INTRODUCTION This Statement of Basis provides the rationale of the Director of the Division of Waste Management and Radiation Control (DWMRC) for issuing the ET Technologies, Inc. Soils Regeneration Site Solid Waste Treatment Facility Permit, pending a public comment period. The Director’s staff conducted this evaluation to ensure compliance with the applicable solid waste rules. Nathan Nicolodemos wrote this Statement of Basis. 2. FACILITY BACKGROUND a. Facility Location and History The facility is located on property owned jointly by Salt Lake County and Salt Lake City, and within the permit boundary of the Salt Lake Valley Solid Waste Management Facility Landfill. The property address is 6030 West California Ave. in Salt Lake City. See Figure 1 for a map of the location. b. Regulatory History E.T. Technologies has operated the Soil Regeneration Site since 1984 and has historically been permitted by the Salt Lake County Health Department. This will be E.T. Technologies’ first permit under DWMRC regulations. 3. EVALUATION OF THE PERMIT APPLICATION a. An initial permit application was received from E. T. Technologies, Inc. on January 7, 2019 (DSHW- 2019-000343). The Division requested additional information, which was received on November 22, 2019 (DSHW-2019-016202), May 13, 2021 (DSHW-2021-007342), December 28, 2021 (DSHW-2021- 026123) and June 5, 2023 (DSHW-2023-047420). Together, these documents compose and are referred to as the Permit Application, which was determined complete on June 5, 2023. The Division then drafted a permit and sent it to E.T. Technologies for approval on January 22, 2024 (DSHW-2024-002302). b. E.T. Technologies Inc. reviewed the first iteration of the draft permit and responded with a list of comments on February 6, 2024 (DSHW-2024-007934) and March 8, 2024 (DSHW-2024-007933). The amendments listed below were incorporated into the draft permit by the Division on February 4, 2025. i. Contact information for E.T. Technologies’ site manager was updated. ii. “Salt Lake Valley Solid Waste Management Council” was removed as a listed operator of the facility. iii. Section IV.A.2. regarding closure procedure was reworded to account for the time required for accepted waste to be removed from the site as compost. 4. JUSTIFICATION FOR ISSUING THE PERMIT a. The Director’s staff has evaluated the permit application as required by Section 19-6-108 of the Solid and Hazardous Waste Act and R315-301 through 320 of the Solid Waste Permitting and Management Rules. The information provided in the permit application satisfies the requirements. 5. PUBLIC PARTICIPATION a. As required by Utah Administrative Code R315-311-3, a Public Notice has been prepared and a 45-day public comment period will commence on Thursday, March 13, 2025 and end at 5:00 p.m. on Monday, April 28, 2025.
