General Description
Geneva Rock Products, Incorporated (Geneva) operates an aggregate mining and processing facility
called the Cove Aggregate Pit in Cove, Utah. There are two mining areas: the upper mining area and the
lower mining area. The lower mining area has a processing plant consisting of a screening plant and a
crushing plant. The screening plant consists of one screen and various conveyors and feeders. The
crushing plant consists of three crushers, two screens, and various conveyors and feeders. Power to the
crushing plant is provided by a 475-hp diesel generator, and power to the screening plant is provided by a
174-hp diesel generator. The company produces up to 83,799 tpy of bank-run material from the upper
mining area and 304,469 tpy of processed aggregate from the lower mining area.

Project Description
This project is a 10-year review of this source and the Approval Order associated with it.
On August 23, 2023, DAQ Compliance noted that most of the equipment listed in the permit was not on
site. Geneva confirmed that the equipment has been removed from the source location. Geneva would like
to keep the permit as is for potential future use of the site; thus, there are no changes to equipment or
emissions.

SECTION I: GENERAL PROVISIONS
I.1 All definitions, terms, abbreviations, and references used in this AO conform to those used in
the UAC R307 and 40 CFR. Unless noted otherwise, references cited in these AO conditions
refer to those rules. [R307-101]
I.2 The limits set forth in this AO shall not be exceeded without prior approval. [R307-401]
I.3 Modifications to the equipment or processes approved by this AO that could affect the
emissions covered by this AO must be reviewed and approved. [R307-401-1]

I.4 All records referenced in this AO or in other applicable rules, which are required to be kept by
the owner/operator, shall be made available to the Director or Director's representative upon
request, and the records shall include the two-year period prior to the date of the request.
Unless otherwise specified in this AO or in other applicable state and federal rules, records
shall be kept for a minimum of two years. [R307-401-8]
I.5 At all times, including periods of startup, shutdown, and malfunction, owners and operators
shall, to the extent practicable, maintain and operate any equipment approved under this AO,
including associated air pollution control equipment, in a manner consistent with good air
pollution control practice for minimizing emissions. Determination of whether acceptable
operating and maintenance procedures are being used will be based on information available to
the Director which may include, but is not limited to, monitoring results, opacity observations,
review of operating and maintenance procedures, and inspection of the source. All maintenance
performed on equipment authorized by this AO shall be recorded. [R307-401-4]

II.B REQUIREMENTS AND LIMITATIONS
II.B.1 The Cove Pit shall be subject to the following:
II.B.1.a The owner/operator shall use a conveyor to transport aggregate from the crushing plant to the
wash plant. The owner/operator shall not use a loader to load aggregate material into the wash
plant. [R307-401-8]
II.B.1.b Unless otherwise specified in this AO, the owner/operator shall not allow visible emissions from
any source on site to exceed 20 percent opacity. [R307-401-8]
II.B.1.b.1 Unless otherwise specified in this AO, opacity observations of emissions from stationary sources
shall be conducted according to 40 CFR 60, Appendix A, Method 9. [R307-309-5]
II.B.2 Operational Limits
II.B.2.a The owner/operator shall not operate the Cove Pit before 6:00 a.m. or after 8:00 p.m. each day.

II.B.2.b The owner/operator shall not operate (which includes mining, crushing, screening, and load-out)
the lower pit during the months of December through February. [R307-401-8, R307-410-4]
II.B.2.c The owner/operator shall only conduct crushing and screening activities in the lower pit. The
owner/operator shall not conduct crushing and screening activities before 7:00 a.m. or after 5:00
p.m. each day. [R307-401-8, R307-410-4]
II.B.2.d The owner/operator shall not operate the Upper Pit and the Lower Pit at the same time. The
owner/operator shall not change operations from one pit to the other pit more than one time per
day. [R307-401-8, R307-410-4]
II.B.2.e The owner/operator shall:
A. Determine hours of operation by maintaining an operation log.
B. Record hours of operation each day.
C. Keep hours of operation records for all periods the plant is in operation.

II.B.2.e.1 The operational records shall include the following:
A. The time operations begin and end at the Cove Pit each day.
B. The date and time aggregate processing (crushing and screening) begins and ends.
C. The time operations begin and end in the Upper Pit.
D. The time operations begin and end in the Lower Pit.

