Dear Scott Nielsen:
On June 24, 2024, the Director of the Division of Drinking Water (“Director”) issued an Initial
Order for New Public Water System (“IO”) to Black Desert Resort Water System UTAH27114
(“System”). The system was inactivated in our database per an email we received from Scott
Nielsen on September 5, 2024. The system has now been reactivated and we are issuing an
extension for items (See Appendix A) of the IO.
Because the System was inactive for approximately 10 months in our database, I am granting an
extension for the items listed in Appendix A with associated due dates.
With the issuance of this extension, the Black Desert Resort Water System will remain unrated.
Please continue to work with Division staff and your local health department to remain in
compliance. Under Utah law, the Director of the Division is required to provide notice of
violations of the Utah Safe Drinking Water Act (the “Act”), the rules, or orders, and to otherwise
enforce compliance with regulatory requirements; this includes violations of the IO.
