INTRODUCTION This Statement of Basis provides the rationale of the Director of the Division of Waste Management and Radiation Control (DWMRC) for issuing the Advanced Paving and Construction Class IVb Landfill permit renewal. The Director’s staff conducted this evaluation to ensure compliance with the applicable solid waste rules. Kelly Shaw wrote this Statement of Basis. 2. FACILITY BACKGROUND a. Facility Location and History The Advanced Paving and Construction Landfill is located at 1723 West 1350 South, Ogden, UT 84401. b. Regulatory History The facility first received waste in early 1981. The first permit to accept solid waste was issued in 1998 (DSHW-2025-000288). This is the 4th renewal of the permit. 3. EVALUATION OF THE PERMIT APPLICATION a. The permit renewal application (Application) was received on December 4, 2023 (DSHW-2024-004237). The Application was reviewed and found to be incomplete. A Request for Information (DSHW-2024- 007403 and DSHW-2024-007404) was sent to the applicant on August 16, 2024. Additional information (DSHW-2024-008322) was received from the applicant on September 17, 2024. The additional information was reviewed and found incomplete. A Request for Information (DSHW-2024-008818) was sent to the applicant November 6, 2024. Additional information (DSHW-2024-009295) was received November 21, 2024. The additional documents and original application were reviewed and determined to be complete and a draft permit (DSHW-2025-000076) was sent to the applicant to review on February 11, 2025. An email response from the applicant (DSHW-2025-001263) was received on February 27, 2025. 4. JUSTIFICATION FOR ISSUING THE PERMIT a. The Director’s staff has evaluated the permit application as required by Section 19-6-108 of the Solid and Hazardous Waste Act and R315-301 through 320 of the Solid Waste Permitting and Management Rules. 5. PUBLIC PARTICIPATION a.
