I am working on a remedial action plan for a site that has groundwater impacts above the MCL. They have a section in the report that discusses the potential need for construction dewatering. The site is less than an acre and groundwater could be encountered through hotspot removal (stripping the entire site down to native is not anticipated). I've included the text from the RAP that discusses dewatering below. "Based on the planned building design, significant construction dewatering is not anticipated. In limited locations where dewatering is required all dewatering water will be containerized (e.g., using a frac-tank or equivalent) and characterized for management at an off-site disposal facility." I am reaching out regarding what kind of permit, if any, would be required for this (UPDES, Construction, etc.). We have had previous conversations with them about the need to obtain a permit for dewatering, but I wasn't sure if a permit would be needed based on the limited scope and their proposal to manage that water at an off-site disposal facility, rather than discharging it to nearby surface water. Please let me know if you have any thoughts on this. I am also happy to discuss over the phone. My number is 385-391- 8134. Based on what you've indicated, it doesn't sound like a permit would be required since they are planning on total containment. If they change the plan, permit(s) may be required. Deidre is correct that if the dewatering water is containerized and disposed of off site, a discharge permit is not required. If the situation changes and the operator wants to dispose of the water to storm drain or water of the state, either a Construction Dewatering and Hydrostatic Testing Permit (UTG070000) or Treated Groundwater and Surface Water Permit (UTG790000) would be required. Given groundwater contamination history, the water would need to be tested for the conditions of the Treated GW/SW permit to determine which permit is applicable. The permit authorization process takes about 2 weeks following submission of a complete Notice of Intent (NOI). Please feel free to reach out if we can provide additional information.
