A Site Investigation Reporting and Requirements (SIR) compliance schedule (SIR letter) was sent on October 25, 2023 which outlined information required to be submitted to the State of Utah PST Branch concerning your above-referenced Release Site. The report outlined in the SIR letter was due on January 31, 2023. To date, the required information has not been submitted and is currently past due. Pursuant to Utah Admin. Code R311-202, Sections 280.62 through 280.65, you are required to characterize the site by determining the extent, degree, and location of petroleum contaminated soils and the presence, concentration, and extent of dissolved petroleum contamination in the groundwater, and initiate free product removal, when appropriate. Additionally, the SIR report should include the disposal documentation of the soils excavated from the release area and stockpiled at the Point East facility. If the results of your overdue report indicate that laboratory analytical results at either the source area or the stockpile location are above State-established petroleum cleanup levels, or the extent and degree of the subsurface contamination is not adequately defined, you will receive and be required to comply with the requirements of additional compliance schedules. In addition, you may be required to conduct remediation (cleanup) of any subsurface contamination which does exceed applicable state-established cleanup levels. Facility ID# 1000890 Page 2 Any PST release management, abatement, investigation or corrective action must be performed by a Certified PST Consultant as outlined in Utah Admin. Code R311-201-2. Failure to submit the required SIR report referenced herein within 90 days of your receipt of this notice may result in further compliance actions against you.
