Shelley Executive Director DIVISION OF ENVIRONMENTAL RESPONSE AND REMEDIATION Brent H. Everett Director MEMORANDUM TO: Morgan Atkison, PST Branch Manager Division of Environmental Response and Remediation THROUGH: Chris Howell, RA Section Manager Division of Environmental Response and Remediation Scott Everett, Toxicologist Division of Environmental Response and Remediation FROM: Liberty Coe, RA Section Project Manager Division of Environmental Response and Remediation DATE: July 18, 2024 SUBJECT: No Further Action Recommendation, Suspected Petroleum Storage Tank Release Jackson’s Food Stores #193, located at 835 West 1200 South, Orem, Utah Facility Identification No.1000137, Release OKX I have reviewed the file for the above-referenced facility, which includes information provided by the facility owner. My recommendation that no further action is required at the facility is based on the review of the information contained in the case file. A suspected release was reported to the Division of Environmental Response and Remediation. However, further investigation has indicated (outlined below) a release has not occurred. I recommend no Reporting and Remediation compliance schedule(s) be sent to the responsible party. In addition, no closeout letter will be sent to the responsible party since the site has not been tracked as an active PST release site. This recommendation for closeout is based on the condition that if future evidence indicates the existence of contamination at or emanating from this site, investigation and corrective action may be required. CH Case file information justifying no further action includes the following: On June 24, 2024, a driver crashed into a dispenser at this facility, causing a fire that destroyed the dispenser and the premium and unleaded product lines. These lines were shut off and replaced. On July 3, 2024, line testing was conducted to ensure the new product lines were functioning properly. A new sump was also installed for the destroyed dispenser. Photos of the repairs and line test results were sent to the DERR on July 10, 2024 and uploaded to Laserfiche. The incident did not impact soil or storm drains; 5 gallons of product were discovered inside the burnt sump and removed.
