Please read the instructions that are found in the document, INSTRUCTIONS FOR APPLICATION FOR A
PERMIT TO OPERATE A CLASS IV or VI LANDFILL. This application form shall be used for all Class IV or VI
solid waste disposal facility permits and modifications. Part I, GENERAL INFORMATION, must accompany a
permit application. Part 11, APPLICATION CHECKLIST, is provided to assist applicants and, if included with
the application, will assist review. Part II is provided to assist in preparation and review of a permit application;
it is not required by rule. The text of the rule governs all permit application contents and should be consulted
when questions arise.

Utah Class IV and VI Landfill Permit Application Checklist
Important Note: The following checklist is for the permit application and addresses only the
requirements of the Division of Waste Management and Radiation Control. Other federal, state, or local
agencies may have requirements that the facility must meet. The applicant is responsible to be informed
of, and meet, any applicable requirements. Examples of these requirements may include obtaining a
conditional use permit, a business license, or a storm water permit. The applicant is reminded that
obtaining a permit under the Solid Waste Permitting and Management Rules does not exempt the facility
from these other requirements. Please take note of the heading of each section for the facilities that the
section applies to.
An application for a permit to construct and operate a landfill is the documentation that the landfill will be

located, designed, constructed, operated, and closed in compliance with the requirements of Utah
Administrative Code R315-301 through 320 (Utah Solid Waste Permitting and Management Rules) and
Utah Code Annotated 19-6-101 through 126 (Utah Solid and Hazardous Waste Act). The application
should be written to be understandable by regulatory agencies, landfill operators, and the general public .
The application should also be written so that the landfill operator, after reading it, will be able to operate
the landfill according to the requirements with a minimum of additional training.
Copies of the Solid Waste Permitting and Management Rules, the Utah Solid and Hazardous Waste Act,
along with many other useful guidance documents can be obtained by contacting the Division of Waste
Management and Radiation Control at 801-536-0200. Most of these documents are available on the
Division's web page at https://deg.utah.gov/division-waste-management-radiation-control. Guidance

1. GENERAL DESCRIPTION OF THE FACILITY
R315-310-3(1)(b)
Uintah County is seeking a permit renewal for the continued operation of a Class IVb Landfill that is
owned by Uintah County and operated by the Uintah County Landfill Department. The Uintah County
Landfill is currently being operated under the guidelines established by the Original Permit Number
9516R1, issued by the Utah Department of Environmental Quality, Division of Solid and Hazardous
Waste.
The Uintah County Landfill Facility is located at 12502 East Highway 121, Utah84039, approximately 1.5
miles east of Lapoint, Utah, and approximately 14 miles West of Vernal on State Highway 121, and it
currently serves the population of western Uintah County.

Ecologically or Scientifically Significant Areas or Endangered Species
Based on information derived from the U.S. Fish and Wildlife Service (USFWS) Information for Planning
and Consultation (IPaC) webpage, neither wetlands nor critical habitats for threatened or endangered
species occur within the landfill property or immediate surrounding area.

