The equipment on site consists of various presses, laminators, and finishing and packaging machines. The VOC emissions from all the operations at the plant will be controlled by a regenerative thermal oxidizer (RTO) that uses supplemental natural gas to maintain the operating temperature. The VOC emissions from the ink and solvent storage areas, ink mixing areas, printer de-inking areas, the Uteco 8 color press device, and three (3) floor sweeps are controlled by the RTO as well. [R307-401-8] I.5 At all times, including periods of startup, shutdown, and malfunction, owners and operators shall, to the extent practicable, maintain and operate any equipment approved under this AO, including associated air pollution control equipment, in a manner consistent with good air pollution control practice for minimizing emissions. Determination of whether acceptable operating and maintenance procedures are being used will be based on information available to the Director which may include, but is not limited to, monitoring results, opacity observations, review of operating and maintenance procedures, and inspection of the source. SECTION II: SPECIAL PROVISIONS II.B REQUIREMENTS AND LIMITATIONS II.B.1 Site-wide Requirements II.B.1.a The owner/operator shall not allow visible emissions from any stationary point or fugitive emission source on site to exceed 10% opacity. [R307-401-8] DAQE-AN158320003-24 Page 7 II.B.1.a.1 Opacity observations of emissions from stationary sources shall be conducted in accordance with 40 CFR 60, Appendix A, Method 9. [R307-401-8] II.B.2 VOC Requirements II.B.2.a The VOC content of the inks used at this plant shall not exceed the density limits established by R307-351. Inks shall not be thinned or otherwise reduced beyond manufacturers recommendations. [R307-351] II.B.2.a.1 The density parameters shall be tested by using the appropriate ASTM method or another method approved by the Director. [R307-401-8] II.B.2.b The plant-wide emissions of VOCs from the printing presses and associated operations shall not exceed: 19.35 tons per rolling 12-month period for VOCs. [R307-401-8] II.B.2.b.1 Compliance with each limitation shall be determined on a rolling 12-month total. Based on the 20th day of each month, a new 12-month total shall be calculated using data from the previous 12 months. [R307-401-8] The VOC emissions shall be determined by maintaining a record of VOC-emitting materials used each month. The record shall include the following data for each material used: A. Name of the VOC-emitting material, such as ink, adhesive, solvent, thinner, reducers, chemical compounds, toxics, isocyanates, etc. B. Density of each material used (pounds per gallon) C. Percent by weight of all VOC in each material used D. Gallons of each VOC-emitting material used E. The amount of VOC emitted monthly by each material used shall be calculated by the following procedure: VOC = (% VOC by Weight/100) x [Density (lb/gal )] x Gal Consumed x (1 ton/2000 lb) F. The amount of VOC emitted monthly from all materials used. G. The amount of VOCs reclaimed for the month shall be similarly quantified and subtracted from the quantities calculated above to provide the monthly total VOC emissions. H. VOCs from the floor sweeps, the Uteco 8 press, and the Uteco 8XS are controlled by the RTO and shall be accounted for assuming 95% capture efficiency and 98% control efficiency. [R307-401-8] II.B.2.c The owner/operator shall not use any chemicals with any HAPs in the printing presses and associated operations in the plant. [R307-401-8] II.B.2.c.1 The owner/operator shall use the most recent version of the Safety Data Sheets (SDS) to demonstrate compliance with the HAP requirement above. [R307-401-8] DAQE-AN158320003-24 Page 8 II.B.3 RTO Requirements II.B.3.a The owner/operator shall route all emissions from the floor sweeps, Uteco 8 Press, and Uteco 8XS Press to the RTO before being vented to the atmosphere. [R307-401-8] II.B.3.b At all times while operating, the owner/operator shall maintain a temperature at or above 1,500 degrees Fahrenheit in the RTO. [R307-401-8] II.B.3.c The owner/operator shall install, calibrate, maintain, and operate a device to monitor the operating temperature of the RTO. [R307-401-8] II.B.3.c.1 The monitoring device shall be located such that an inspector/operator can safely read the output at any time. The operating temperature of the RTO shall be recorded on a daily basis when the RTO operates. Air pollution producing sources and/or their air control facilities may not be constructed, installed, established, or modified prior to the issuance