R307-401-9-3 stipulates that small source May submit written registration notice to the director. It is an option not a requirement. In my first conversation with Mr. Humphries he also indicated it was not a requirement. Furthermore, the previous owners of Energy Recycling Technologies elected to register as a small source and qualified, even though their calculations were based on a 21 hour cycle time and running 417 ten ton cycles per year. We are using the exact same equipment and the exact same process except that we are going to use propane instead of natural gas. Also, we are going to be running on a 24 hour cycle and a maximum of 260 less than ten ton cycles per year. So obviously if they qualified then we easily are exempt. (3) A waste tire recycler shall: (a) demonstrate financial responsibility for bodily injury and property damage, including bodily injury and property damage to third parties caused by sudden or nonsudden accidental occurrences arising from storing and recycling waste tires. The waste tire recycler shall have and maintain liability coverage for sudden or nonsudden accidental occurrences in the amount of $300,000; and (b) for the initial application for a recycler registration or for any subsequent application for registration at a site not previously registered, demonstrate to the director that the local requirements for a waste tire recycler have been met, including getting any necessary permits or approvals where required. You will also need to contact the Utah Department of Air Quality to obtain a permit, as this process involves pyrolysis recycling.
