Is the report ready for approval? 2. How long will the approval take? 3. How much more is it going to cost to get the approval? I look forward to hearing from you. That you for your time. -Jake Elsmore On Wed, Apr 9, 2025, 10:10 AM Bill Rees <brees@utah.gov> wrote: Hi Jake, I am just following up with the email below. Is the report ready for approval? - We have not reviewed the report, in part because we had not heard from you regarding the status of the project and your interest in continuing to proceed under the program. Second, as noted, I am hesitant to have Leigh start a review if there will be challenges with payment again. How will your team address this moving forward in a manner consistent with the Voluntary Cleanup Agreement (VCA)? 2. How long will the approval take? Once I give her the green light, she will probably need about a week or so to review the document and see if we agree with the proposed changes. If there are still outstanding issues, it could take a bit longer as we figure out our response and work with your team to resolve the issues. 3. How much more is it going to cost to get the approval? We bill at the approved legislative rate which I believe is $125/hr. Since it has been a few months, I'm guessing she will need 10-15 hours to catch up and review the document. If there are on-going issues, she will need more time. Additional: Please keep in mind, there is still a 30-day public comment period prior to any approval of the RAP. We have no way of knowing the public's interest in this project. All public comments must be responded to, which can also add time. Once the RAP is accepted, you can implement the remedy. My team remains involved throughout the cleanup and necessary steps to close out the site so my question about the timeliness of oversight payments remains relevant.
