This Temporary Exception Expires on February28, 2028.
Dear Kale Watkins:
On December 17, 2024, the Division of Drinking Water (the Division) received your request for an exception to Rule R309-550-11(3) and R309-105-9(3) regarding an individual home booster
pump located at 1020 East 525 North, Morgan, Utah 50. According to these rules, individual home booster pumps shall not be allowed for individual service from the public water supply
mains where the dynamic water pressure at the point of connection will fall below 20 psi during normal operation of the water system.
It is our understanding that the hydropneumatic booster system was installed by the previous homeowner, and the new homeowner wants to comply with all necessary rules and regulations.
The residential home is at a similar elevation to the water system tank, which results in a pressure below 20 psi. The Morgan City water system is dedicated to improving distribution
pressure in this area by connecting it to a higher pressure zone or relocating the existing tank to a higher elevation.
Exception Request
The basis for your request for an exception to R309-550-11(3) and R309-105-9(3)) regarding individual home booster pumps is that the home is at a similar elevation to the tank requiring
a home booster to provide 20 psi at the service connection. You propose the following to provide equivalent protection for public health to meet the intent of the rule:
The hydropneumatic booster system has been inspected and approved by a licensed plumber and the building official. There are two backflow devices installed to protect the distribution
system.
Morgan City takes the responsibility of the water quality to the water meter. Water quality will be the responsibility of the property owner downstream of the water meter.
The tank and all appurtenances must comply with NSF/ANSI 61: Drinking Water System Components.
The individual home booster pump installation and the required backflow prevention assembly must be included in Morgan City's cross-connection control inventory.
The property owner will be required to submit testing and inspection reports for the required backflow prevention assembly. The reports must be submitted to Morgan City annually or as
often as necessary.
The property owner will be required to record a formal notice of the individual home booster pump installation with the property deed at the Morgan County Recorder's Office. These requirements
will be transferred to subsequent property owners in the event the home is sold.
On this basis, exceptions to R309-550-11(3) and R309-105-9(3), Individual Home Booster Pump, are hereby granted for 1020 East 525 North Morgan, Utah.
This Temporary Exception expires onFebruary 28, 2028.
You must install an automatic cutoff device to shutdown the hydropneumatic booster system when suction pressure is less than 20 psi.
You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal
prior to February 28, 2028.
Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued.
Failure to request the re-evaluation of this exception and obtain an exception renewal by February 28, 2028, will result in the activation of the deficiency related to having an individual
home booster and not meeting minimum pressure requirements.
This Temporary Exception may be rescinded any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this
exception.
The issuance of this exception temporarily resolves your water system’s deficiencies related to M008 and D003, Individual Home Booster and Pressure Requirements. An updated IPS report
