PUBLIC NOTICE TO ISSUE A SECTION 401 WATER QUATLITY CERTIFICATION
PURPOSE OF PUBLIC NOTICE
The purpose of this public notice is to declare the State of Utah's intention to issue a Section 401Water Quality Certification with Conditions under the authority of the Federal Clean
Water Act (33U.S.C. § 1341), and consistent with the Utah Water Quality Act, Title 19, Chapter 5, Utah Code and Utah Administrative Code R317-15.

BACKGROUND
The United States Army Corps of Engineers (USACE), Sacramento District (the Project Proponent) is proposing to modify and re-issue the Regional General Permit (RGP) 16 for aquatic habitat
restoration and enhancement activities subject to Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act within the boarders of the Sacramento District.The proposed
RGP 16 (the Project) would authorize permanent or temporary discharge of dredged and /or fill material into waters of the U.S, including wetlands, for construction and maintenance activities
associated with aquatic habitat restoration and enhancement activities. The typical activities authorized under the RGP 16 include bur are not limited to, fish passage and screening
improvements, bioengineered bank stabilization, engineering/designing with nature; nature-based solutions, water conservation aquatic habitat restoration and enhancement of tidal and
non-tidal streams, wetlands and other waters, and removal of pilings, small dams, tide gates, flood gates and other in-water structures. Compensatory mitigation is not required for activities
authorized under this RGP. Activities must be restoration or enhancement in nature, resulting in no net loss of aquatic resource functions and services. The conversion of waters from
one type to another is authorized as long as there is an overall no net loss of aquatic resource functions and services. The USACE proposes to authorize the RGP 16 with terms and conditions
to minimize impacts and ensure that activities will result in no net loss of aquatic resource functions and services. Any permittee authorized by RGP 16 must comply with the general
terms and conditions listed within the following Blanket RGP 16 401 Water Quality Certification when conducting activities within the State of Utah.
