Pursuant to the provisions of the utah solid and Hazardous waste Act, Title 1g, chapter 6,utah code Annotated (ucA) 1953, as amended (the Act) and the utah sotid waste permitting
and Management Rules, Utah Administrative Code (UAC) R315-301 through 320 (rhe SolidWaste Rules) adopted thereunder,

is hereby authorized to construct and operate a Class II Landfill located in Sections 15 and 16,Township 12 N, Range 7 E, Salt Lake-Base and Meridian, Rieh County, Utah as shown in thepermit application dated October 5, 1995 and revised September 10, Ottober 21, November26, and December 19, 1996.
The operation of the landfill is subject to the condition that Rich County (permittee) meet therequirements set forth herein.
All references to UAC R315-301 through320 are to regulations that are in effect on the datethat this permit becomes effective.

The permit application submitted by Rich County on October 5, 1995 and revised September
10, October 21, November 26 and December 19, 1996 is incorporated by reference into this
solid waste plan approval (hereafter called permit). All representations made in the permit
application are a part of this permit. Where differences in wording exist between this permit
and the application, the permit wording supersedes that of the application.
By this permit to operate, Rich County (hereafter referred to as Permittee) shall be subject to
the following conditions.
I. GENERAL COMPLIANCE RESPONSIBILITIES
A. General Ooeration
The Permittee shall operate the municipal landfill in aceordance with all
requirements of R315-302 and 303 Utah Administrative Code (UAC) unless
otherwise noted in this permit. Any permit noncompliance constitutes a
violation of R315 UAC and is grounds for appropriate enforcement action,

permit termination, revocation and reissuance, modification, or denial of a
permit renewal application.
B" Acceptable Waste
This permit is for disposal of nonhazardous solid waste which may include,
municipal waste, commercial waste, industrial waste, construction/demolition
waste, and special waste.
C" Prohibited Waste
No regulated quantity of hazardous waste, as defined by R315-1 and R315-2uAC, or PCB's, as defined by R315-301(52) uAC, shall be accepted for
treatment, storage, or disposal at the landfill. Any such waste received at thefacility will constitute a violation of this permit and R315-303-5(7) UAC. The
landfill owner/operator will inspect all waste loads to verify that no wastes other
than nonhazardous solid waste are disposed in the landfill.
D. Self Inspections
The owner or operator shall, no less than quarterly, inspect the landfill site
including the fencing; gate, or other access controls; and the storm water run-
on/run-off controls. A record of these inspections shall be maintained in the
operating record.
E. Noncompliance
In the event of noncompliance with the permit or the utah soltd waste
Permitting and Management Rules, the Permittee shall take all reasonable steps
to minimize releases to the environment and shall carry out such measures ur "tanecessary to protect human health and the environment. Following a
noncompliance event, the Permittee shall: document the noncompliance in the
operating record; orally notify the Solid Waste Section of the Division of Solid
and Hazardous Waste within 24 hours or the next business day; and give written
notice within seven days of the noncompliance and the measuies taken to protect
human health and the environment. Compliance with the terms of this permit
does not constitute a defense to actions brought under any other local, Sht", o,
Federal Law. It shall not constitute a defense for the permittee in an
enforcement action that it would have been necessary to halt or reduce thepermitted activity in order to maintain compliance with the conditions of this
permit.

F. Inspection Access
The landfill will be subject to inspection by the State and the Bear River Health
Department. The Permittee shall allow the Executive Secretary of the Utah
Solid and Hazardous Waste Control Board, or an authorized representative,
including representatives from the Bear River Health Department, upon
presentation of credentials, to enter during operating hours, and inspect at
reasonable times any facilities, equipment, practices, or operations regulated or
required under this permit. A record of the inspection may be made by
photographic, videotape, electronic, or other reasonable means
G" Revocation
This permit is subject to revocation if any condition of this permit is not being
met. The operator will be notified in writing prior to any proposed revocation
action and such action will be subject to all applicable hearing procedures
established under the Utah Solid and Hazardous Waste Act, including R315-12
UAC, and the Utah Administrative Procedures Act.
II. DESIGN AND CONSTRUCTION
A. Design and Construction
The Permittee shall construct the landfill, run-on and run-off diversion systems,
and the final cover in accordance with the plans presented in the permit
application. Cell or trench construction methods differing from those described
in the permit application shall require approval from the Executive Secretary.
III. LANDFILL OPERATION
A. Ooerations PIan
The Operations Plan shall be kept on-site at the landfill. The Operations Plan
will address hours of operation, incoming waste inspections, landfill inspection
and monitoring schedule, description of equipment maintenance, procedures for
controlling disease vectors, training and safety plan for site operators, and
contingency plans in the event of fire or explosion. The Operations Plan will
also include examples of forms used to record quantities of waste received,
results of waste inspections, results of gas monitoring, and training programs
completed.
B. Training
Permittee shall provide training for on-site supervisors in landfill operation,