II.B.3 Production Limits
II.B.3.a The owner/operator shall not produce more than 500,000 tons of aggregate material, including
bank-run material, for the entire site per rolling 12-month period and shall not ship more than
7,350 tons of aggregate material, including bank-run material, off site per day. [R307-401-8]
II.B.3.b The owner/operator shall not produce more than 304,469 tons of aggregate material in the
crushing plant per rolling 12-month period. [R307-401-8]
II.B.3.c The owner/operator shall not produce more than 55,866 tons of aggregate material in the
screening plant per rolling 12-month period. [R307-401-8]
II.B.3.d The owner/operator shall not produce more than 3,500 tons of aggregate material in the crushing
and screening plants combined per day, with no more than 1,750 tons of aggregate material
produced in the screening plant per day. [R307-401-8]
II.B.3.e The owner/operator shall not produce more than 83,799 tons of bank-run material in the upper pit
per rolling 12-month period and shall not produce more than 2,100 tons of bank-run material in
the upper pit per day. [R307-401-8]
II.B.3.f The owner/operator shall only produce bank-run material in the upper pit. All bank-run material
produced in the upper pit shall be shipped offsite with no further processing. [R307-401-8]
II.B.3.g The owner/operator shall:
A. Determine production with belt scale records and/or scale house records.
B. Record production on a daily basis.
C. Use the production data to calculate a new rolling 12-month total by the 20th day of
each month using data from the previous 12 months.
D. Keep the production records for all periods the plant is in operation.

II.B.3.g.1 The records of production shall include the following:
A. The production for the crushing plant (daily & rolling 12-month total).
B. The production for the screening plant (daily & rolling 12-month total).
C. The bank-run produced in the upper pit (daily & rolling 12-month total).
D. The bank-run produced in the lower pit (daily & rolling 12-month total).
E. The total production for the site (daily & rolling 12-month total).

II.B.4 All Stationary Engines on site shall be subject to the following:
II.B.4.a The owner/operator shall not operate all stationary diesel engines on site for more than 2,466,200
horsepower-hours (hp-hrs) combined per rolling 12-month period. [R307-401-8]

II.B.4.a.1 The owner/operator shall:
A. Determine the total hp-hrs for the facility by multiplying the horsepower of the engine
and the hours operated for that engine for each day and add the total hp-hrs of all the
engines together.
B. Determine hours of operation by supervisor monitoring and maintaining of an
operations log for each engine.
C. Record hours of operations each day.
D. Calculate a new rolling 12-month total for each day of the previous month by the 20th
day of each month using data from the previous 12 months.

II.B.4.a.2 The record of hp-hrs shall include the following:
A. The horsepower of each engine.
B. The hours operated of each engine.
C. The hp-hrs for each engine.
D. The total hp-hrs for all engines at the facility.

II.B.4.b The owner/operator shall not allow visible emissions from any stationary diesel engine on site to
exceed 20 percent opacity. [R307-201-3]
II.B.4.c The owner/operator shall only combust diesel fuel that meets the definition of ultra-low sulfur
diesel (ULSD), which has a sulfur content of 15 ppm or less.

II.B.4.c.1 To demonstrate compliance with the ULSD fuel requirement, the owner/operator shall maintain
records of diesel fuel purchase invoices or obtain certification of sulfur content from the diesel
fuel supplier. The diesel fuel purchase invoices shall indicate that the diesel fuel meets the ULSD
requirements. [R307-401-8]
II.B.5 All Haul Roads and Operational Areas on site shall be subject to the following:
II.B.5.a The owner/operator shall cover all haul roads and operational areas with road-base material and
shall use chemical suppressants supplemented with water application to maintain opacity limits
listed in this AO. The owner/operator may stop applying chemical suppressants and water to the
haul roads and operational areas when the temperature is below freezing. [R307-401-8]

II.B.5.a.1 The owner/operator shall keep records of water application for all periods when the plant is in
operation. The records shall include the following items:
A. Date and time treatments were made.
B. Amount of chemical suppressant used and dilution ratio.
C. Quantity of water applied.
D. Rainfall amount received, if any.
E. Records of temperature, if the temperature is below freezing.

