The following equipment has been approved for operation for this temporary project: PTR-400X jaw crusher Cedarapids-Terex impact crusher Finlay/883 C & S screen Scania 271 hp generator Scania 550 hp generator Cat/C4.4 142 hp generator Deutz 73 hp generator Miscellaneous stackers Utah Administrative Code (UAC) R307-209 authorizes portable equipment for temporary projects. This equipment will be used by Interstate Rock Products which will be responsible for the operating conditions and the emission reporting requirements for this project. Approval is granted to relocate and operate this equipment at the new location for a period not to exceed 180 operational days. As per UAC R307-209-5, the operation of equipment at this temporary site may be for up to 180 working days in any calendar year not to exceed 365 consecutive days, starting from the initial relocation date. Approval is subject to the conditions of the dust control plan submitted for this location and UAC R307-209. Hours of operation for this equipment shall be held to 10 hours each day. Please make certain that the plant operator is aware of all the location specific requirements for this site and the conditions of the aforementioned AO. Federal New Source Performance Standards Subpart OOO requires that initial Method 9 observations be performed for all applicable portable crushers, screens, and attached conveyors. Subpart OOO also mandates that all crushers constructed, modified, or reconstructed on or after April 22, 2008, which are not enclosed, must install spray bars on the equipment and keep maintenance records to ensure proper spray bar operations. Utah Division of Water Quality Storm Water Permits and regulations may apply to this temporary project. Please refer to Utah DEQ Water Quality’s current Storm Water Construction requirements for additional information. This approval for relocation in no way releases the owner or operator from any liability for compliance with all other applicable federal, state, and local regulations including the UAC. I noticed some mentions of the Laverkin Pit in the email thread and want to ensure this is a separate operation, as we manage temporary projects at permanent sites differently. The DAQ updated the format of portable approval orders (AO) several years ago to generically referenced equipment (see Section II.A of attached DAQE-AN143180003-24 for an example) rather than listing out each specific piece of equipment like the 2010 (AO) for Interstate Rock Products currently does. This update is something you can work with our permitting group to get updated and it sounds like you have been in contact with Christine Bodell about that. This would probably be a good option since the equipment ratings (TPH and HP) you have referenced on the Temporary Relocation do not match what is listed in the portable AO. Another option would be to use UAC R307-209 (see attached R307-209) for the project. This is a new state rule that authorizes temporary relocation equipment without requiring a portable AO. At this point, I would recommend using R307-209 for this particular temporary relocation to resolve the issue of the requested equipment not matching that on the portable AO. You also need to include a valid Fugitive Dust Control Plan (FDCP) number for this temporary project (Question 22 of the form you filled out which has been answered as "N/A"), and include all pieces of equipment intended for use (Question 25-10 of the form was answered as "See email dated 5-22-2025 for all other equipment"). You can go here and click on "Submit FDCP Online" at the top of the page to fill out that plan then respond back to this email with that plan number. You can also respond back to this email with all equipment that will be used at this location as the diagram provided on 5-22-25 does not really specify what's different from what was provided in the temporary relocation application.