2. LEGAL DESCRIPTION OF PROPERTY
R315-310-3(1)(c)
The existing landfill facility is owned and operated by Uintah County.
The Class IVb Landfill as presently permitted is described as the Northeast 1/4 Northwest 1/4 and North
1/2 Southeast 1/4 Northwest 1/4 and the West 1/2 west 1/2 Northwest 1/4 Northeast 1/4 of section 11,
Township 5 South, Range 19 East, Salt Lake base and Meridian, comprising of 75 acres. Uintah County,
Utah. The landfill facility's front gate is located at Latitude 40"24'1.60"N, Longitude 109"45'44.61W
The property on which the landfill facility is situated is zoned Mining and Grazing (M&G). The property
surrounding the landfill facility is zoned M&G
3. PROOF OF OWNERSHIP
R315-310-3(1)(c)
Land patents issued by the United States of America and a Uintah County Ownership Plat can be found
in Appendix B. and provide the required proof of land ownership.
4. NON-COMMERCIAL LANDFILL FACILITY
Utah Code 19-6-102(3)
The landfill facility permit is held by the Uintah County Commission. The Uintah County landfill is located
on property belonging to Uintah County and the daily landfill operations are performed by the Uintah
County Landfill Department personnel.
5. WASTE TYPE AND ANTICIPATED DAILY VOLUME
R315-310-3(1)(d)
The area served by the landfill is primarily the west side of Uintah County. Lapoint, Tridell, Gusher,
Ballard, and Fort Duchesne. Uintah County consists of approximately 421 households and 1064 persons.
6. ACCEPTED WASTE
R315-301-2(10)
The Class IVb Landfill accepts for disposal construction/demolition waste, yard waste, inert waste and
dead animals as defined in R315-301-2(10). This includes waste generated from construction including
building materials used in construction. Construction related materials include packaging materials from
products, waste lumber, wallboard, boxes from appliances, empty paint cans, caulking tubes, and sealer
and adhesive cans "Empty'' is defined as no more than l0% of the product remaining inside the
container. Demolition waste is generated from the destruction of and remodeling of buildings and
houses. Demolition waste may include furnaces, piping, ducting and water heaters. Other acceptable
construction/demolition materials include untreated wood, including pallets and crates, bricks,
concrete, asphalt, rock, and non-asbestos roofing materials.
7. SPECIFICALLY EXCLUDED WASTE
R315-303-3(1)(b)
Waste materials that are specifically excluded from being disposed of in the active area of the landfill
include household waste (municipal solid waste), contaminated soils, friable asbestos, tanks of any kind,
railroad ties, cardboard and metal not directly generated from construction or demolition activities,
furniture and electronics of any kind, treated lumber, hazardous wastes and sludge and liquids as
described in R315-303-3(1)(b).
The Lapoint landfill will accept and stockpile for recycling purposes tires, batteries and appliances.
Appliances containing refrigerants are placed in the metal recycling area of the landfill only after the
refrigerant has been removed by a State qualified business that has contracted with the County.
Removal of these recyclable materials from the landfill site is an on-going operation with recyclers.
8. INTENDED SCHEDULE OF CONSTRUCTION

The landfill construction was started early in the year 1996, with the boundary of the landfill property
being half-fenced and continues in operation within the original permitted guidelines (Permit #9516R)
and the current operations as prescribed by this Permit.
9. PLAN OF OPERATIONS
The Uintah County landfill Lapoint facility is operated Three (3) days a week in accordance with the
following schedule:
Monday 9:00 a.m. to 3:00 p.m.
Wednesday 9:00 a.m. to 3:00 p.m.
Saturday 9:00 a.m. to 5:00 p.m.
The facility is closed all holidays. Signs are posted at the entrance gate for public notification of the
landfill facility owner and operator, hours of operation, type of materials accepted by and excluded from
the landfill.
10. STANDARD PROCEDURE
R315-302-2(2)(b)
Persons disposing of waste at the landfill will comply with the following:
Vehicles delivering waste to the site will stop at the office located at the main gate on the access road
where a Landfill employee will inquire as to the contents of their load. The driver will be instructed
where to deposit each type of waste in the load. The driver will then follow the instructions given by the
Landfill employee. Signs have been installed directing patrons to the different disposal sites within the
Landfill to ensure that only appropriate waste is disposed of in each disposal site.
11. MEASUREMENT OF WASTE
R315-310-3(1)(f)
The Lapoint Landfill does not have a scale for weighing the waste loads. As an alternative, the operator
at the gate performs load counts on daily basis, making a record of the number, type, and maximum
volume of each delivery vehicle arriving at the site.
12. RANDOM LOAD INSPECTIONS
Inspection and Monitoring Schedule R3I5-302-2(2)(c) & R315-302-2(5)(a)

