Subject:Disapproval, Updated Drinking Water Source Protection Plan for the Marble Hills Well; Marble Hills Subdivision Water System; Water System #02058, Source No. WS001
Dear Scott Waldron:
The Division of Drinking Water (the Division) received the updated Drinking Water Source Protection (DWSP) plan for the Marble Hills Well from you on July 12, 2023.
We have completed our review of the updated DWSP plan; however before we can concur with the updated plan, the requirements listed below must be addressed and the plan resubmitted for
review.
RequirementsImplementation of land management strategiesThe following is a screenshot from a previous updated DWSP plan that outlines the strategies that need to be completed. Please
complete the management strategies for the uncontrolled PCS, including Faust Valley Road and residences within the source protection zones and submit records that it was completed. For
residential fact sheets, I often see the fact sheets uploaded to a website then a bill stuffer with a few lines pointing people to the website. You can find the Division of Drinking
Water (DDW) created fact sheets in the Ground-Water User’s guide on the DDW website.https://deq.utah.gov/drinking-water/preparing-source-protection-plansAs stated in R309-600 and 605:
Implementing DWSP Plans - Each Public Water System (PWS) shall begin implementing each of its DWSP Plans in accordance with the implementation schedule within 180 days after submittal,
if the plan is not disapproved, which should include documentation of how the land management strategies identified for existing and future potential contamination sources were implemented.
You did not provide adequate documentation that you implemented your plan according to this requirement. Please implement the land management strategies outlined in prior plan submittals
and provide documentation to source protection staff within 90 days of the date of this letter.
A dormant deficiency (SP03 DWSP PLAN NOT IMPLEMENTED ACCORDING TO MANAGEMENT STRATEGIES IN DWSP) has been added to the Division’s database to serve as a tracking tool and reminder. Failure
to correct this deficiency by the required due date (90 days from the date of this letter) will result in 25 Improvement Priority System (IPS) points being assigned as well as a treatment
technique violation as stated in R309-215-16(4)(a). If you have any questions about these points please contact Jennifer Yee at (385) 515-1501 or ddwips@utah.gov.If you cannot address
the deficiency within 90 days, please request a Corrective Action Plan (CAP) at requestcap.utah.gov. You must request the CAP before the deficiency has been assessed. If you have any
questions about requesting a CAP, please contact Brandi Smith at brandismith@utah.gov.Please contact Melissa Noble, P.G., at (385) 271-7043 or at mnoble@utah.gov if you have questions
or concerns about the review of your DWSP plan. To help us serve you more efficiently, please use the water system number (02058) in your correspondence.