including waste load inspection, hazardous waste identification, and personal
safety and protection.
C. Securitv
A locked gate shall be installed to prevent vehicular access to the site during
closed hours. Fencing as shown in the permit application shall be construc[d toprevent access of persons or livestock by other routes. The permittee shallnotit/ the Executive secretary in writing of the completion of the fencing
construction before receipt of waste.
D. Roads
All access roads used for transporting waste to the landflll for disposal shall be
improved and maintained as necessary to assure safe and reliable all-weather
access to the disposal area.
E. Burnine of Waste
Intentional burning of solid waste is prohibited and a violation of R315-303-
5(2Xb) UAC. All accidental fires shall be extinguished as soon as possible.
F. Disposal of Liquids
Disposal of containers larger than five gallons holding liquids, noncontaineraed
liquids, sludge containing free liquids, or any waste containing free liquids in
containers larger than five gallons is prohibited.
G. Daily Cover
Cover material consisting of at least six inches of dirt shall be applied at the end
of each working day. Alternative cover material may be used if approved by the
Executive Secretary.
H. Disposal of Special Wastes
Animal carcasses may be disposed at the bottom of the landfill working face and
covered with other solid waste or earth by the end of the working day they are
received or they may be disposed in a special trench or pit prepared for the
acceptance of dead animals. If a special trench is used, animals placed in the
trench shall be covered with six inches of earth by the end of each working day.
Asbestos waste shall be handled, transported, and disposed in accordance with
UAC-315-31s-2.

Ash shall be transported in such a manner to prevent leakage or the release of
fugitive dust. The ash shall be completely covered with a minimum of six
inches of material, or use other methods or material, if necessary, to control
fugitive dust.
I. Gas Monitorine
The Permittee shall monitor landfill gases quarterly and at the locations
specified in the Landfill Gas Monitoring Plan.
If the concentrations of explosive gases at any of the facility structures, at the
' property boundary or beyond, ever exceed the standards set in UAC R315-303-
3(2)(a), the Permittee shall immediately take all necessary steps to ensure
protection of human health and notify the Executive Secretary. Within seven
days of detection, place in the operating record the explosive gas levels detected
and a description of the immediate steps taken to protect human health.
Implementation of a remediation plan shall meet the requirements as stated in
UAC R315-303-4(5Xb) and shall be submitted and approved by the Executive
Secretary prior to implementation.
J. Record Keeours
The Permittee or operator of the facility shall maintain on-site or at another
location approved by the Executive Secretary an operating record as required by
R315-302-2(3) UAC. The operating record shall include: weights or volumes of
waste received, number of vehicles entering, the types of waste received (if
available), major deviations from the approved plan of operation, training and
notification procedures, results of gas monitoring, an inspection log or
sufilmary, closure and post-closure care plans, and cost estimates and financial
assurance documentation.
K. Reoortins
The Permittee shall prepare and submit an Annual Report to the Executive
Secretary as required in R315-302-2(4) UAC. The Annual Report shall include:
period covered by the report, annual quantity of waste received, estimated in-
place density of waste, the annual update of the financial assurance mechanism,
results of gas monitoring, and training programs completed.

A. Financial Assurance
V
A financial assurance mechanism shall be proposed by the permittee and
approved by the Executive secretary. The approved mechanism shall be
established by the Permittee by October 9, 1997 . An annual revision of closure
costs and financial assurance funding shall be submitted to the Executive
Secretary. The financial assurance fund shall be adequately funded to provide
for the cost of closure at any stage or phase or anytime during the life of tfr.
landfill, and must be fully funded within five years of the date waste is first
received at the landfill.
B Final Cover
Final cover of the landfill shall consist of 18 inches compacted clay soil with a
permeability of I x 10 -s cm/s or less up to grade, plus 24 inches of additional
cover soil as specified in the December 19, 1996 revision of the permit
application. Any alternative design must be approved prior to emplacement of
final cover or expiration of this permit, whichever occurs first.
C. Closure
The Permittee shall close and maintain the facility in accordance with the
closure and post-closure plans included in the permit application and as required
by R315-302'3. UAC
ADMINISTRATIVE REQUIREMENTS
A. Permit Transfer
This permit may be tlansferred to a new permittee by meeting the requirements
of the Permit Transfer provision in R315-310-9 UAC.
B. Status Notification
Eighteen months from the date of this permit the Executive Secretary shall be
notified in writing of the status of the construction of this facility un-less
construction is complete and operation has commenced.
C. Permit Modifications
Modifications to this permit may be made by the permitting agency as necessary
as a result of statutory or regulatory changes. The permittee will be given
written notice of any perrnit modification.

D. Exoiration
This permit shall expire five years from the effective date which will be the date
shown on the signature (cover) page of this permit. Application for permit
renewal shall be made at least six months prior to the expiration of this permit.
If a timely renewal application is made and the permit renewal is not complete
by the expiration date, this permit will continue in force until renewal is
completed or denied.
E" Expansion
Any expansion of the landfill facility beyond the areas designated in the permit
application will require submittal of a new permit application in accordance with
the requirements outlined in R315-310 UAC. Permittee may not begin
construction of any expansion until approval of the new permit is received from
the Executive Secretary of the Utah Solid and Hazardous Waste Control Board
is received in writing.
