Subject: NOTICE OF DEFICIENCY– D003: Distribution System Unable to Provide 20 PSI Minimum Pressure, Water System #UTAH20070 Lorne Berry:
It is our understanding that portions of the Legacy Mountain Water System (the System) have
water pressure below 20 psi and several cabin connections that have no water or pressure available to them. We also understand that, historically, the System has been able to provide adequate pressure to all connections in the past with the same infrastructure (wells, tanks, etc.) that is currently in service.
On February 21, 2025, I met with you and your representatives, along with Utah Division of
Drinking Water (Division) employees Ryan Dearing and Pete Keers. Mark Bagley, a cabin owner served by the System, was also present at that meeting. The purpose of that meeting was to discuss the lack of water service to portions of the existing water system located in the higher elevations of the system. You explained that your previous investigations into the problem led you
to believe that the water lines in the higher elevation areas have multiple leaks that is preventing
the water system in that area to stay pressurized. Your proposed solution to the problem was to start searching for those pipeline leaks and repairing them as soon as the snow cleared from those areas.
On May 8, 2025, I sent you an email inquiring about your plans to start looking for the pipeline
leaks, as you mentioned you would do during the meeting on February 21st. No response to that
email inquiry was received.
On May 14, 2025, I received an email from Mark Bagley indicating that work had not begun on repairing, or attempting to locate, the leaks in the water system piping.
On May 28, 2025, I met with four cabin owners that have a water connection to the System, but
have no water available or the water is only intermittently available. It was confirmed on site that
day, that those cabins had zero pressure and no water available.

Based on these findings, a 50-significant point deficiency will be added to the Improvement Priority System (IPS) report for D003: Distribution System Unable to Provide 20 PSI Minimum Pressure For Water Lines.
The system has 120 days to correct this deficiency and come into compliance. If the system
cannot meet that deadline, the system must request a corrective action plan (CAP) with the
Division to address the significant deficiencies at requestcap.utah.gov prior to the deadline.
Once the deficiency has been corrected, you must notify the Division and submit documentation of that correction within 30 days of completion. Failure to do so will result in a treatment technique violation as stated in R309-215-16(4)(a).
