Dave,
I know I never responded to this....... I am responding now! Do you think Conoco is worth going after? I sent a letter to
Phillips a couple years ago and they said they had no record of the station.
Thanks,
Avery

Hi Avery,
3/6/25, 9:54 AM State of Utah Mail - Re: RP Memo on Snowville Conoco LUST Site, #1000707/NXU

I am going through my email chain to see if there is anything I have overlooked the past couple of months
and found this email that I didn't respond to. Sorry for the oversight although I vaguely remember maybe
discussing this with someone. That someone may have been Kimberlee.
Anyway, I don't think Conoco would be worth going a er. The facility likely operated under a Conoco flag
like most other facili es at the me. Further, we have no documents such as leases, tles or other evidence
of a Conoco ownership. Title histories indicate no ownership on the part of Conoco. All we have are
people's memories of a Conoco sta on but nothing else as to Conoco's rela on to the site. It seems most
likely that the property owners and those running the gas sta on were the owners and operators under a
Conoco flag. As it stands, it would be difficult to prove Conoco involvement at the site was in the capacity
of owner or operator.
That being said, if you would like you could send a le er to Conoco saying it is a possible RP and see how it
responds. Maybe it will provide further details of its involvement in the site (I doubt it but who knows). The
bo om line is without more available informa on DERR couldn't go a er Conoco and prevail in an
adjudica on just on informa on the facility had a Conoco flag and the other indica ons are that those
owning and running the gas sta on were the owner/operators.
Best,
David McKnight

Okay, thank you. We will proceed with LUST Trust.
I did send a letter to Phillips a couple years ago, and they said they had no record of the facility.
Thanks,
Avery
