Dear Andrew Clark Beecher:
The Division of Drinking Water (the Division) received the updated Drinking Water Source Protection (DWSP) plan for the listed sources from you on November 13, 2023. Spring #10 and Spring
#11 were included in the updated plan, however, Division records show that these two sources never received concurrence for their PER/DWSP plan. In a letter dated November 13, 2008,
the system requested that this plan status be changed to inactive since it was decided not to develop the springs at that time. If development were to proceed, land use agreements would
be required. The letter has been attached for your reference.
We have completed our review of the updated DWSP plan and find that the plan basically complies with the applicable portions of Utah’s Administrative Rules for Public Drinking Water
Systems. The Division concurs with this updated plan. We commend you for establishing a program to protect this source from present and future contamination. This plan must be updated
often enough to ensure that it reflects current conditions in your protection zones.
The due date for submitting the next updated plan is December 31, 2029. Updates are not required for inactive sources but will be accepted for review if submitted.
Important Notice for Spring #10 (WS010) and Spring #11 (WS011)
A PER/DWSP plan for WS010 and WS011 was received and reviewed by Division staff on April 18, 2008. However, the plan was never approved since land use agreements from landowners in zones
one and two were not provided to the Division. Rule R309-600-13(2)(d) states thataPWS shall not introduce a new source into its system until copies of all applicable recorded land use
agreements are submitted to DDW.
In a letter dated November 13, 2008, the PWS requested that the PER status for these sources be changed to inactive, since it was decided that development would not proceed for the time
being. If the sources were to be developed, land use agreements (LUA) would be acquired and provided to the Division. Since LUAs have not been provided to date, these sources have not
received a PER/DWSP concurrence letter and therefore are not approved for public use. RemindersAs stated in R309-600 and 605: Implementing DWSP Plans - Each Public Water System (PWS)
shall begin implementing each of its DWSP Plans in accordance with the implementation schedule within 180 days after submittal if the plan is not disapproved. Be prepared to describe
these efforts in your next update, which should include documentation of how the land management strategies identified for existing and future potential contamination sources were implemented.
Your updated plan will be disapproved, and 25 Improvement Priority System (IPS) points will be assigned for failure to comply with this requirement.As stated in R309-600 and 605: Recordkeeping
- As a DWSP Plan is executed, the PWS shall document any land management strategies that are implemented. Please provide actual copies of memoranda of understanding, public education
programs, bill stuffers, newsletters, or other correspondence documenting the implementation of each land management strategy as it occurs, in this section of your updated plan.Please
