Subject:Disapproval, Updated Drinking Water Source Protection Plan for the Storm Haven Well 2; Storm Haven Residents; Water System #26023, Source No. WS002
Dear Shelly Bunker:
The Division of Drinking Water (the Division) received the updated Drinking Water Source Protection (DWSP) plan for the Storm Haven Well 2 from your consultant, G Ryan Taylor, and T-O
Engineers on June 14, 2023.
We have completed our review of the updated DWSP plan; however, before we can concur with the updated plan, the requirements listed below must be addressed and the plan resubmitted for
review.
Requirements
1- It is unclear if this updated DWSP plan is for Storm Have Well 2 or if it also includes Storm Haven Well 1. Please confirm if this report also covers the update for Storm Haven Well
1. If so, please separate the Potential Contamination Source (PCS) for each source.
2- The Potential Contamination Source (PCS) inventory includes new (?) additions. These need to be plotted on a map with the source protection zones. Are these really new PCS or does
this include the PCS from Storm Haven Well 1. The major indicator that this may be the PCS from Storm Haven Well 1 is the addition of a sewer line in zone 1. If the map is correctly
located for Storm Haven Well 2, there are no residents in zone 1, but the map for Storm Haven Well 1 does show a resident.
3- The management strategies need to be implemented for all not adequately controlled PCS. Here is a screen shot from the updated DWSP plan.These strategies are a bit complicated. What
is needed at a minimum, is public education for residential homes for sewer lines, septic, and pesticides, herbicides, fertilizers, etc. You can send the fact sheets found in the DWSP
plan. You can find the groundwater user's guide that has all the Division of Drinking Water (DDW) prepared fact sheets in the appendix on the DDW website.https://deq.utah.gov/drinking-water/preparing-source-protection-plansThis
could be accomplished by adding the fact sheets to your website and instructing residents to view them with a bill stuffer. Or you can send the fact sheets out to each homeowner in the
source protection zones. How the fact sheets are distributed is needed including the letter or bill stuffer language, and a date that information went out.4- Septic in Zone 2. The presence
of septic in zone 2 of an unprotected aquifer requires an exception to rule be requested. You can find the Temporary Exception to Rule - Approval Form on the DDW website. Here is a link:https://deq.utah.gov/drinking-water/exceptions-to-rule-requirements5-
A Note. The delineation section added as appendix C is not the currently concurred with delineation. Please make sure to use the delineation from the final DWSP plan submitted to DDW
on 8/23/2019.As stated in R309-600 and 605: Implementing DWSP Plans - Each Public Water System (PWS) shall begin implementing each of its DWSP Plans in accordance with the implementation
schedule within 180 days after submittal, if the plan is not disapproved, which should include documentation of how the land management strategies identified for existing and future
potential contamination sources were implemented. You did not provide adequate documentation that you implemented your plan according to this requirement. Please implement the land management
strategies outlined in prior plan submittals and provide documentation to source protection staff within 90 days of the date of this letter.
A dormant deficiency (SP03 DWSP PLAN NOT IMPLEMENTED ACCORDING TO MANAGEMENT STRATEGIES IN DWSP) has been added to the Division’s database to serve as a tracking tool and reminder. Failure
to correct this deficiency by the required due date (90 days from the date of this letter) will result in 25 Improvement Priority System (IPS) points being assigned as well as a treatment
technique violation as stated in R309-215-16(4)(a). If you have any questions about these points please contact Jennifer Yee at (385) 515-1501 or ddwips@utah.gov.If you cannot address
the deficiency within 90 days, please request a Corrective Action Plan (CAP) at requestcap.utah.gov. You must request the CAP before the deficiency has been assessed. If you have any
