Dear Mrs. Pitcher:
On April 7, 2025, David Pitcher with Ophir Mountain LLC (Project Proponent) submitted a 401 Water Quality Certification Request to the Utah Division of Water Quality (DWQ) for the proposed
Project Smith Ranch (Proposed Project). The USACE determined the reasonable period of time to be 60 days. The Division will issue a certification decision by June 7, 2025.
Enclosed is the Draft Section 401 Water Quality Certification for the Proposed Project, which will be on Public Notice until May 15, 2025. The Public Notice announcement is enclosed
and can be found on the Division website https://deq.utah.gov/public-notices-archive/water-quality-public-notices. After considering public comment, the Director may execute the Certification
issuance, revise it, or abandon it.
