Re:Request for Information Regarding PST Fund Eligibility at the
Former ABF Freight Site

Dear Mr. Duke:
The Division of Environmental Response and Remediation (DERR) received email
correspondence dated April 15, 2025, from your consultant, David Wilson at Tetra Tech, requesting
information pertaining to the former ABF Freight Site. We acknowledge your interest in obtaining
copies of the Division of Environmental Response and Remediation (DERR) Underground Storage
Tank Inspection Report from 2024 (enclosed) and annual inspection reports from 2023 back to 1992.
Requests for records must adhere to the Government Records Access and Management Act
(GRAMA), Utah Code § 63G-2-101 et seq. To facilitate access to public records, specific procedures
are required to ensure compliance with GRAMA.
To obtain the remaining requested inspection reports and historic file information, you will
need to submit a formal GRAMA request.
Please complete the enclosed GRAMA Request Form and email it back to
errgrama@utah.gov. We will process your request in accordance with GRAMA upon receipt of a
complete and formal submission.
As outlined in the prior correspondence, a release must meet the requirements outlined in Utah
Code and Utah Administrative Code to be covered by the Petroleum Storage Tank (PST) Fund. In

accordance with Utah Code Ann. § 19-6-424(1) and Utah Admin. Code 311-207-2(9), the following
information, which mirrors the questions in our prior email, must be included in your evidence or
response to ensure that any potential release meets the requirements for PST Fund coverage:
1. Provide any and all evidence that a release occurred from the tanks during a period of
coverage by the PST Fund.
2. Provide documentation of the amount of the release from the PST Fund participating
tank(s) during the time the tank(s) were covered by the PST Fund. Provide estimated
volumes, supporting calculations, and all information used in this determination.
Automatic Tank Gauge records with inventory data over time may be available from
the operator’s service provider.
3. Provide evidence to support segregating the release volumes, extent, and costs of a
potentially PST Fund covered release from previous known releases not covered by
the PST Fund, as required by Utah Admin. Code R311-207-2(9).
In addition to the above, the DERR will require a report, with supporting documentation,
detailing findings related to any new release, to be submitted within 60 days of receipt of this letter.
At that time, the DERR DivisionDirector will make a determination regarding Larry H. Miller’s PST
Eligibility Application. In the event that evidence of a new release from the four PST Fund covered
diesel PSTs cannot be provided, the DERR will close Release OLX.
