Public Notice of Modification of Sludge Disposal and Farm Closure Plan for
Ground Water Discharge
Permits

Purpose of Public Notice
The Utah Division of Water Quality (“Division”DWQ) is soliciting comments on the request to modify the Sludge Disposal and Farm Closure Plan for the above-mentioned ground water discharge
permits. The ground water discharge permits affected by this modification were issued by the Director of the Division of Water Quality under authority of the Utah Water Quality Act,
Section 19-5-106(g) Utah Code Annotated. 1953, as amended and Utah Administrative Code R317-6. Under Section 19-1-301.5, effective May 8, 2012, a person who wishes to challenge a Permit
Order may only raise an issue or argument during an adjudicatory proceeding that was raised during the public comment period and was supported with sufficient information or documentation
to enable the Director to fully consider the substance and significance of the issue. Utah Code Annotated. 19-1-301.5 can be viewed at the following internet URL:

On January 16, 2025, a Change of Ownership Notificationce Letter was submitted to the DivisionDWQ which detailed the sale of the agricultural properties previously owned and operated
by Murphy-Brown, LLC (sometimes referred to as “Smithfield” and/or “Smithfield Hog Production”) to MANGOango II-Milford, LLC. The change of ownership included the transfer of five ground
water discharge permits (Permit No. UGW010002, UGW010008, UGW210005, UGW010012, and UGW010016, and UGW210005) from Smithfield Hog Production to MANGOango II-Milford, LLC. The DivisionDWQ
issued minor permit modifications to reflect the change of ownership for each of the permitted facilities. As part of the
change of ownership process, MANGOango II-Milford, LLC requested modifications to the Sludge Disposal and Farm Closure Plan, as they intend to close farm sites that have been depopulated
and are now dormant.
The Sludge Disposal and Farm Closure Plan is being modified to allow the continued operation of swine production facilities now owned by MANGOango II-Milford, LLC. The modifications
to the Sludge Disposal and Farm Closure Plan will apply to all of the properties covered under the previously mentioned ground water discharge permits. Additional modifications to the
individual permits will not beare not currently required at this time.
The permitted facilities are located in Beaver, Iron, and Millard Counties. Manure from the hog production facilities is washed into anaerobic basins and digesters for treatment and
storage. The permitted facilities at each farm site consists of one primary lagoon or digester and one secondary containment basin for evaporation. In addition to well monitoring, the
basins are lined with a flexible membrane liner for theto protect protection of ground water. The ground water quality beneath farm sites ranges from Class 1A Drinking Water Quality
to Class III Limited Use Water Quality.
The modifications to the Sludge Disposal and Farm Closure Plan will allow for the long-term in-situ management of dried sludge material, the surface application of wastewater and sludge
according to an approved Nutrient Management Plan, and the drying and harvesting of sludge material according to the Manure Drying Plan. The modifications also outline the requirements
for removing individual farm sites to be removed from the respective ground water discharge permits following depopulation.

or via email at wqcomments@utah.gov. All comments received prior to close of business May 16, 2025, will be considered in the formulation of final determinations to be imposed onconcerning
the Sludge Disposal and Farm Closure Plan. A public hearing may be held if written requests are received within the first 15 days of this public comment period that demonstrate significant
public interest and substantive issues exist to warrant holding a hearing.
