HomeMy WebLinkAboutDWQ-2025-003404April 10, 2025 VIA EMAIL (Read Receipt Requested) Greg Evans, City Council Member Eureka City PO Box 156 Eureka, Utah 84628 greg@eurekautah.org Subject: Request for Ground Water Discharge Permit Application Eureka City Wastewater Treatment Facility Dear Mr. Evans: The Division of Water Quality (“Division”) received Eureka City’s (Eureka) request to close the current Utah Pollutant Discharge Elimination System (UPDES) Permit No. UT0024601 on April 4, 2025. The previous UPDES Permit for the Eureka City Wastewater Treatment Facility (“Facility”) contained reuse provisions, allowing discharge of treated effluent from Outfall 001D to a wildlife habitat area west of the lagoons during the spring, summer, and fall. The Division has determined that these reuse provisions are not appropriate for a UPDES Permit because the discharge does not constitute a direct discharge to surface waters of the State. Division staff met with Eureka representatives at the facility on March 24, 2025. Based on that meeting, and requests by Eureka, the Division understands that Eureka would like to discontinue use of Outfall 001 and continue use of Outfall 001D, which likely represents a potential discharge to ground waters of the state from the Facility. Utah Admin. Code R317-6-6(6.1) requires a person who may construct, install, or operate a new facility; or modify an existing facility which may discharge pollutants that may move directly or indirectly into ground water to be covered under a ground water discharge permit, if they are not permitted by rule (“PBR”) under Utah Admin. Code R317-6-6(6.2). The Division will review the ground water discharge permit application to determine whether the Facility should be permitted under a ground water discharge permit or qualifies for PBR. Attached you will find a copy of a guidance document titled “Ground Water Quality Protection Permitting Information Document” (Attachment 1).  The Ground Water Discharge Application form can be found in Appendix A. Please submit a ground water discharge permit application to the Division through the Division’s electronic submission portal in the next 180 days for evaluation by staff. UPDES Individual Permit coverage will extend until Eureka obtains a ground water discharge permit or PBR determination; at that time, Permit No. UT0024601 will be void.
