HomeMy WebLinkAboutDWQ-2025-002704April 15, 2025 VIA EMAIL (Read Receipt Requested) Kaitlin Potter Phelps, Landowner 5991 East 2300 North Eden, UT 84310 Subject: Ground Water Discharge Permit by Rule Determination and Issuance of GWPBR-25-004 for the Placement of Soil Cuttings and Water Dear Ms. Phelps: The Division of Water Quality (“Division”) received your request for a ground water discharge permit by rule determination via email on March 3, 2025. The project consists of directional drilling and pot holing for the placement of underground power lines next to existing roads in Eden, Utah. Hydro excavation (“hydro-vac”) trucks will remove the soil cuttings and water encountered during drilling and then take the soil/water mixture and pump it onto the ground at your 11-acre property located at 5991 East 2300 North, Eden, Utah (“Site”). The project will last approximately six to eight months. Ground Water Discharge Permit by Rule (PBR) Determination The Division determined that the proposed project meets the requirements of PBR outlined in Utah Admin. Code R317-6-6. Below are the relevant factors evaluated in determining that the proposed operation qualifies for PBR and that the discharge will have a de minimis actual or potential effect on ground water quality and beneficial uses of ground water resources under Utah Admin. Code R317-6-6(6.2)(A)(25): The Division understands that berms will be constructed to contain the mud and water. Waddles may also be placed to filter any water that may move out of the bermed area. At no time will the water be allowed to leave the property. There are multiple companies performing the drilling and hydro excavating, but all are subcontracted through 1884 Line Co. To eliminate the possibility of contamination, the hydro-vac trucks will be dedicated to this project, and they will not be used for other projects or at other locations. The project is of limited volume and time, greatly reducing the potential impact to groundwater. The groundwater and soil being removed is from the shallowest, unconfined, groundwater resource and is likely representative of groundwater present under your property. Permit by Rule Conditions of Approval The following conditions are required under this PBR: This PBR will only be valid for one year from the date of issuance. If the project extends beyond that date, an extension request will be required. Cease operations and notify the Division immediately if a sheen or odor is detected on any of the mud or water. Berm all areas and limit discharge to ensure no water leaves the site boundaries or enters surface water. Upon completion of the bermed area, please notify Mr. Woodrow Campbell, of this office, so an inspection can be made. The Division should be informed immediately if factors change which were evaluated in determining that the Site qualifies for PBR, such as operational changes or from additional knowledge of site conditions. If future project knowledge or experience indicates that groundwater quality is threatened by this operation, this PBR may no longer be valid, and the Director may require that you apply for a Ground Water Discharge Permit per Utah Admin. Code R317-6-6(6.2)(C). Throughout the duration of the project, the Director may conduct an inspection and request additional information, as necessary.