of an AO by the Director. A 30-day public comment period will be held in accordance with UAC R307-401-7. A notification of the intent to approve will be published in the Ogden Standard Examiner on October 18, 2024. During the public comment period the proposal and the evaluation of its impact on air quality will be available for the public to review and provide comment. If anyone so requests a public hearing within 15 days of publication, it will be held in accordance with UAC R307-401-7. The hearing will be held as close as practicable to the location of the source. Any comments received during the public comment period and the hearing will be evaluated. The proposed conditions of the AO may be changed as a result of the comments received. Based on the 20th day of each month, a new 12-month total shall be calculated using data from the previous 12 months. The record shall include the following data for each material used: A. Name of the VOC-emitting material, such as ink, adhesive, solvent, thinner, reducers, chemical compounds, toxics, isocyanates, etc. B. Density of each material used (pounds per gallon). C. Percent by weight of all VOC in each material used. D. Gallons of each VOC-emitting material used. E. The amount of VOC emitted monthly by each material used shall be calculated by the following procedure: VOC = (% VOC by Weight/100) x [Density (lb/gal )] x Gal Consumed x (1 ton/2000 lb) F. The amount of VOC emitted monthly from all materials used. G. The amount of VOCs reclaimed for the month shall be similarly quantified and subtracted from the quantities calculated above to provide the monthly total VOC emissions. H. VOCs from the floor sweeps, the Uteco 8 press, and the Uteco 8XS are controlled by the RTO and shall be accounted for assuming 95% capture efficiency and 98% control efficiency. (RMEC) is hereby providing you with the following request for modification of the above- referenced Approval Order (AO) with the Utah Division of Air Quality (UDAQ). The primary purpose of this AO modification is to allow the addition of a color printer and a printer/laminator to the existing printing operations at the site. Additionally, there are couple of administrative discrepancies in the AO that Target Labels would like addressed as part of the modification. MODIFICATION DETAILS New Equipment Target Labels intends to add the following equipment to the permitted printing processes currently in operation at the site: § One (1) Uteco Onyx XS 8 Color Printer with two (2) burners and a single corona treater attached. This unit will be connected to the Regenerative Thermal Oxidizer (RTO) system and will result in a total increase of 156,420 pounds of ink usage and 148,500 pounds of solvent usage. Total increase of volatile organic compounds (VOC) are summarized in Table 1 on the following page. § One (1) Uteco Mistral MV Printer/Laminator with an attached single burner and corona treater. This unit will primarily run water-based products, which would foul-up and damage the RTO. As such, emissions from the unit will not be controlled by the RTO when running water-based inks; however, it will be connected to the RTO so that standard inks projects need to be ran, if needed. Operation of this unit will result in an increase of 2,000 pounds of water-based ink usage. Cleaning of the unit after water-based projects uses water and will not require any solvent usage for cleanup. Total increase of VOC emissions are also summarized in Table 1. Water-based inks, used on the printer/laminator process, have an average VOC content of 4.5% 2 Control efficiency of 98% was applied for the RTO unit (as per 2017 NOI). Administrative Modifications Target feels that the following administrative modifications should be made to address some discrepancies in the AO: § The abstract section of the AO states that all operations at the plant will be controlled by the RTO; however, the RTO is currently only used to control emissions from the existing Uteco color presses/printer along with the floor sweeps. The new equipment associated with this modification will be connected to the RTO; however, other units, such as the simplex press and digital printer, were never intended to be connected to the RTO. § Provision II.B.1.d of the subject AO, stipulates that “the owner/operator shall not use any chemicals with any HAPs in the printing presses and associated operations in the plant. [R307-401-8]”. We feel that the inclusion of this provision may have been an error as the permit does allow for 0.03 tons of HAP emissions. BACT ANALYSIS Uteco Onyx XS 8 Color Printer All VOC/HAP