II.B.6 The Bulldozing Operations on site shall be subject to the following:
II.B.6.a The owner/operator shall not operate bulldozers on site for more than 2,500 hours combined per
rolling 12-month period and not for more than 20 hours combined per day. [R307-401-8]
II.B.6.a.1 The owner/operator shall:
A. Determine hours of operation by supervisor monitoring and maintaining an operations
log.
B. Record hours of operation each day.
C. Use the hours of operation to calculate a new rolling 12-month total by the 20th day of
each month using data from the previous 12 months.

II.B.6.a.2 The records of operation shall include the following:
A. The hours of operation for each bulldozer each day.
B. The total hours of operation for all bulldozers each day.
C. The rolling 12-month total hours of operation for all bulldozers.

II.B.7 All Fugitive Dust Sources on site shall be subject to the following:
II.B.7.a The owner/operator shall not allow visible emissions from haul roads and any fugitive dust
emission source on site to exceed 20 percent opacity on the site and 10 percent opacity at the
property boundary. [R307-309-5]
II.B.7.a.1 Visible emission determinations for fugitive dust emissions from haul-road traffic and mobile
equipment in operational areas shall be conducted using Method 9. The normal requirement for
observations to be made at 15-second intervals over a six-minute period, however, shall not
apply. Visible emissions shall be measured at the densest point of the plume but at a point not
less than 1/2 vehicle length behind the vehicle and not less than 1/2 the height of the vehicle.

II.B.7.b The owner/operator shall apply water to all storage piles and exposed areas on site to maintain
the opacity limits listed in this AO. The owner/operator may stop applying water to the storage
piles and exposed areas when the temperature is below freezing. [R307-401-8]

II.B.7.b.1 Records of water application shall be kept for all periods when the plant is in operation. The
records shall include the following items:
A. Date and time treatments were made.
B. Quantity of water applied.
C. Rainfall amount received, if any.
D. Records of temperature, if the temperature is below freezing.

II.B.7.c The owner/operator shall comply with all applicable requirements of R307-309 for Fugitive
Emission and Fugitive Dust sources on site. [R307-309]
II.B.8 All Aggregate Processing Equipment on site shall be subject to the following:
II.B.8.a The owner/operator shall not allow visible emissions from any crusher on site to exceed 12
percent opacity. [R307-312-4]
II.B.8.b The owner/operator shall not allow visible emissions from any screen on site to exceed 7 percent
opacity. [R307-312-4]
II.B.8.c The owner/operator shall not allow visible emissions from any conveyor transfer point on site to
exceed 7 percent opacity. [R307-312-4]
II.B.8.d The owner/operator shall not allow visible emissions from any conveyor drop point on site to
exceed 20 percent opacity. [R307-401-8]
II.B.8.e The owner/operator shall not allow any visible emissions from the wash plant on site.

II.B.8.f The owner/operator shall install water sprays on all crushers, all screens, and all unenclosed
conveyor transfer points on site to control fugitive emissions. The owner/operator shall operate
sprays as required when the temperature is above freezing to maintain the opacity limits listed in
this AO. [R307-401-8]
II.B.8.g Within 60 days after achieving the maximum production rate but not later than 180 days after
initial startup, the owner/operator shall conduct an initial performance test for all crushers,
screens, and conveyor transfer points on site manufactured after August 31, 1983. Performance
tests shall meet the limitations specified in Table 3 to Subpart OOO. Records of initial
performance tests shall be kept and maintained on site for the life of the equipment.

II.B.8.g.1 Initial performance tests for fugitive emissions limits shall be conducted according to 40 CFR
60.675(c). The owner or operator may use methods and procedures specified in 40 CFR
60.675(e) as alternatives to the reference methods and procedures specified in 40 CFR 60.675(c).

II.B.8.g.2 The owner/operator shall submit written reports to the Director of the results of all performance
tests conducted to demonstrate compliance with the standards set forth in 40 CFR 60.672.

concerns with the review of the draft permit conditions. Upon resolution of your concerns, please email
Katie Andersen at kandersen@utah.gov the signed cover letter. Upon receipt of the signed cover letter,
the DAQ will prepare an Approval Order (AO) for signature by the DAQ Director.
If Geneva Rock Products, Inc. does not respond to this letter within 10 business days, the project will
move forward without source concurrence. If Geneva Rock Products, Inc. has concerns that cannot be
resolved and the project becomes stagnant, the DAQ Director may issue an Order prohibiting
construction.

