SOURCE INSPECTION
EVALUATION: With the exception of sources that only monitor for opacity, quarterly report
memoranda will only address the findings of the quarterly report. Approval
Order and Title V permit conditions addressing continuous emission
monitoring requirements will be addressed in Holcim’s relative accuracy
performance specification test review memorandum.
SOURCE REVIEW EVALUATION:
Second Quarter 2023:
A Notice of Violation was issued to Holcim for failure to submit complete 2Q2023 and 3Q2023 SEDR’s and
for failure to submit deviation reports in accordance with the Title V operating permit Condition I.S.2.c.
Holcim submitted a revised 2Q2023 SEDR in response to that NOV on January 9, 2024.

The following non-compliant items were noted in the review of 2Q2023 data:
UAC R307-170-9(10) requires that: “Each source shall submit a narrative description explaining each event of
monitor unavailability or excess emissions. Each description also shall be accompanied with reason codes and
action codes that will link descriptions to events reported in the monitoring information and excess emission
report.”
Holcim referred to 65 of 70 monitor outages in TC 220 as “Daily Calibration” for instances ranging from
0.983 hours to 24.983 hours. No further narrative or description was offered. These items were discussed in an
email on January 11, 2024, with Mr. Miller as to why all of the daily calibrations weren’t included, just these
longer daily calibrations. Mr. Miller stated that these were the daily calibrations which took longer than normal
due to some issue during the daily calibration that caused them to use up more time. There was no further
information made available on these monitor outages. No corrections or modifications were made to the
2Q2023 SEDR submittal.
Holcim’s first submittal of the 2Q2023 SEDR contained cylinder gas audit information from the 1Q2023
SEDR. I emailed Mr. Badger on September 12, 2023, notifying him of the error. He indicated that he would
look into it and correct the error. I received a revised 2Q2023 SEDR on January 9, 2024, in an email from Mr.
Miller in response to the NOV issued to Holcim. In the revised 2Q2023 SEDR, Holcim has modified the dates
of the cylinder gas audit data in TC 260 of the report but potentially knowingly falsely reported the gas audit
results as they had not changed from the first quarter. This report was also inaccurate and incomplete. This is a
data comparison between TC260 data from 1Q2023 and 2Q2023:

Holcim referred to 47 of 51 outages in TC 220 as “Daily Calibration” for instances ranging from 0.983 hours
to 6.983 hours. No further narrative or description was offered. These items were discussed in an email on
January 11, 2024, with Mr. Miller as to why all of the daily calibrations weren’t included, just these longer
daily calibrations. Mr. Miller stated that these were the daily calibrations which took longer than normal due to
some issue during the daily calibration that caused them to use up more time. There was no further information

*Note that the O2 Cylinder was updated from the bottle used first and second quarter, but the O2 cylinder
value (Ca) stayed the same at exactly 10.97. This shows that Holcim is actively making changes to this
information for the 3Q2023 SEDR, but still not reporting the actual CEM values or the cylinder gas
concentration value for the third quarter CGA’s.
Fourth Quarter 2023: Based on the February 8, 2024, SEDR submittal in response to the January 7, 2024,
email I sent to Mr. Miller, Mr. Badger, and Mr. Fry acknowledging receipt of the hand delivered cover letter
dated January 30, 2024, and notifying them of the company’s failure to submit an electronic data report on or
before January 30, 2024. The 4Q2023 SEDR Review is as follows:

I received the 4Q2023 SEDR on February 8, 2024, in an email from Mr. Badger in response to the email I
submitted to Holcim on February 7, 2024. In the 4Q2023 SEDR, Holcim has modified the dates of the cylinder
gas audit data in TC 260 of the report but potentially knowingly falsely reported the gas audit results as they
had not changed from the first quarter. This report is also inaccurate and incomplete. This is a data comparison

for the 3Q2023 and 4Q2023 SEDR, but still not reporting the actual CEM values for the fourth quarter CGA’s.
Under Utah Code § 19-2-115(2)(a), A person who violates this chapter, or any rule, order, or permit issued or
made under this chapter is subject in a civil proceeding to a penalty not to exceed $10,000 per day for each
violation.” Under the Utah Administrative Code (UAC)R307-170-9(1)(c)(i), each source that is required to
install a continuous monitoring system shall submit to the DAQ Director a complete, unmodified electronic
data report in an ASCII format specified by the DAQ Director by January 30, April 30, July 30, and October
30 for the quarter ending 30 days earlier. UAC R307-415-5d and R307-170-9(9) and Condition I.K of the Title
V Operating Permit require certifications of each report as truthful, accurate, and complete.
Utah Code 19-2-115(4)(a) states that “[a] person is guilty of a third degree felony and is subject to
imprisonment under Section 76-3-203 and a fine of not more than $25,000 per day of violation who
knowingly:
(a) makes any false material statement, representation, or certification, in any notice or report required by
permit;”
UAC R307-170-9(10) requires that:
“Each source shall submit a narrative description explaining each event of monitor unavailability or excess
emissions. Each description also shall be accompanied with reason codes and action codes that will link
descriptions to events reported in the monitoring information and excess emission report.”
SOURCE INSPECTION
SUMMARY EVALUATION: Holcim has repeatedly reported inaccurate and potentially knowingly false
information in its 2023 quarterly reports. The company was previously cited
for failure to submit the 2Q2023 and 3Q2023 SEDR’s required by
R307-170-9. The company representatives have been given multiple chances
to self-audit and correct errant submittals. Emails have been sent to discuss
discrepancies that were not corrected. A meeting was held on February 15,
2024, with Mr. Miller and Mr. Badger where the accuracy of the TC220 data
was in question, among other things. The company claimed to have done a
“thorough self-audit” and discovered that they failed to conduct a required
RATA for HCl which was due in November 2023. After this review, they still
failed to look over their quarterly reports to catch critical errors in their
reporting.
CURRENT
RECOMMENDATIONS: DAQ may refer potential violations of Utah Code § 19-2-115(4)(a) for
knowingly making false “certified” statements in the 2Q2023, 3Q2023, and
4Q2023 SEDR reports by failing to report the actual monitor values and the
actual relative accuracy of the cylinder gas audits for each quarter to criminal
investigation and prosecution under the authority of Utah Code § 19-2-117.
Holcim failed to submit approximately 209 narrative descriptions of monitor
unavailability in the 2Q2023, 3Q2023, and 4Q2023 SEDR reports for
abnormally long “daily calibrations.”

Holcim failed to comply with Title V operating permit Conditions II.B.6.b.3,
II.B.6.d.3, II.B.6.k.3, II.B 6.l.3, and II.B.6.m.3 for failure to submit a
complete and accurate quarterly SEDR for its CEMS as required in R307-170
and 40 CFR 60.13 for 4Q2023.
A NOV should be issued for failure to comply with the Utah Air Conservation
Act (Title 19, Chapter 2), UAC R307-170-9 and R307-415-5d, applicable
federal regulations, and Title V operating permit conditions I.S.2.C,
II.B.6.d.3, II.B.6.k.3, II.B 6.l.3, and II.B.6.m.3.
HIGH PRIORITY
VIOLATOR (HPV): Yes – HPV Criterion V for violating federally enforceable work practice
standards and reporting that substantially interferes with the determination of
source compliance.
RECOMMENDATION
FOR NEXT INSPECTION: Check DAS for daily zero and span drift.
Check the QC program to ensure that monitor drift is being tracked and that
the source can identify excessive drift.
Double check that CGA’s, RATA’s, Monitor Down Time, and Excess
Emissions are all being accurately tracked from quarter to quarter.