emissions from this printer will be routed to the RTO, which meets the currently- accepted BACT requirements. Uteco Mistral MV Printer/Laminator Emissions from water-based inks on the printer/laminator will not be routed to the RTO. This unit will primarily use water-based ink and adhesives products, which are not compatible with the RTO. Treatment of water-based product emissions will foul-up and ruin the RTO, which makes the use of such control technology “technically unfeasible”. Furthermore, the quantity of water- based VOC emissions are minimal (less than 100-lbs) and would not meet the BACT cost effectiveness thresholds. If standard inks are run on this unit, all VOC/HAP emissions from this printer will be routed to the RTO, which meets the currently-accepted BACT requirements. The heated oil is circulated through the jacketed vessel at precisely controlled temperatures to optimize the heat transfer for the solvent/s in question. At the end of the batch the unit will automatically cool down for 1 hour, after which time the operator can define a sludge temperature that is safer for the dump process. This system also provides the benefit of a self-contained heating system and is therefore easy to install and certify as explosion-proof. 1.0 Scope of Supply 1.1 Components This proposal covers the standard specifications and terms of sale for the purchase of one Model SR-180V-Nitro Solvent Recovery System and options supplied by: IST, 4160 Boul. Proposal # S2020-PPCTS-TL01rev1 4 of 13 2.2 Electric Resistance Heater • Three 5 kW, explosion-proof heater for a total of 15kW o Temperature range: 100°F - 435°F / 40°C - 224°C. 2.3 Vacuum System • Vacuum is used to reduce boiling point temperatures, and therefore reduce the amount of heat energy needed for operation. • Vacuum is provided by an air vacuum generator using compressed air. The vacuum generator has a no mechanical moving part for long service life. • A vacuum gauge is also provided for fast visual inspection of the vacuum status. 2.4 Auto Cool-down When the heating cycle is completed, the unit will automatically go into a cool down mode for 1 hour as indicated by the PLC display. At the end of the cool down period the PLC will indicate: –END- . At this time the operator can dump the sludge from the distillation vessel in lower and safer temperature conditions. 2.5 Standard Sludge Discharge The standard sludge discharge is manually done by the operator. Upon completion of the process, the operator will open the cover of the distillation vessel and remove the plastic bag to discharge the sludge contents. Depending on the size of the distillation vessel, it will take multiple batches before filling up a drum of sludge. 2.6 Control Panel Control hardware is mounted on left side of cabinet for operator convenience. Electrical components are CSA/UL approved. The unit is CSA certified for Canada and USA as per UL2208 standard. The electrical design is in accordance with the National Electrical Code (NFPA 70) for explosion proof installation in a Class 1, Division 1, Group D environment. Controls consist of: • IST PLC controller • RTD (Resistance Thermal Devices) in the oil, sludge and reclaimed solvent areas for continuous process monitoring by the PLC • High-level float switch 2.7 Software The control software is written and supported by IST Industry in Laval, QC. Taxes: Unless otherwise expressly provided in the Order, prices quoted do not include taxes, license fees or other assessments with respect to the Goods or Services and Buyer shall pay any and all use, sales, privilege, income tax or other taxes or license fees or assessments imposed by foreign, federal, state or local governments. 6. Shipment Terms: Unless otherwise expressly provided in the Order, all shipments are Ex-Works, Pewaukee, WI 53072, USA (Incoterms 2000), and all storage, shipping, insurance, special packing or crating, and other incidental costs with respect to the Goods shall be for the account of or paid directly by Buyer. 7. Shipment Date: Any shipment date for the Goods acknowledged by PPCTS is a desired and not a promised date. PPCTS will make all reasonable efforts to meet the shipment schedule set forth in the Order but shall not be liable for failure to do so. Acknowledged shipment dates are conditional on PPCTS receiving all required payments and technical and commercial information promptly in accordance with the terms set out in the Order. PPCTS shall not be liable for any damage to or loss of the Goods or any delay in or failure to ship, deliver, service, repair or replace the Goods arising from shortage of raw materials, failure of suppliers to make timely delivery, failure of suppliers of Buyer-specified components to make timely delivery and provide timely technical assistance, labor disputes of any kind, fire, windstorm, flood, theft, war, embargoes, governmental acts or rulings, loss or damage or delays in carriage, acts of God, or any other circumstances beyond PPCTS's control. 