Please see attached letter regarding the transfer of facilities from the Division of Oil, Gas, & Mining to the Division of Waste Management and Radiation Control. Please click on the link in the letter to complete your Facility Transfer Bond Release Application Form. Please note that while DOGM will process bond releases as promptly as possible, the timing of actual fund availability depends on your financial institution. If you have any questions, please contact reportingOG@utah.gov. Recycling facilities that will stay under DOGM will need to submit a new application by April 1, 2025. HENDERSON Lieutenant Governor January 15th, 2025 NOTICE TO OIL AND GAS OPERATORS Re: Transfer of Facilities from the Division of Oil, Gas, & Mining to the Division of Waste Management and Radiation Control On October 15, 2024, the Division of Waste Management and Radiation Control adopted Rules R315-321 and R315-322, transferring E&P waste facilities from the jurisdiction of the Division of Oil, Gas, & Mining to the Division of Waste Management and Radiation Control. As a result of this transfer, the Division of Oil, Gas, & Mining has drafted a new Rule 649-9, E & P recycling. The board entered into formal rule making at the December 4, 2024 hearing, and Rule 649-9 E and P waste management is expected to be rescinded effective February 26, 2025. Due to these changes, we have decided to release bonds for facilities that have applied for a temporary permit with the Division of Waste Management and Radiation Control as soon as the operator submits both: 1.A proof that a temporary application has been submitted, and 2.A completed “Facility Transfer Bond Release Application” form -available on our website.Link(https://app.smartsheet.com/b/form/27cc8143a3aa4f39b0857a39bb38ac78) As the DOGM bonds are released, it is the operator’s sole responsibility to ensure compliance with DWMRC financial assurance requirements. DOGM has no involvement in securing these bonds or initiating the transfer of bonds.
