Dear Wendle James Roberts:
The Division of Drinking Water (the Division) received the updated Drinking Water Source Protection (DWSP) plan for the Lime Kiln Spring and the 1992 Well Repl-1 from you on October
16, 2023. Additional information on the 1992 Well Repl-1 update was requested by Division staff via email on April 10, 2025. No reply was received.
We have completed our review of the updated DWSP plan for the 1992 Well Repl-1 (WS004); however, before we can concur with the updated plan, the requirements listed below must be addressed
and the plan resubmitted for review.
We have also completed our review of the updated DWSP plan for the Lime Kiln Spring (WS001) and find that the plan basically complies with the applicable portions of Utah’s Administrative
Rules for Public Drinking Water Systems. The Division concurs with the updated plan for the Lime Kiln Spring (WS001). We commend you for establishing a program to protect this source
from present and future contamination. This plan must be updated often enough to ensure that it reflects current conditions in your protection zones.
The due date for submitting the next updated plan for your spring is December 31, 2029.
Requirements
Although your updated plan for the 1992 Well Repl-1 (WS004) stated that management strategies were implemented in the last update cycle, implementation documentation was not provided.
Rule R390-600-7(2)(e) states that updated plans must document the implementation of land management strategies in the recordkeeping section. Actual copies of public education programs,
bill stuffers, newsletters, training session agendas, minutes of meetings, memoranda for file, etc. must be submitted with the recordkeeping section of updated plans. Please provide
a copy of the public education material that was distributed and the approximate implementation date. As stated in R309-600 and 605: Implementing DWSP Plans - Each Public Water System
(PWS) shall begin implementing each of its DWSP Plans in accordance with the implementation schedule within 180 days after submittal, if the plan is not disapproved, which should include
documentation of how the land management strategies identified for existing and future potential contamination sources were implemented. You did not provide adequate documentation that
you implemented your plan according to this requirement. Please implement the land management strategies outlined in prior plan submittals and provide documentation to source protection
staff within 90 days of the date of this letter.
A dormant deficiency (SP03 DWSP PLAN NOT IMPLEMENTED ACCORDING TO MANAGEMENT STRATEGIES IN DWSP) has been added to the Division’s database to serve as a tracking tool and reminder. Failure
to correct this deficiency by the required due date (90 days from the date of this letter) will result in 25 Improvement Priority System (IPS) points being assigned as well as a treatment
technique violation as stated in R309-215-16(4)(a). If you have any questions about these points, please contact Jennifer Yee at (385) 515-1501 or ddwips@utah.gov.If you cannot address
the deficiencies within 90 days, please request a Corrective Action Plan (CAP) at requestcap.utah.gov. You must request the CAP before the deficiencies have been assessed. If you have
any questions about requesting a CAP, please contact Brandi Smith at brandismith@utah.gov.Monitoring Reduction WaiverYour Lime Kiln Spring (WS001) source was previously granted a pesticide
use waiver. Waivers need to be renewed with every update cycle to prevent waivers from expiring. No use waiver was provided with your updated plan. If you want your monitoring schedule