8. Installation: Unless otherwise expressly provided in the Order, the Goods are sold for installation and interconnection by Buyer; Buyer will supply all necessary labor, material, and permits to properly install the Goods in accordance with PPCTS's specific instructions; and PPCTS will not be responsible for moving any machinery, for pipe fitting, electrical work, or any other labor. PPCTS recommends that it or one of its authorized representatives supervise Buyer's installation and start-up of the Goods. If Buyer requests PPCTS's supervision of the installation and start- up, Buyer shall promptly pay PPCTS for such services at PPCTS's then current rates. If Buyer installs and starts up the Goods without PPCTS's supervision, Buyer shall have the sole responsibility for all installation procedures. Compliance with any and all local, state and federal requirements is the responsibility of Buyer. 9. Warranty: During the warranty period, PPCTS will repair or replace at its facility in Pewaukee, WI, USA, any part of the Goods, which part has been manufactured by PPCTS, and which PPCTS determines to have failed because of defective design, material or workmanship under normal use and service. PPCTS shall have no warranty or other liability for any part not manufactured by it, but agrees to cooperate with Buyer in obtaining an assignment of PPCTS's warranty rights against the manufacturer. Prior to repair or replacement, PPCTS shall have the right to examine the part at its option either at Buyer's plant or at PPCTS's facility in Pewaukee, WI, USA. For this warranty to apply, Buyer must give PPCTS written notice of any warranted defect within fifteen (15) days after discovery and, in any event, not later than the date on which this warranty expires or Buyer will be barred from any remedy. Upon PPCTS's written authorization, the Goods must be shipped to PPCTS freight prepaid within a reasonable time thereafter. This warranty shall not apply to any of the Goods or parts thereof repaired or altered by anyone but PPCTS or its authorized representatives, operated or installed contrary to instructions, subjected to misuse, negligence or accident, or to the first service visit by PPCTS in the event that the Buyer elects not to use PPCTS's supervision during installation of the Goods; provided, that PPCTS shall not be obligated to make any service visits to Buyer's plant. This warranty is not assignable and expires upon the earlier of Buyer's transfer, sale or other disposition of the Goods, or one (1) year from the date of shipment of the Goods by PPCTS to Buyer. PPCTS's liability under this warranty shall be limited to repairing or replacing warranted Goods or, if such Goods cannot be repaired or replaced by PPCTS, to the return of the purchase price paid for the defective or nonconforming warranted Goods; provided, that Buyer shall first return to PPCTS those goods for which a refund of the purchase price is to be made. Proposal # S2020-PPCTS-TL01rev1 10 of 13 Standard Terms and Conditions of Sale THE WARRANTIES PRINTED ABOVE ARE THE ONLY WARRANTIES APPLICABLE TO THE ORDER OR THE GOODS. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED. 10. Limitation of Liability PPCTS SHALL NOT BE LIABLE, WHETHER IN CONTRACT, IN TORT, UNDER ANY WARRANTY, IN NEGLIGENCE, OR OTHERWISE, FOR INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES OR FOR COSTS OF REMOVAL OR SHIPMENT. UNDER NO CIRCUMSTANCES SHALL PPCTS'S LIABILITY OR BUYER'S REMEDY FOR DAMAGES AGAINST PPCTS EXCEED THE AMOUNT OF THE PURCHASE PRICE OF GOODS SOLD FOR WHICH OR RELATING TO WHICH CLAIM IS MADE. IN THE EVENT THAT PPCTS'S WARRANTY, IF ANY, OR ANY OTHER OBLIGATION OF PPCTS APPLICABLE TO THE GOODS FAILS OF ITS ESSENTIAL PURPOSE, BUYER'S EXCLUSIVE REMEDY SHALL BE LIMITED TO RETURN OF OR CREDIT FOR SO MUCH OF THE PURCHASE PRICE AS IS APPLICABLE TO THE GOODS WHICH ARE NONCONFORMING OR DEFECTIVE, PROVIDED SUCH GOODS ARE RETURNED TO PPCTS. THE PRICE STATED FOR THE GOODS IS BASED UPON AND IN CONSIDERATION FOR LIMITING PPCTS'S LIABILITY. NO ACTION ARISING OUT OF THE ORDER OR PERTAINING TO THE GOODS MAY BE BROUGHT BY BUYER MORE THAN FIFTEEN (15) MONTHS AFTER THE DATE OF SHIPMENT OF THE GOODS BY PPCTS TO BUYER. BUYER'S REMEDIES AS PROVIDED HEREIN ARE ITS SOLE AND EXCLUSIVE REMEDIES. 