Landfill personnel are required to receive initial and periodic waste screening inspection training.
Currently Uintah County Employees are receiving their training through the Solid Waste Training
Institute, in Kaysville, Utah. Waste screening certificates of training received are kept in personnel files.
A visual inspection of each incoming load of waste material is made by the Gate House Attendant. The
load is visually inspected to identify unacceptable and excluded wastes to prevent unauthorized
disposal. In depth random inspections of incoming loads are conducted according to the schedule
established by the Landfill Supervisor. Currently the Landfill in Lapoint receives on average less than 10
vehicle loads of waste per day, one random load inspection is done per 20 loads of waste. Appropriate
protective gear is worn by Landfill personnel. The waste is spread out with landfill equipment or hand
tools and visually examined.
Loads will also regularly be surveyed at the tipping area. If a discharged load contains unacceptable
material, the discharger will be required to reload the material and remove it from the landfill. If Landfill
personnel are unable to determine who is responsible, the area where the illegal dump occurred will be
sectioned off. The unacceptable material will be moved to a designated area for identification and
prepared for proper disposal.
Any vehicle declared to contain, or suspected to contain unacceptable materials (liquid waste, sludge, or
hazardous waste) will be prevented from entering the disposal area unless the driver can provide
evidence that the waste is acceptable for disposal at the site. If the load contains unacceptable
materials, it will be rejected without discharging its load. At its sole discretion, the Landfill reserves the
right to reject any suspect load.
In compliance with R3l5-302-2(5)(a) the Landfill Supervisor will inspect the facility to minimize
malfunctions and deterioration, operator errors, and discharges that may cause or lead to the release of
waste to the environment or threaten human health. These inspections are conducted on a quarterly
basis or as needed. A Landfill Monitoring Form is kept as part of the operating record. A Landfill
Monitoring Form can be found in Appendix C.
Record Keeping and Reporting
The Landfill Supervisor shall maintain the following operating records for the landfill:
• Records of inspection and maintenance;
• Records of training and notification procedures;
• Records of groundwater monitoring;
• Records of landfill gas monitoring;
• Records of weights and volume of waste received;
• Number of vehicles;
• Deviations from the plan of operation;
• Records of placement or recirculation of leachate;
• Records of any gas condensate;
• Prepare an annual report and place the report in the facility’s operating record;
• A copy of the permit including the permit application;
• Closure and post-closure care plans; and
• Results of inspections conducted by representatives of the Utah Solid and Hazardous.
13. UNACCEPTABLE WASTE FOUND
If a waste is found at the "face" that is unacceptable, the Landfill Supervisor is called immediately if
unstable wastes that cannot be handled safely or radioactive wastes are discovered or suspected. If the
Landfill Supervisor concurs, they will contact the Uintah County Hazmat Response Team (Hazmat).
If frequent violations are identified, additional random inspections will be scheduled at the discretion of
the Landfill Supervisor.
The Waste Inspection Form is completed. An example of a Waste Inspection Form can be found in
Appendix D.
14. EQUIPMENT
The Landfill primarily utilizes one (1) piece of heavy equipment (938G Loader) during the course of any
given day of landfill operations. As needed the Uintah County Road Department, and Cemetery
Department bring in additional heavy equipment at times when extra work is needed. Like construction
of new trenches or the need for new or improved roads. These pieces of equipment include a CAT D-7
Dozer, a CAT 623E Paddle Wheel, a CAT 4-16 Backhoe, a CAT 140G road Grader, 772 Bomag Compactor,
and a water truck. As the landfill is operated by the Uintah County, additional heavy equipment is
readily available for use at the landfill as required.
15. FIRE OR EXPLOSION CONTINGENCY PLAN
R315-302-2(2)(d)
The contingency plan in the event of a fire or an explosion on the landfill property shall include the
following preventative measures:
No open burning or smoking is allowed near the working face. Identifying and prohibiting the delivery of
hot materials to the landfill. Fires inside of the delivery trucks which result from spontaneous
combustion during the unloading process shall be isolated in as much as possible from the working face
of the landfill. Implementation and adherence with the waste cover schedule. Proper maintenance and
cleaning of the landfill equipment and providing for and maintaining fire extinguishers in the equipment
and other landfill vehicles.
The contingency plan in the event of a fire or an explosion on landfill property shall include the following
corrective measures:
All persons shall be evacuated from the impacted area with assistance and first aid treatment being
rendered to the injured as required. 911 and the Landfill Supervisor, who directly oversees the landfill
operation, shall be notified. The Landfill Supervisor in turn shall notify the Division of Solid and
Hazardous Waste and, if deemed necessary, the County Hazmat Response Team. Any on-site landfill
equipment, including the dozer, the loader, the paddle wheel scraper, loaders, and the water truck, will
be utilized to the fullest extent to isolate and combat the fire. The intent being to both cool the burning
material with water and smother the fire with earthen cover material.
Additional personnel and equipment shall be made available from the County Road Department, and
Cemetery Department to assist fire-fighting efforts as required. The nearest fire station to the landfill
property is located in Lapoint. Less than 5 miles.
16. FUGITIVE DUST CONTROL PLAN
R315-302-2(2)(s)
The landfill access road from Highway 121 to the landfill is gravel. All other roads on the landfill property
also consist of dirt, gravel and recycled ashalt which require dust mitigation. The County Road
Department water truck is used to water the access roads within the landfill facility at appropriate
