You mentioned that White Peaks Ranch is the only PCS, with the hazard being animal waste from elk. You also stated that this PCS is uncontrolled due to the unknown number of elk and the uncertain use of best management practices. The plan states that this PCS is located within zones 2, 3, and 4. However, since it appears the proposed well site is within the fenced elk enclosure, I am concerned that elk will also be able to enter protection zone 1. According to R309-600-13(2)(b)(ii), a new groundwater source for drinking water cannot be located where an uncontrolled PCS exists within zone 1. Since it seems there is no control to prevent elk from entering zone 1, I cannot concur with the current assessment. Please provide additional information addressing this issue. Thank you. Following up with your concerns regarding elk waste, Bear River Water Conservancy District (BRWCD) will place a wildlife fence that will completely enclose the 100-foot radius around the well. This fence will inhibit wildlife and/or livestock access into Zone 1. Additionally, the fence will be inspected and maintained by BRWCD personnel. Best, Ted V.
