Subject:Concurrence, Updated Drinking Water Source Protection Plans for the Upper Tollgate Spring, Lower Tollgate Spring, Little Bear Spring, Lower Well 1, and Well 4; Fairview City
Water System; Water System #20012, Source No. WS001, WS002, WS003, WS004, and WS008
Dear Justin K Jackson:
The Division of Drinking Water (the Division) received the updated Drinking Water Source Protection (DWSP) plans for Lower Well 1 and Well 4 from you on October 5, 2023. The Division
also received the updated DWSP plans for the Upper Tollgate Spring, Lower Tollgate Spring, and Little Bear Spring from you on December 28, 2023.
We have completed our review of the updated DWSP plans and find that the plans basically comply with the applicable portions of Utah’s Administrative Rules for Public Drinking Water
Systems. The Division concurs with these updated plans. We commend you for establishing a program to protect these sources from present and future contamination. These plans must be
updated often enough to ensure that they reflect current conditions in your protection zones.
The due date for submitting the next updated plans for your wells is December 31, 2028.
The due date for submitting the next updated plans for your springs is December 31, 2029.RemindersAs stated in R309-600 and 605: Implementing DWSP Plans - Each Public Water System (PWS)
shall begin implementing each of its DWSP Plans in accordance with the implementation schedule within 180 days after submittal if the plan is not disapproved. Be prepared to describe
these efforts in your next update, which should include documentation of how the land management strategies identified for existing and future potential contamination sources were implemented.
Your updated plans will be disapproved, and 25 Improvement Priority System (IPS) points will be assigned for failure to comply with this requirement.As stated in R309-600 and 605: Recordkeeping
- As a DWSP Plan is executed, the PWS shall document any land management strategies that are implemented. Please provide actual copies of memoranda of understanding, public education
programs, bill stuffers, newsletters, or other correspondence documenting the implementation of each land management strategy as it occurs, in this section of your updated plan.
Monitoring Reduction Waivers
You requested renewal of your Use waivers for VOCs and/or pesticides for the Upper Tollgate Spring (WS001), Lower Tollgate Spring (WS002), and Little Bear Spring (WS003). However, these
sources are grouped under one sampling station and currently have a Reliably and Consistently waiver. Since UT-31 crosses the Upper Tollgate Spring’s protection zone two, a Use waiver
cannot be granted for this sampling station. Generally, the presence of roads within zones one, two, or three implies that pesticides and volatile organic chemicals are used.
This sampling station may be eligible for a Use waiver for pesticides if you can provide a letter from UDOT confirming that pesticides are not used along the road within the protection
zones of the Upper Tollgate Spring. Based on our records, a letter from UDOT has not been provided. Your sampling schedule remains the same.Please contact Noah Zorsky, P.G., at (385)
