HomeMy WebLinkAboutDSHW-2025-001573March XX, 2025 Don Perry White Hills Class I Landfill PO Box 625 Moroni, UT 84646 RE:Compliance Advisory No.2501003 for the White Hills Class I LandfillSW249 Dear Mr. Perry, On January 22, 2025, representatives of the Division of Waste Management and Radiation Control (the Division) conducted an inspection at the White Hills Class I Landfill. The scope of the inspection was to determinecompliance with theUtah Administrative Code R315 (the Rules),and the Utah Solid and Hazardous Waste Act (the Act). Based on observations and information obtained during the inspection, the Director of the Division (Director) is issuing this Compliance Advisory to provide the Respondent with notice of the followingcompliance issues as well as an opportunity to correct these apparent compliance issues: Utah Administrative Code R315-303-4(4)(g)states that “If an area of the working face of a landfill that accepts municipal waste will not receive waste for a period longer than 30 days, the owner or operator shall cover the area with a minimum of 12 inches of soil…” Intermediate cover is lacking around the landfill, especially in the area adjacent to the working face. Past working areasare becoming exposed, and litter is being carried by wind into the south fence-line. A large pile of uncovered municipal waste isexposed on the southeast corner of the property. Covering this unaddressed pile, and refreshing the cover in any previous working areas will drastically reduce the amount of wind-blown litter onsite. Please respond with a plan to improve the landfill’s intermediate cover before the Division’s next inspection.Utah Administrative Code R315-303-5(8) requires “…fencing at the property or unit boundary or the use of other artificial or natural barriers to impede entry by the public and large animals. A lockable gate shall be required at the entry to the facility…” An approximately 40-foot section of fencing east of the front gate was noted to be missing, which could allow for the unauthorized access of vehicles or animals. The fence appeared to be complete around the rest of the property and was in good condition. Please provide a plan for constructing the missing section of fence in this area.Utah Administrative Code R315-262-11states that “A person who generates a solid waste, as defined in Section R315-261-2, shall make an accurate determination as to whether that waste is a hazardous waste to ensure wastes are properly managed according to applicable rules…”. Several unlabeled barrels of liquid were seen stored on a pallet. One of these had large punctures in the side and had leaked onto the ground. The operator onsite was unsure of their contents and mentioned that the barrels had always been there. Please identify the contents in these barrels within 30 daysin order toensure proper cleanup, transport, and disposal of the waste. R315-262-11 contains a list of steps to determine whether a solid waste is hazardous. Pursuant to this Compliance Advisory, the Director is providing the Respondent an opportunity to correct the apparent compliance issues. The Director will also consider any evidence and additional information provided by the Respondent. Please submit the following requested documentation regarding each compliance issue and associated corrective actions to the Director: the cause of each compliance issue; the specific corrective actions taken, results achieved, and applicable dates; if future corrective actions are proposed, the specific corrective actions and proposed completion dates, including intermediate milestones, as applicable; and how the corrective actions will prevent similar compliance issues from recurring. If the Respondent demonstrates that it has taken appropriate corrective actionsregarding the matters addressed in this Compliance Advisory, the Director will issue a closeout letter and will consider this matter to be closed.However, if the Respondent fails to demonstrate appropriate corrective actions before the Division’s next inspection, the Director will consider taking escalated enforcement actions, including seeking financial penalties. In all events, the matters addressed in this Compliance Advisory, including the Respondent’s corrective actions, will become part of the Respondent’s compliance record and may be considered in connection with future enforcement matters.