intervals to prevent the migration of dust from the landfill property.
17. LITTER CONTROL AND COLLECTION PLAN
R315-302-2(2)(h)
The Landfill has implemented several preventive measures to help minimize and control wind-blown
litter. These measures include:
County ordinance requiring all loads coming to the landfill to be covered. Uncovered loads entering the
landfill are subject to an enforceable fine (double regular fee). Any municipal solid waste collected at the
landfill is placed in a roll-off dumpster which is regularly removed from the landfill site and emptied. The
landfill cover material of six (6) inches is placed as needed.
The landfill is fenced around half of its perimeter which assists in containing wind-blown litter within the
landfill property. We plan to fence the other half soon as possible. Landfill personnel perform daily litter
cleanup to keep the landfill and surrounding properties free from debris and litter.
18. HAZARDOUS AND PCB WASTE EXCLUSION PLAN
R315-302-2(2)(j)
Should hazardous or prohibited wastes containing PCB be discovered during random inspections or
during tipping, the Landfill Supervisor or his designee will contact the Uintah County Hazmat Response
Team (Hazmat). The situation will be turned over to Hazmat team once they arrive on scene. The
following procedures are only a recommended course of action; ultimately the procedures to be
followed will be directed by the Incident Commander. If the waste is still in the hauler’s vehicle, the
hauler is instructed as to appropriate disposal options.
If the waste has been deposited or is in the process of being deposited, the hauler will immediately stop.
The area will be evacuated, and Hazmat will assume control of the situation. If the hauler or generator is
no longer at the Landfill and is known to Landfill personnel, they are asked to retrieve the waste and
informed of the proper disposal options.
If the hauler or generator cannot be identified, the Landfill Supervisor arranges to have the waste
transported to the proper disposal site. A record of the identification and removal of all hazardous or
prohibited wastes containing PCB will be kept in the site operational records on the Waste Inspection
form. A copy of the Waste Inspection form can be found in Appendix D.
A copy of the Incident Report should be provided to the Landfill personnel by Hazmat after the incident
for their records. In the event the hazardous or prohibited waste containing PCB is discovered at the
Landfill after the hauler has left the property, the Landfill Supervisor or his designee will contact Hazmat.
The situation will be turned over to Hazmat once they arrive on scene.
19. PROCEDURES FOR CONTROLLING DISEASE VECTORS
R315-302-2(2)(k)
The Lapoint Landfill is a class IVb Landfill that does not accept M.S.W. so the vector problem is very
minimal. Dead animals received at the facility shall be deposited in a separate disposal trench and will
be covered daily with a minimum of six (6) inches of earth to prevent odors and the propagation and
harborage of rodents and insects.
20. ALTERNATIVE WASTE HANDLING
R315-302-2(2)(1)
Alternative waste handling procedures for periods when the landfill is not able to dispose of solid waste
will be similar to procedures for fires and explosions. Waste will be diverted to alternate disposal sites.
Alternative facilities may include the Uintah County Landfill in Vernal or K&K Sanitation's transfer station
in Ballard. Procedures will continue in this manner until operations at the landfill can return to normal.
21. COST DISCLOSURE FOR OPERATING THE LANDFILL
Utah Solid and hazardous Waste Act 19-6-108(9)(h)
The Lapoint Landfill has an annual budget of $25,000.00 per year, approximately. This budget is passed
through a public hearing, and County Commissioner meetings with public comment. This has been
sufficient to operate this landfill in the past. The budget comes from Uintah County through property
taxes, and fees collected at the Landfill.
22. CLOSURE PLAN & CLOSURE SCHEDULE
R315-310-3(1)(h) & R315-310-4(2)(d)(i)
A detailed closure schedule will be prepared as part of the final closure and post-closure maintenance
and monitoring plan. The following provides a summary of the currently anticipated closure schedule.
Signage posted at all points of access consistent with regulatory requirements at the time of closure.
These signs will be placed at least 60-days prior to closure, state the date of closure, identify alternative
waste disposal locations, and remain for at least 180 days after receiving the final load of construction
and demolition waste materials.
A public notice will be placed in a local newspaper with general circulation at least 6 days prior to
closure.
Preparation and completion of construction and quality assurance activities will likely occur at the time
each phase of closure takes place. Assuming that each closure phase will cover approximately 1 to 3
acres. It is anticipated that it will take about three to four weeks to complete.
Closure activities proposed for the construction and demolition of waste materials landfill include:
1) Complete the final filling of the particular phase of the project;
2) A final cover system will be completed as part of the landfill's closure activities. However, as the
operator plans to construct and use the landfill in separate phases, portions of the landflll will be
covered as they are completed;
3) The final slope of the top layer will be about 2 percent, and vegetative cover and erosion
control. The integrity of the final cover side slope will be maintained by the placement of a
vegetative cover layer to provide erosion control. The final slopes will be re-vegetated with an
application of drought tolerant seed mixes that can survive under normal precipitation
conditions without irrigation and fertilizers as specified on the landscape plans after the final
grading is complete;
4) Perform final grading on the landfill slope, and install final cover materials, compacted soil layer
and the erosion (vegetative) control final cover material, and installation of erosion and run-off
controls; and
5) Removal of any remaining structures and facilities that will not be required for closure and
post-closure activities, and Installation of final site security measures, such as, signs posted at all
points of access, locked perimeter gates, and fencing around the entire site.

