Exploration & Production Waste
Regulatory Transition Guidance
This document is intended to provide key information and important timelines for facilities
transitioning to regulations under the Division of Waste Management and Radiation Control
(Division).
Permiing
The standards for Solid Waste Exploration and Production Waste Landfill and Surface Impoundment
Permits became eective October 15, 2024. A Temporary Permit is required to continue operating
during the application process for a Class VII permit.
● Temporary Permit TP
Bonds must be transferred to the Division within 60 days of TP Issued Date.
If reconfiguring the facility before the Class VII permit, submit a
Landfarm transition plan with 90 days of TP Eective Date, or
Surface impoundment closure plan with 90 days of TP Eective Date.
Applications for a Class VII permit must be submied within 180 days of TP Eective Date.

Records & Reporting Requirements
➢ Maintain daily operating records, such as facility monitoring, inspections and maintenance.
➢ Record daily tons or cubic yards of waste received, number of vehicles, and waste types.
➢ Waste volume must be converted to tons for reporting. 53 barrels of produced water = 1 ton.
➢ Quarterly Reports are required and payment of fees per ton.*
➢ Annual reports are required, including annual waste totals, capacity and financial assurance.

Fees
Fees as outlined in 19 6 119 6 are calculated on a per ton basis with the rate being published
annually in the Division’s fee schedule. *Payment is required when submiing Quarterly Reports on
the following schedule.

IMPORTANT NOTE Liner Requirement Changes Beginning 2030
During the 2025 General Legislative Session, S.B. 159 changed the requirements for liners at Solid
Class VII landfills. This change requires an impervious synthetic or clay liner system that has
hydraulic conductivity no greater than 1E-7 centimeters per second. Additionally, the bill requires
waste acceptance in unlined Class VII landfills to conclude by July 1, 2030. The Division will begin
outreach on this new requirement in the coming months.