11. Default and Remedies: If Buyer fails or refuses to accept delivery of the Goods, fails to pay for the Goods when due or otherwise fails to perform in accordance with the Order, all amounts owing to PPCTS by Buyer under the Order and any other order or obligation shall at PPCTS’s option and without notice or demand become immediately due and payable and PPCTS shall have available to it any remedy allowed by law or equity, and may recover all damages suffered by PPCTS as a consequence from Buyer’s breach. Without limiting the foregoing, PPCTS shall have the right in the event of a breach or default to retain the cash deposited or paid to it by Buyer and the Goods accepted by it on account of the sale price, if any, and apply the same toward payment of its damages. If Goods ordered have been delivered to Buyer by PPCTS at the time of default or breach, PPCTS may repossess the products as allowed by law. Any payment not received by PPCTS within ten (10) days after its due date shall bear interest at the rate of two percent (2%) per month from its due date until paid. In the event that PPCTS resorts to an attorney to collect amounts due under the Order, for the Goods, and/or for PPCTS’s damages, Buyer shall pay PPCTS its costs and expenses incurred to effect collection, including without limitation all attorney’s and paralegal fees and all court costs and out-of-pocket disbursements. 12. Security Interest: PPCTS retains a purchase money security interest in all Goods not paid for in full, notwithstanding that the Goods have been delivered to Buyer, and Buyer shall execute and deliver to PPCTS upon request, financing statements describing the Goods, and other documents which may be requested by PPCTS to evidence its security interest. 13. Breach of Contract: Breach of contract by either party shall have no effect upon the provisions governing the risk of loss of the Goods. Section 2-510 of the Uniform Commercial Code shall have no effect on the Order and unless otherwise expressly provided in the Order, Buyer shall remain obligated for all risk of loss to the Goods until their proper return to PPCTS pursuant to paragraph 9 of these Conditions of Sale. 14. Governing Law; Consent to Jurisdiction and Venue: The Order is made in and it and all matters pertaining to the Goods shall be governed by the laws of the State of Wisconsin, USA. Buyer irrevocably consents to the jurisdiction of any court located in district of Milwaukee, Wisconsin, USA. The Courts located in Milwaukee, Wisconsin, USA shall have exclusive jurisdiction over all controversies arising out of or in connection with the Order or the Goods. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply to this Order or the Goods. 15. Invalid Term: The invalidity of any term contained in the Order shall not affect any other of its terms. 16. Non-waiver: PPCTS's failure to enforce or declare a default or breach with respect to any particular term or condition of the Order shall not be considered a waiver of PPCTS's right to enforce or declare a default or breach with respect to any other term or condition or, on a subsequent occasion, with respect to that particular term or condition or, on a subsequent occasion, with respect to that particular term or condition. 17. Alteration of Terms and Parol Evidence: The terms and conditions of the Order are in each instance intended by the parties as a final expression and a complete and exclusive statement of the agreement of the parties respecting Buyer's purchase of the Goods from PPCTS. None of the terms and conditions contained in the Order may be modified except by a written instrument signed by an authorized officer of PPCTS and delivered by PPCTS to Buyer. In the event that the English text of these Conditions of Sale are translated into another language text, the English text will take precedence in any discrepancies. 18. Payment: Unless otherwise expressly provided in the Order, standard terms of payment to customers with approved credit are: 40% With placement of order, 50% Prior to shipment, 10% On completion of installation and start-up or 30 days from delivery for PRODUCT shipped by PPCTS due immediately upon receipt of invoice for equipment and upon receipt of invoice for accessories, parts, labor and service unless other terms are expressly provided in the Order. Interest will be charged at the rate of two percent (2%) per month on delinquent accounts. 19. Errors: Stenographic and/or clerical errors in PPCTS’s Order are subject to correction by PPCTS without liability.