23. CAPACITY OF SITE
R315-310-4(2)(d)(ii)
As previously discussed, the facility receives waste for the northwest section of Uintah County. The
waste stream for 2022 is listed in Table 1 below.

The Lapoint Landfill Facility receives approximately 0.51 tons of MSW, which is then transferred to the
Vernal Class I Facility. The remaining 1.06 tons of C&D waste per operating day is disposed onsite. The
75-acre Facility lies just east of LaPoint along Highway 121. The permitted area is 75 acres and has a life
expectancy of over 50 years. The present capacity will be evaluated based on the permitted area, buffer
area, class IV disposal, animal waste disposal, landfill equipment, landfill facilities, manpower, recycling,
and compost /mulch.
24. PERMITTED AREA
The Facility currently operates on a 75-acre Class IVb permitted area. Under present conditions this
75-acre permitted area has a life expectancy of over 50 years.
25: FINAL INSPECTION BY REGULATORY AGENCIES
R315-310-4(2)(d)(iii)
As part of the landfill's closure process, the Division of Waste and Radiation Control or other regulatory
agency will need to do a final inspection on the Landfill.
26. POST CLOSURE CARE PLAN
R315-310-3(1)(h)
The County has set up a P.T.I.F. account for the purpose of having any expense that might arise during
the post closure time frame to be covered. Every year $6,000.00 is put into this account to adjust for
rising costs and inflation. Also, an outside audit is conducted every 4 years, by an engineering firm, to
keep our closure and post-closure estimates accurate. Our P.T.I.F. account currently has more money
than our closure, and post closure estimate.

