Dear Mr. Anderson:

The Division of Environmental Response and Remediation (DERR) requested that you
submit a Subsurface Investigation Report (SIR). The WP&B was due on February 29, 2024. To
date, the WP&B has not been received and is past due.

Please submit a WP&B to the DERR by April 5, 2024. Failure to comply with this notice
may result in issuance of a Notice of Non-Compliance or Order. The DERR has the authority to
seek civil penalties of up to $10,000 for each day of violation pursuant to Utah UST Act, Section
19-6-425.

In addition, a Petroleum Storage Tank Fund (PST Fund) Eligibility Application has not been
received. The DERR may not authorize payments from the PST Fund if a claim is not filed within
one year after the PST Fund covered underground storage tank is closed as specified in Utah Code
Ann. §19-6-424(1).
