Everett Director ERRL-0158-25 April 22, 2025 CERTIFIED MAIL RETURN RECEIPT REQUESTED Catherine Wyffels Salt Lake City Corporation, Department of Sustainability 451 South State Street Salt Lake City, Utah 84111 Re:Subsurface Investigation Requirements 4th West Apartments, 455 West 200 North, Salt Lake City Facility ID 4002538, Release NMN Dear Ms. Wyffels: A release of petroleum from a petroleum storage tank (PST) at the above-referenced site was reported on December 22, 2016, to the Division of Environmental Response and Remediation (DERR) based on soil contamination encountered during the removal of a PST. In January 2017, approximately 44 cubic yards of contaminated soil were over-excavated and taken off-site for proper disposal. Soil and groundwater concentrations following the removal remain above the acceptable cleanup standards. Additionally, a Limited Site Investigation conducted in May 2017 indicated that petroleum contamination in soil and groundwater existed at the perimeter of the former excavation area above cleanup standards. In early 2019, Salt Lake City Corporation (SLC, Corp.) applied for funding from the Federal Coalition Assessment Grant. Unfortunately, money from the grant was not awarded, and no additional work has been completed. According to Utah Administrative Code R311-202, SLC, Corp., is required to report, control, abate, and characterize the release by defining the extent and degree of petroleum contamination and remediate (clean up) the release. These regulations require that SLC, Corp., prepare specific reports addressing the release and submit them to the DERR within specified time frames following the release. The DERR project manager has reviewed the release information and the limited investigation and has determined that additional investigation is required. The project manager relied on the information provided to the DERR and did not investigate the facility independently. The investigation's intent is to define the extent and degree of subsurface petroleum contamination Facility ID 4002538 Page 2 and evaluate the potential risks to human health and the environment. Sampling, abatement, and cleanup activities must be performed by a Utah Certified PST Consultant or Sampler as outlined by Utah Admin. Code R311-201-2(a). A Subsurface Investigation Report (SIR) outlining the results of the investigation must be submitted to the DERR within 90 days of your receipt of this letter. Requirements for an SIR can be found on our website: https://deq.utah.gov/environmental- response-and-remediation/guidance-documents-references-lust-program. The DERR project manager will evaluate the SIR findings to determine whether a No Further Action (closeout) recommendation can be made or if additional work is necessary. This additional work may include investigation, cleanup, monitoring, and/or risk assessment. Section 19-6-420(10)(a) of the Underground Storage Tank Act allows the DERR to recover certain expenses incurred for petroleum releases not covered by the PST Fund. The DERR’s expenses for managing and overseeing the abatement, investigation or corrective action are billed quarterly to the responsible party. The Utah Legislature sets rates for oversight and review, currently $125.00 per hour. Payment will be due within 30 days from the billing. Certain factors may be considered by the Division Director when determining whether to recover these management and oversight costs. If the responsible party can demonstrate an inability to pay, the Division Director may grant an exemption from paying these expenses.