27. CHANGE TO RECORD OF TITLE, LAND USE, AND ZONING RESTRICTIONS
R315-310-4(2)(e)(v)
The Lapoint Landfill will file a detailed description of the closed site to the County Recorder's Office. The
site description will include:
• A map and description of the closed site and date closure was completed;
• Locations where the Closure and Post-closure maintenance plans can be obtained;
• Boundaries of each phase of construction and height and depth of construction and demolition
waste materials; and
• A statement the site is restricted to open space uses only, in accordance with the post-closure
maintenance plan.
28. POST CLOSURE MAINTENANCE
R315-310-4(2)(iii) & R315-3104(2)(e)(vi)
Final Cover and Integrity Inspections
Qualified personnel will inspect the final cover for signs of settlement and/or subsidence, erosion,
cracking, or other items that could adversely affect the integrity and effectiveness of the final cover.
Items requiring corrective action will be repaired and vegetative cover re-evaluated.
Run-off control system inspection
Qualified personnel will inspect the drainage system. Any malfunctions, such as separated pipes due to
differential settlement, sediment buildup in pipes and/or drop inlets and low points causing water
ponding will be corrected weather permitting.

The Uintah County Commission, its successors or assigns, assumes all liability
for and shall defend, indemnify, and save harmless the United States and its
officers, agents, representatives, and employees (hereinafter referred to in this
clause as the United States), from all claims, loss, damage, actions, causes of
action, expense, and liability (hereinafter referred to in this clause as claims)
resulting from, brought for, or on account of, any personal injury, threat of
personal injury, or property damage received or sustained by any person or
persons (including the patentee's employees) or property growing out of,
occurring, or attributable directly or indirectly, to the disposal, placement,
or release of hazardous substances from the, W½W¼NW¼NE¼,
W½NW¼SW¼NE¼. N½SE¼NW¼, section 11, T. 5 S., R. 19 E., Salt
Lake Meridian, Utah, regardless of whether such claims shall be attributable
to: (1) the concurrent, contributory, or partial fault, failure, or negligence of
the United States, or ( 2) the sole fault, failure, or negligence of the United
States; The patentee shall indemnity and hold harmless the United States
against any legal liability or future costs that may arise out of any violation of
such laws;
4. The above described land has been conveyed for utilization as a solid waste
disposal site. The land may contain small quantities of commercial and
household hazardous waste as determined in the Resource Conservation and
Recovery Act of 1976, as amended (42 U.S.C. 6901), and defined in 40 CFR
261.4 and 261.5. Although there is no indication these materials pose any
significant risk to human health or the environment, future land uses should
be limited to those which to not penetrate the liner or final cover of the
landfill unless evacuation is conducted subject to applicable State and Federal
requirements;
5. Provided, under 43 CFR 2743.2 that title shall revert to the United States
upon a finding, after notice and opportunity for a hearing, that the patentee
has not substantially used all of the land in accordance with the approved
plan of development on or before the date of five years after the date of
conveyance;
6. If, at any time, the patentee transfers to another party ownership of any
portion of the land not used for the purpose(s) specified in the application and
the approved plan of development, the patentee shall pay the Bureau of Land
Management the fair market value, as determined by the authorized officer, of
the transferred portion as of the date of transfer, including the value of any
improvements thereon;
7. No portion of the land covered by such patent shall under any circumstance
revert to the United States if such portion has been used for solid waste
disposal or for any other purpose that the authorized officer determines may
result in the disposal, placement, or release of any hazardous substance; and
Provided further, that the Secretary of Interior may take action to revest title in
the United States if the patentee directly or indirectly permits its agents, employees,
contractors, or subcontractors (including without limitation lessees. sublessees and permittees}
to prohibit or restrict the use of any part of the patented land or any of the facilities thereon
by any person because ot such person's race, creed, sex, or national origin.

4. The reservations, conditions, and limitations contained in paragraphs 1-3
above shall constitute a covenant running with the lands, binding on the patentee
and its successors or assigns in interest for the period for which the lands
described herein is used for the purpose for which this grant was made, or for
another purpose involving the provision of similar services or benefits; and
5 The assurance and covenant required by paragraphs 1-4 above shall not apply
to ultimate beneficiaries under the program for which this grant is made.
