RE:Compliance Advisory No. ########Acceptance of Waste Greater than Class A
Radioactive Materials Licenses No. UT 2300249 and No. UT 2300478
Dear Mr. Rogers:
This Compliance Advisory is being sent to your attention as a representative of EnergySolutions, LLC (the Respondent). According to the Division of Waste Management and Radiation Control’s
(Division) records, you are the designated contact person for the Respondent.
Based on information submitted by EnergySolutions, LLC (EnergySolutions), the Director of the Division (Director) is issuing this Compliance Advisory to provide the Respondent with notice
of the followingcompliance issues as well as an opportunity to correct these apparent compliance issues: Radioactive Materials License No. UT 2300249, Condition 9, subsection B states
that “…the Licensee may not receive Class B or Class Clow-level radioactive waste without first receiving approval from the Director of the Division of WasteManagement and Radiation
Control (Director), the Governor and the Legislature.”
On April 30, 2025, a representative of EnergySolutionsnotified the Director (DRC-2025-001408) of an issue with shipment 9125-13-0007 (Bates Number M16438). EnergySolutionsconducted onsite
gamma spectroscopy, and the results did not align with the manifested data. The shipment was placed on hold to conduct a further investigation.
On May 6, 2025, a representative of EnergySolutionsprovided a 7-day follow-up report to the Director (DRC-2025-001479). Within this follow-up, EnergySolutionsprovided the results of
the onsite gamma spectroscopy which showed elevated levels of Am-241 above the Class A waste limits of 10,000 pCi/g. A sample was sent to a third-party lab to confirm the findings.
The alpha spectrometry results from the third-party lab were submitted to the Director on May 8, 2025 (DRC-2025-001523). Americium-241was detected at168,000 pCi/g, confirming the wastegreaterthan
Class A.
Please provide the Division with the following:
A detailed root cause analysis focused on the acceptance of shipment 9125-13-0007 (Bates Number M16438) at EnergySolutions.
A proposal that fully addresses the findings of the root cause analysis that contain, at a minimum, corrective actionsto be taken by EnergrySolutionsto prevent the acceptance of waste
greater than Class A in the future.
Pursuant to this Compliance Advisory, the Director is providing the Respondentwith an opportunity to correct the apparent compliance issues. The Director will also consider any evidence
and additional information provided by the Respondent.
Within 30 days of the date of this Compliance Advisory, please submit the following requested documentation regarding each compliance issue and associated corrective actions to the Director:
the cause of each compliance issue;
the specific corrective actions taken, results achieved, and applicable dates;
if future corrective actions are proposed, the specific corrective actions and proposed completion dates, including intermediate milestones, as applicable; and
how the corrective actions will prevent similar compliance issues from recurring.

If the Respondent demonstrates that it has taken appropriate corrective actionsregarding the matters addressed in this Compliance Advisory, the Director will issue a closeout letter
and will consider this matter to be closed.However, if the Respondent fails to demonstrate appropriate corrective actions within the30day timeframe, the Director will consider taking
escalated enforcement actions, including seeking financial penalties. In all events, the matters addressed in this Compliance Advisory, including the Respondent’s corrective actions,
will become part of the Respondent’s compliance record and may be considered in connection with future enforcement matters.
