RE: Revocation of Approval Order DAQE-AN0141410002-10 dated July 15, 2010
Project Number: N141410004
The Division of Air Quality (DAQ) initiated a 10-Year Review for Approval Order (AO)
DAQE-AN0141410002-10 for the Harper Contracting, Inc. Pelican Point Concrete Batch Plant. During
the review, it was determined no equipment is currently operating at the site. The DAQ received a request
to revoke DAQE-AN0141410002-10 on January 29, 2025. All permitted equipment at the site has been
removed. There are no concrete production operations taking place at this site. Therefore, the
DAQ has revoked the AO referenced above as of the date of this letter.
As authorized by the Utah Legislature, the fee for revoking an AO is the actual time spent by the review
engineer and all other staff on the project. Payment should be made to the DAQ upon receipt of the
invoice.

entrance. At 0.2 miles there is currently an American Eagle Ready mix
that has taken over the location. There is no facility or evidence of a past
facility at two miles. The Harper facility was at 0.2 miles.

Status: Not evaluated. No Harper equipment on site. Location sold in 2010. However, similar
equipment was onsite operated by American Eagle Ready Mix under Small source exemption
DAQE-EN15937002-16. They reported that an electrical line was placed and that line power will
soon replace the generator they were using.

RECOMMENDATION FOR
NSR PERMITTING REVIEW: Delete/Cancel AO; Harper unclear/mixed on intention, see attached
emails, but given use and site status no reason to keep AO.

Thanks for your time and information about the former site of a Harper Concrete Batch Plant a quarter of a mile off State Highway
68, Saratoga Springs.
American Eagle Ready Mix is operating at the site, and Ames Construction is operating an adjacent aggregate pit.
Please let me know if it is determined the Approval Order (AO) will be cancelled, or what its status of the AO will be.

The owner of the company wants to think about this for a day or so. He says he still has a vested interest in that property.
I'll email you back on Monday to let you know what we are doing. Right now I am pretty sure we will close out the permit but want to wait
for his blessing.

Any word on a decision about the old Pelican point Approval Order (AO)?
If the current operator has the same size equipment (including generator), they may be able to operate under the AO. If Harper still has
interest in the site, one may want them to change the AO to their name?
Note, I understand that starting next year all AO's will have an annual fee.
Please advise on Harper's direction.

My apologies Greg. I've been out in the field talking with all the crews (in small groups) about precautions to help with the vivid-19
pandemic.
Rulon was saying he wanted to hold off closing that permit because he still had a vested interest in Pelican Point.
Now in reality I think we'll go ahead and close that OA. If he decides he wants to start up a batch plant out there we will just start the
process from square one.

Good Afternoon,
I'm with the Utah Division of Air Quality. I was asked to do a review of existing permits to make sure they're up to date, and I was assigned to the above referenced
site. This site was issued a permit in 2010 (DAQE-AN0141410002-10) and during review I found the attached compliance inspection from 2020. From this
inspection it seems that Harper no longer operates at this site and wanted to revoke the AO for the facility. Can you take a look into this and confirm whether the
permit should be revoked or not? Thank you for any help you can provide,

I thought that we had closed that permit back in June of 2020.
I have went online and filled out the form to delete the permit.