1. Comment regarding Applicability of R307-312:
R307-312 applies to all crushers, screens, and conveyors located within a PM2.5 nonattainment and
maintenance area. Because this source is located in Cache Valley, Utah, which is a maintenance area
for PM2.5, the source is subject to R307-312. [Last updated May 30, 2024]
2. Comment regarding NSPS IIII & MACT ZZZZ Applicability:
40 CFR 60 NSPS Subpart IIII applies to owners and operators of stationary CI ICE that commence
construction after July 11, 2005 where the stationary CI ICE are manufactured after April 1, 2006
[40 CFR 60.4200(a)(2)(i)]. Beginning October 1, 2010, owners and operators of stationary CI ICE
subject to this subpart with a displacement of less than 30 liters per cylinder that use diesel fuel must
use diesel fuel that meets the requirements of 40 CFR 80.510(b) for nonroad diesel fuel [40 CFR
60.4207(b)]. 40 CFR 80.510(b) has the requirement to use 15 ppm sulfur content fuel.
If 40 CFR 60 NSPS Subpart IIII does not apply, 40 CFR 63 MACT Subpart ZZZZ would still apply.
40 CFR 63 MACT Subpart ZZZZ applies to stationary RICEs at a major or area source of HAP
emissions [40 CFR 63.6585]. The fuel requirement in MACT ZZZZ applies to owners and operators
of existing non-emergency, non-black start CI stationary RICE with a site rating of more than 300
brake HP with a displacement of less than 30 liters per cylinder that uses diesel fuel. Owners and
operators must use diesel fuel that meets the requirements in 40 CFR 80.510(b) for nonroad diesel
fuel [40 CFR 63.6604]. For stationary RICE located at an area source of HAP emissions, a
stationary RICE is existing if you commenced construction or reconstruction of the stationary RICE
before June 12, 2006 [40 CFR 63.6590(a)(1)(iii)]. This requirement is the same as NSPS IIII, which
requires the use 15 ppm sulfur content fuel.
If an engine is manufactured prior to 2006 and larger than 300 hp, it would be required to use 15
ppm sulfur content fuel according to MACT ZZZZ. If an engine is manufactured after 2006, it
would be required to use 15 ppm sulfur content fuel according to NSPS IIII. Manufacture dates for
the engines at this site were not included with the NOI, but regardless of the manufacture date, the
475 hp engine would be required to use 15 ppm sulfur content diesel fuel. The 174 hp engine may
or may not be required to use 15 ppm sulfur content diesel fuel, depending on the manufacture date;
however, to satisfy BACT, the 15 ppm sulfur content diesel fuel will be required for the 174 hp

3. Comment regarding Title V Applicability:
Title V of the 1990 Clean Air Act (Title V) applies to the following:
1. Any major source
2. Any source subject to a standard, limitation, or other requirement under Section 111 of the Act,

This source is not a major source nor a Title IV source; however, the facility is subject to 40 CFR 60
NSPS Subpart IIII, and 40 CFR 63 MACT Subpart ZZZZ regulations. NSPS Subpart IIII, and
MACT Subpart ZZZZ exempt sources from the obligation to obtain a permit under 40 CFR part 70
(Title V permit) if the source is not otherwise required by law to obtain a permit, therefore, the
source is not a Title V source due to 40 CFR 60 NSPS Subpart IIII and 40 CFR 63 MACT Subpart
ZZZZ. However, the facility is also subject to 40 CFR 60 NSPS Subpart OOO, which does not
exempt sources from the obligation to obtain a permit under 40 CFR part 70 (Title V permit).

I also noticed that I sent the wrong version of the Draft ER. Here is the correct version. The main changes are with

Thanks. Yes, it would be great if the source is notified of the equipment issues. I know there isn't much you can do if they
opt to keep an AO with equipment that no longer exists but we can find them out of compliance and cite them if they bring
this equipment back without letting us know.
